Case Summary

Plaintiffs claim AEO violated the TCPA by sending text messages to cellular telephones between April 8, 2010 and January 24, 2017, through the use of an automatic telephone dialing system without prior express consent or where any such consent had been revoked. AEO denies these allegations and denies any claim of wrongdoing. The Court has conditionally certified a class action for settlement purposes only. The Honorable Valerie Caproni is in charge of this action.

        I was reached out to do to American Eagle Outfitters texting my phone a couple years ago and submitted a claim for this lawsuit and have yet to receive anything or hear anything else since submitting my claim online and through the mail.

    The final approval was on Sep 11. Now the admin has to validate all claims. I would give it at least another month before we can find out the approximate date for checks.

    All – from reading articles on Law360, in September the judge said that the proposed settlement of $10,000 each for the four named claimants was way too high, and reduced their payments to $2,500 each. Perhaps that’s what was appealed? (Just guessing.) Or perhaps Experian is still trying to get out of it?

    Some appeals can take years if not decades. As the appeals take place the overall settlement pool could potentially be revised to address attorney’s fees.

    I just spoke with the law firm handling the claim and they said that since it was appealed, it’s due to go up in court on 11/5/18 and afterwards, it could very well take up to 5 months to finally wrap things up. Be patient and optimistic.

      The first step is to check the official website to see the general status of the settlement. If the page has disappeared it means the case was paid out and you no longer have recourse.
