Case Summary

In February 2015, Anthem announced that it had been the subject of a cyberattack which resulted in the theft of information stored in Anthem’s databases concerning approximately 79 million people (the “Data Breach”). The information taken in this Data Breach may have included names, dates of birth, Social Security numbers, health care ID numbers, home addresses, email addresses, and employment information, including income data.

The lawsuit was brought on behalf of the individuals impacted by the Data Breach against Anthem, its subsidiaries and affiliates, and certain Blue Cross and Blue Shield companies who had members with data stored on Anthem’s databases that was taken in the Data Breach, even though they were not Anthem members. The Plaintiffs claim that Defendants failed to adequately protect their personal information and that they were injured as a result. Defendants deny any wrongdoing, and no court or other entity has made any judgment or other determination of any wrongdoing or that the law has been violated.

      I believe it to be legit. With the information on the card to the this lawsuit, it all matches up. (We got one too.)

      Also, when you select the option of “File a claim for credit monitoring services or alternative compensation” it states this:
      “If you received a Postcard Notice in the mail, it contains a 13-digit claim number directly above your Name and Address. Please use that number for faster claims processing. Postcard Notices are being mailed to Settlement Class Members for whom the Settlement Administrator has been provided addresses on a rolling basis through October 30, 2017. Please be patient.”

I bet theses bastards are connected to all this in some way. In the long run they arent loosing anything. Their all in bed together. We had the same thing happen with Bank of Americas class action suit. God only knows how much money Bof A got away with with all their fraudulant charges. Then the people get a mere i think it was like $18.00. This all makes me so sick to my stomach. Thank God people are starting to wake up.

Your identity could have been stolen at a different place or time allowing for the defendants to get away with smaller payouts.

Also, it appears claimants would only receive $36 for credit monitoring if you already have a service. The company I would consider costs much more than that for the timeframe you require.     According to the FAQ available in the main page for this settlement the monitoring of your credit will be provided by Experian. If you head to question 11 it reads as follows:

    Will the Settlement help protect me against future identity theft and fraud?
    Settlement Benefit: Free Credit Monitoring Services

    The Settlement provides a way to protect yourself from unauthorized use of your personal information. Settlement Class Members are encouraged to submit a claim to receive at least two years of future Credit Monitoring Services. If you already have credit monitoring services, you may still sign up for this additional protection.

    The Credit Monitoring Services provided by the Settlement are separate from, and in addition to, the two years of credit monitoring and identity protection services offered through AllClear ID by Anthem starting in 2015, which expired in 2017. You need not have signed up for the previous services to be eligible to make a claim for the Credit Monitoring Services being offered through this Settlement.

    Credit Monitoring Services will be provided for an initial period of two years. Credit Monitoring Services may be automatically extended to Settlement Class Members for a period longer than two years if there are sufficient funds left in the Settlement Fund. More detail about how Credit Monitoring Services could be extended longer than two years is available in Question 19.

    Credit Monitoring Services are being provided by Experian. The features of these Credit Monitoring Services include:

    Daily credit monitoring of the Settlement Class Members’ credit file at all three major credit reporting agencies (Experian, Equifax & TransUnion);
    An Experian Credit Report Upon Enrollment;
    A subsequent, updated Experian Credit Report available at the Settlement Class Members’ election as often as daily (online);
    ID Theft Insurance, which covers certain identity theft related expenses incurred by Settlement Class Members up to a limit of $1 million;
    Internet Surveillance, which includes monitoring of the “dark web” for Settlement Class Members’ personal information;
    Identity Validation monitoring and alerts to notify Settlement Class Members in the event their identity has been verified across the Experian identity network;
    Identity Monitoring of minors under the age of 18 (through their parents or legal guardian), including Social Security number trace, internet surveillance, identity restoration, and identity theft insurance; and
    Fraud Resolution Services that provide professional fraud resolution assistance to Settlement Class Members who experience identity theft or fraud, helping them with identity recovery and restoration.

      Please keep in mind that “reply-to” email addresses can be spoofed. Be sure to look at the destination addresses of the link the email wants you to click to complete whatever they’re asking for. Never go by the “from” or “reply-to” address.

He was 1 of 5 children on husband bc/bs .Are all our children at risk because this is the 1st time mail has come to say anything about data breach.     If this is supposed to be a “fair” settlement, how come Anthem customers are only getting credit monitoring for a year when Anthem confirmed the data breach, which includes Social Security numbers Income information, affected 80 MILLION PEOPLE???

