Case Summary

The lawsuit alleges that certain barbecue grills, with model numbers 01566, 03495, 16142, 16154, 23673, 23676, 23681, 23682, 23683, 23766, 34172, 34176, 34178, 34308, and 34611 (the Grills), sold by Sears were manufactured with firebox trays made out of galvanized steel, making the firebox trays defective and resulting in the firebox trays rusting and failing prematurely. Sears denies the claims of Plaintiffs, denies all allegations of wrongdoing, fault, liability, or damage of any kind to Plaintiffs or the Settlement Class, denies that the Grills were defective in any way and that it acted improperly or wrongfully in any way, and is entering into this Settlement to avoid burdensome and costly litigation. The Settlement is not an admission of wrongdoing.

    I put these grills together for the home depot.
    These stores do not make the grills. Kenmore does. You can’t hold Sears liable. These no proof that these did fail.

      I also own a company that put grills among other things together for Home Depot and Lowes. I actually have one of these on my deck and, yes, the pan rusted and failed.

      This is a settlement in which Sears is offering to provide $180 gift card, $125 check, or firebox replacement in exchange for not having to admit wrong doing. All anybody who joins this class cares about is getting some redress from Sears for their defective grills. There are hundreds if not thousands of people who will be a part of this class. Sears would not sign on if they weren’t concerned about their liability for their grills.

      Go to the Sears you purchased the grill from they should have a record of your purchase and that will satisfy instead of your receipt. Sears should have a history of your purchases on their database.

      On March 1, 2017, the admin filed an unopposed motion for disbursement of the funds after appeals were dismissed. Presently there is no timeline for payment.

      Heidi, Who in Gods name keeps receipts for 5 or 6 years? We received on as a gift from my family for Fathers Day in June, 1912. Guess it’s good for you, so that’s one more rebate that you can screw a legitimate purchase from being paid.

      The role of a class action administrator is to distribute as much of the money as possible while preventing fraud. The rules of a settlement are often decided by a judge. In your case however, since the grill was purchased in 1912 which was the very beginnings of Sears you do not qualify. These grills did no exist then.

      YOU CAN GO TO SEARS WEB SITE AND REQUEST CREDIT CARD INVOICES WHICH WILL SHOW THE PURCHASE AND PRICE,GOT MINE IT GOES BCAK 20 YEARS,THEY PRINT AND MAIL THEM TO YOU.

    I believe you have to file a paper form and select the receive as a gift option if you were not the original purchaser.

    Regarding my receipt issue, I contacted Sears Credit Card Services and they promptly sent me a courtesy copy by USPS within a week. The Kenmore gas grill that I purchased started rusting with 18 months of purchase (June, 2013) even as it was constantly under cover. The rust is so bad now that unless I want to call the fire department, I dare not fire it back up.

    The claim form also affords the option, in absence of a receipt, to rely on Sears records. Since I purchased this grill in 2012, and used my club card, they surely must have a record. I bought the grill in the Sears store in Ramona, CA. I now live in North Carolina, so going to the store is not an option. I submitted very clear pictures of an incredibly rusted through fire box. I have always kept the grill under cover and int he garage in the winter. The level of corrosion of the fire box was incredible, considering there is no other rust anywhere on the grill itself. I’d just like to get it fixed, and don’t want to go without a BBQ for an entire summer waiting.

    Fact: Sears is Kenmore.
    Fact: If you purchased a grill at Seats they have a record of the purchase. No receipt needed.
    Fact: Sears will not directly stand behind a defective grill if it the warranty has run out (approx. 1 yr.) unless you purchased a “plan”.
    Fact: The settlement company has indicated to me NOT to expect any form of compensation ($135 cash or $180 “gift certificate”) for at least 6 months.
    Fact: My Sears has indicated they can/will do nothing further to remedy or replace my grill.
    Fact: I paid $279.99 ion May 1st, 2014. The burner plates went within 18 month. Sears locations do not stock. On line replacement cost and freight was nearly HALF the cost of the grill.
    Fact: The remained of the fire box and burners rusted out in March, 2017. A settlement form was received (coincidence?) within a week.
    Fact: Next grill will not be purchased from Sears. . . nor will I make ANY new purchases from Sears.
    Fact: Customer Service is no longer a Sears benchmark. .

    I have the exact same problem with a Model 1486156210. It was purchased for me as a gift at Christmas 2012 and the firebox rusted out. I have written to Sears Customer Service, as well as directly to Mr. Edward Lampert and received no reply. I still have the grill although it cannot be used any longer. I also sent pictures along with the letters. Very poor service.

    I filed receipts for old and new grill along with rusting picture of fire box. I received notice of deficient claim for a type 5 claim that I need documentary proof of Sears charge or quoted an amount over $300 for repair as my new was over $300. I am not looking to get the amount over $300, just the $300. I don’t think I should be type 6 as I have all the documentation and proof.

    I filed for my store credit for $180.00 on March 2, 2017 and have not heard a thing from Sears since. The grill was the worst piece of junk I have ever purchased. Have since gone back to a Webber, absolutely perfect. I’m wondering if I will ever see a dime from this. I haven’t spent bought a single thing in Sears since. No mystery why they are closing stores all over.
