Case Summary

• Plaintiffs, Marshalls and HomeGoods Merchandise Assistant Store Managers (“Merchandise ASMs”), claim that Merchandise ASMs should have been paid overtime for all hours worked over 40 in a week. The lawsuit claims that Merchandise ASMs perform non-exempt tasks as their primary duties, as described in Section I below. Even though you were paid a salary and may believe that you were not entitled to overtime, you may join this case. If you join this lawsuit, and the court determines that the case should proceed as a class or collective action, and Plaintiffs prevail, you may be entitled to overtime wages and other damages.

    Would this include TJ Maxx Asst. Store Mgrs. too? TJ Maxx is a part of The TJX Companies.

    Class eligibility is very specific and does not include TJ. It reads as follows:

    If you are or were a Merchandise Assistant Store Manager employed by Marshalls or HomeGoods between November 1, 2012 and March 31, 2017 you may be a member of the class

    This is a disgrace to employees who don’t get paid for all the work people.If you wonder why people don’t want to work well this is why.

    Homegoods associates are treated like cattle, They are constantly pushed to go faster, The same if you are a cashier, You are timed on everything,even those who are required to do housekeeping,Some stores do not have a cleaning crew, They are also pressured,,They make no more than an associate, It’s manuel labor! , Managers benefit from this type of harrassment with their large bonus,
    It’s not wonder they cannot keep employees,

    I filled out the letter I received but I did not received a settlement check? M employed through Marshalls from 10/2002 through recent.