    I very recently received a phone call from someone claiming to be a “BlueCross BlueShield representative”. He asked me to confirm my name, address, and DOB. I called Anthem, and they confirmed this was a scammer, but Anthem said there was nothing they would do on their end. When you do an online search of the scammer phone number, you see reports that he called many other Anthem customers and in some cases he knew name of the policyholders’ doctor.

    The actions by Anthem are A JOKE.

    I also received a postcard today and it sure looks like another phishing scam.
    The website certainly doesn’t inspire any confidence that whoever is handling the settlement or whatever credit monitoring service they are offering isn’t going to just lose the information again on those who respond giving the hackers a verified sucker list.
    I personally am going to wait for a while and see how this plays out before responding. I hope whoever is in charge of this settlement reads some of these posts and hopefully upgrade their security.
    We all should just face the fact that the only ones that get anything out of class action suits are the lawyers.

    I would prefer to receive instructions by regular mail. If I do not fill in my email address, will I receive some kind of instructions by regular mail?     Why must we enter personal identifiable information in the claim form along with a claim id? Can’t you just check the dark web for all the information? Seriously though, low to middle earners will pay for this in fees as institutions are defrauded. Fraud based on the data is unlikely to be traceable and institutions know that. Besides, the institutions will earn a bonus on transaction fees.

    This settlement is even more of a joke than the typical class- action settlement. The consequences of a breach like this are forever, and they want to give me, $36.00?

    I had someone file a tax return in my name;

    I had to take time off from work to file police reports;

    I had to put security words on every banking account I have;

    I had to change my home and mobile phone numbera because I was getting phone calls from supposed overseas pharmacies who knew my doctor’s name and what medications I took;

    I had to freeze all my credit (which is a real PITA, by the way – – try buying a phone or getting utilities turned on without a credit check);

    And I have to deal with crap for the rest of my life:

    And they want to give me $36.00???

    I think I’m going to file an objection to this one. I’ve never done it before, but this settlement is so paltry as to be unconscionable.

      I agree completely. That is why it is time to get rid of the Social Security Number as a universal credit identifier. The problems using the SSN are to numerous to list in a short comment, and there are more cryptographically secure means of protecting people’s identity now than in the 1930’s when they came up with Social Security. I have written my entire congressional delegation about this problem, and I would recommend that everyone on this forum to do the same. Richard, if I may be so bold to suggest, you should write everything you’ve written here, by hand, to your congressional reps. Tell them you want a minimum of 128-bit cryptographic signatures to replace the SSN. It does get attention.

      If your data was compromised by the data breach, then you are entitled to damages if *you* can prove, in court, that *you* were damaged by the data breach. You have to bring the court evidence of damage to make a claim. If you don’t have it, the case is dismissed due to lack of standing* (no damages). If you have evidence that someone used the information from the data breach to steal your identity, then you would have a case. But attorneys for the defense have deep pockets and can delay the start of a trial with endless motions. If you have the means, you should fight them. For the rest of us, there is a class filing. That is why you have the card. This settlement is the work of attorneys who have projected how many people will actually be harmed by the data breach, with the rest the class catching false info in their credit reports early enough to avoid damage. If you don’t like the outcome of this settlement, you are within your rights to sue, but I wish you luck.

You are entitled to receive assistance if you have a fraud issue and you are entitled to get money reimbursed if you incurred expenses associated to fraud or to protect yourself from fraud.

    I want to Opt Out, to retain my right to sue Anthem for any future damanges resulting in the data breach.
    One or even two years of credit monitoring is a joke. Our personal data is compromised forever!
    Because the affected parties, my minor children, will likely be unaffected in the near future since they are still too young to apply for credit or conduct any financial transactions, I want to reserve the right for them to take legal action in the years to come.

    I suppose the downside to this course of action is that with so many data breaches (e.g. Equifax Data Breach), it will be difficult to prove the source of the data used by identity thieves. I suppose there may be an apportionment of liability based on the number of parties that have suffered data breaches.

    I imagine it will be my responsibility to keep track of all the data breaches from now on and to inform my children of all of them, so they can respond accordingly when they become victims of identity theft.

    My spouse had me covered under his plan, and I covered him under my Anthem plan.

