Class Eligibility

To be a member of this settlement you need to be a person or entity in the United States who had a consumer or small business AmEx credit card or charge account with American Express Bank FSB or America Express Centurion Bank and:

  • Had a fixed annual percentage rate on the account that was increased or changed to a variable rate between Oct. 1, 2005 and Dec. 31, 2010; or
  • Had a fixed annual percentage rate on the account and were provided notice of an increase in the fixed rate or a change from a fixed rate to a variable rate between Oct. 1, 2005 and Dec. 31, 2010.

    MY CHECK ISSUED IS ALREADY EXPIRED. I WASN’T ABLE TO DEPOSIT BECAUSE I’ M GONE FOR A WHILE FOR A VACATION SO I JUST RETURNED TO MY HOME LAST 3 WKS AGO SO I DEPOSITED THE CHECK THE AMOUNT OF $117.33 BUT THE CHECK CAME BACK SO THE BANK CHARGED ME WITH A FEE OF RETURNED ITEM

    Once the checks expire you no longer have any legal recourse to obtain a duplicate.

    Generally checks that expire from a settlement cannot be reissued. The funds become part of a secondary distribution.

    We are faced with the same situation. We moved in the time this case was settled. Now the check is void. There should be an option to reissue as others are obviously experiencing the same frustration.

    The best way to avoid this is keeping a list of your pending claims and always forwarding a notification of change of address when moving.

    I received a small settlement check Dec 28 2018. I do not remember filing a claim. Is this check legitimate?

    Most likely it is legit but without having a visual of the check and cannot provide you with further guidance.
