You are a member of the Settlement Class who may receive benefits under the Class Settlement if you are a resident of the United States, who enrolled in, or *updated a 24 Hour Fitness Prepaid Membership on or after April 1, 2006, and were still enrolled in a Prepaid Membership as of April 1, 2015, as indicated in 24 Hour Fitness’s membership records system.

The lawsuit alleges that 24 Hour Fitness promised its customers when joining the gym that, in exchange for signing up for a Prepaid Membership, customers would be entitled to a fixed Annual Renewal Amount for life, so long as they remained Prepaid Members in good standing and timely paid their Annual Renewal Amount, but that despite its promises, 24 Hour Fitness began increasing some Prepaid Members’ Annual Renewal Amounts beginning in April 2015.

    When I joined on a month to month membership it was with the understanding that my membership fees would be for life at the rate I signed up for. Yet they continue to raise my rates once or twice a year. Not by much but they do raise them. This suit should be about the members who are on a month by month program too.

    I really wish I could get into this Class Action Settlement, I used to be a member, till I was diagnosed with MS and unable to go to the gym anymore, I wrote many letters letting them know I was unable to continue using there gym, with no response from anyone, not even the head quarters office, but they didn’t have an issue turning my account over to a collection company, which I’m still paying to, for something I can’t even use anymore, I will never recommend this GYM to anyone ever!!! I am asking if there is an update on what is going to happen, because I just received my annual billing from 24Hr and no change in price has happened.       June 1, 2018: The Court will hold the Fairness Hearing at 9:00 AM.

      TBD: The Final Settlement Date. The Final Settlement Date is the date on which the Order and Judgment becomes final, which shall be the latest of: (a) the date of final affirmance on any appear of the Order and Judgment; (b) if there is an appeal or appeals, other than an appeal or appeals solely with respect to the award of attorneys’ fees to Settlement Class Counsel, and/or incentive awards to the Representative Plaintiffs, the date of final dismissal with prejudice of the last pending appeal from the Order and Judgment; or (c) if no appeal is filed, the expiration of the time for filing or noticing any appeal from the Order and Judgment.

    I have a lifetime membership with 24 Hour Fitness. The one where they said I wouldn’t have my membership fees yearly. I submitted my claim form. Although the settlement hasn’t been received yet, . I recently received a bill $99.00 for this years membership dues. I thought this class action suit was supposed to resolve this issue. Do I have to pay this yearly membership dues of $99.00?

    Reach out to the class action administrator. I don’t think the intent of the settlement was to eliminate your annual dues, it is more intended to ensure your dues remain the same as indicated in the initial contract.

    I got the notice that it was going to go up from $49.99 to $99/year back in 2015 and I did not agree to that b/c the sales rep told me that it would never increase as long as you pay that $49.99/year. I said, “Not for me” and left. But it sounds like I can get back my membership at the $49.99/year deal I got back then.

    What is the result thus far? I would really like to know.

    The claim is that form they sent you in the mail to mail back? Also my membership when from 49.99 to 230.00 a year does that mean ill get reimburse for all those years? And hopefully my membership didn’t get messed or effect my reimbursement up cause at one point they canceled my membership in 2017 by error and had to re enroll me back to my original prepaid plan which totally erased my track record on how many times I went into the gym.

    I paid my membership first time increase in August 2017, then I had an jury that prevented me to continue. Forgot all about the membership and the law suit until its due date in 8/28/2018. I did not submit my claim in time because I did not aware of any notification of the law suit. Can I request them to let me pay my original feed (about $50 per year). I hated when I have to pay because someone decided to cheat.

    When they raised my fee from $49 to $149. One of their employees suggested to change my membership fee of $149 to 12 monthly payments. He said in case they raise the fee again, it will only be 10% of the monthly fee ($13.43). So how do I make the change, so I just paying $49 a year ???

    If you submit a Valid Claim Form and Declaration (attached to this Notice or available at http://www.prepaidmembershipsettlement.com the following applies:
    If your Annual Renewal Amount has already been increased, (1) it will revert back to the Initial Annual Renewal Amount, (2) you will receive a refund of any increased amounts already paid, plus applicable taxes if any, and (3) you shall be entitled to renew your Prepaid Membership for the Initial Renewal Amount plus applicable taxes, if any, in the future, as long as you timely pay the Annual Renewal Amount and remain a Prepaid Member in good standing.

    I have gotten my refund check I am totally happy! As for changing the rate of my plan to original annual I have spoken to my local 24hour fitness they informed me that my record says it will take effect on my due date in November since my renew date is November. Hope this helps.

    Hi, I received a check of $150.00 corresponding to 3 years of reimbursement of when my Annual membership dues went from $49.00 to $99.00. However, it did not include to the latest $99.00 (4th year) Annual membership dues I made on August 8th, 2018. I assumed this last payment was missed, because it was made shortly before the settlement check was cut. The check is dated 8/20/2018.

    I have faxed and mailed all supporting documents to Rust Consulting on 9/13/2018, I have not received any response. Please help.

      Hi Thomas, I also didn’t receive $50 becuz I paid my renewal fee of $119 in August, the same time the first checks were mailed. So, I contacted the claims administrator in Mid October. I submitted my payments history and I received the missing $50 check directly from 24 HR the next week. Tell them if you don’t receive the $50 check you will contact class counsel and the OC District Attorneys.

    Not only have they raised the life time membership rates, they are redefined most of the facilities so they are now Club Sport so the life time rate does not apply to Club Sport facilities. Very dishonest. All they added to the facilities that I am aware of were free towels. I had to pay and change my membership so I could go to the other facilities and then they redefined them again. At this point, I can only go to the original facility I signed up for almost 14 years ago. Very dishonest. What should I do?