You need not have signed up for the previous services to be eligible to make a claim for the Credit Monitoring Services being offered through this Settlement.

    Since our credit monitoring by AllClear is no longer in effect, and we will not be eligible for additional free monitoring until the after the Fairness Hearing on Feb. 1, 2018, am I to understand that we have had no credit monitoring or identity protection services for the last 8 months?

    I received a post card about the Anthem Breach. I have been trying to get the online application finished and sent for days, but it keeps telling me invalid email address.
    Whenever I call the number on the post card, it is all automated, with NO options to speak to a human being.
    This whole situation is EXTREMELY FRUSTRATING FOR US ALL. We should at least be able to talk to humans about ours options.

    The judge approves or disapproves the payment to class counsel for their work. Your personal damages are calculated based on the risk you have of having your information used and how that risk can be proved to be associated to this breach. Anytime you feel you deserve more you have the option to object and go after a company on your own through self representation or by hiring your own attorney. You are not at the mercy of the evil attorneys that brought the class action.

    It is Jan 27, 2018 and I want to submit my request for credit monitoring. I went to the website on the postcard but there are several websites listed. How do I know which one is legitimate before entering more of my personal information for fear of clicking on a website that is a fraud?
    Also, If we have the claim no. from the post card, why do we have to enter so much personal info?
    Shouldn’t the claim no. be enough?

I signed it and sent in back in in 2017 but I haven’t gotten any response to let me know that they have received it. someone has already tried to get money out of my bank account someone in Florida and Georgia. I had to close my account. I also got a paper from Equifax due to fraud.

    Here’s the rub from my end of this shit show ! My identity WAS stolen and used to steal my tax return ,3 years and still haven’t received my refund yet I lost my pickup because I was unable to meet my agreement of a pay off with my 2014 tax return!!! My identity has been and is still being used all across the UNITED STATES my credit has been reduced to a freaking joke damn glad I paid my bills on time my whole life just to have the credit score of a crack head “thanks ” and my company I worked for TRI-PRO FOREST PRODUCTS of OROFINO ID closed down putting me out of a job two days after i found out my identity was being used to collect my taxes and apply for credit cards I filed a report with the police about the identity theft and notified my bank of the situation, so I finally get the go-ahead to file my 2014 taxes and wouldn’t you know it H&R BLOCK of Moscow ID. Screwed me by putting my 2014 return on a 2015 form .had to refile paying Fucking H&R BLOCK AGAIN for the same year and they fuck it up again at which point I get a tax advocate to straighten out my tax returns because now I’m trying to get 3 years of tax returns back yeah right 2018 and I Still haven’t received my refunds from the Feds entirely H&R BLOCK has seen more money than I have !!!! Right stand by their work fucking joke , so by now I have hundreds of hours into proving who I am getting my ss# back and secure yeah right joke forced to move back to our home state and city to have family help out and loan us a camper so after being homeless for 5 freaking months we can’t even rent a place because my credit is FUCKED now I’m in a shitty over priced 1000.00$ a month appartment with a freaking 1991 Subru wagon that’s a death trap trying to make ends meet and save enough to get out of here when our lease is up in July all while working for wages I made in high school another fucking joke just to find out the insurance company never paid for my work related injury so now I’m stuck with the bill with not a damn dime to my name to spare . And then I find out about this law suit and the chance to get back what has been stolen from me and they want to pay FUCKING WHAT $36.ARE THEY FUCKING JOKING ,!!!!!! I have more than that paid out in stamps dealing with this FREAKING mess my life has been destroyed completely to the point where I see no joy in this world and trust no one the stress has ruined my marriage and made me a complete head case wondering who is going to fuck me over next I’m tired out of options broke both mind body soul and financialy living off romen trying to work with a hand that was crushed the last week of my job and not documented after being reported to my supervisor “Joe”so I labor on with a hand that I can’t flatten out now and can hardly write my name with now broke down feet from living on concrete floors in the mill ,to be told my career as a planerman is done no work learn a new career again at almost 50 . Fuck add it all up I should just give up git some life insurance and take a long walk in the deep woods and feed the fucking wolves at least my wife would be taken care of better than what I am doing now one meal a day sometimes pisses me off I’ve worked every day since I was 16 and to have someone I don’t even know take everything from me is just wrong where is the justice and accountability and fairness I deserve and that is the question I want answers to please……
