You are a member of the class if, between January 22, 2009 and July 8, 2014, you were a California resident who purchased Proactiv products from Guthy-Renker and, as a result of that purchase, were automatically enrolled in Guthy-Renker’s automatic delivery and automatic renewal billing policy and charged for additional products and shipments beyond your initial purchase.

Case Summary

The Class Representative claims that Guthy-Renker LLC (“Guthy-Renker”) violated California Business & Professions Code §17600 et seq. by enrolling Class Members in automatic renewal billing for Proactiv products, allegedly without complying with the statute’s disclosure requirements and other requirements for automatic renewal billing practices. The Class Representative also asserts related claims for violation of California’s Consumer Legal Remedies Act, Civil Code § 1750 et seq., violation of California’s Unfair Competition Law, Business & Professions Code § 17200, as well as fraud, negligence, and breach of contract.

      I ordered proactiv a couple of times , once from QVC on tv and the next time proactiv contact me and ask told me, they were sending me another order of their skin care products out to me. I ask the operator not to send me anymore because this product did not help my skin problems. The operator on the phone told me that she would not send anymore proactiv to me. This operator continue to send this product to my home although I ask her not too. They charge 29.99-89.99. This continues about a year. The company was taking money out of my banking account without my permission. This continue until I contact the customer service and threaten to get in contact with consumer affair. I had to contact my bank and make them aware of what was going on. Each time they would send the product to my home I would make sure I send it back to their company and tell them why I did not want any more of their products.

    This was at least six years ago when I bought the product, paid for it, later received products that I didn’t order, carried unopened box to post office to be returned, they are still trying to collect money from me.

    My son and I bought this in Utah. They kept billing even though we kept returning. It didn’t even help him as it was! How about a nationwide suit? So many in other states were affected as well.

    Pro Activ works but their billing is horrible! Once they get your info, they ship every month and bill forever!!!! I tried and tried to cancel in writing but they ignored it!! Pam from Ohio

    I ordered proactive after seeing the infomercial for $19.95. A month later my bank account for hit for $45.00 and overdrew my account. Then they billed me every month after I told them to cancel me.

    Why not nation wide, I live in Wisconsin.. They have done the same to me as to all of you.. How can these companies get away with this.. I am a hard working single mom of 2.. The first intoduction price was $19.99. The next month $45.00 later, I had a over draft on my account. I called them numerous time to stop sending this product to me.. But they still keeped taking money out of my account.. I had to block them from my account.. What a flipping joke.. Why is there only settlement in certain states…
