To be a class member you must have purchased gasoline at ARCO and ARCO-AMPM gas stations in Oregon. Purchases must have been completed between January 1, 2011 and August 30, 2013 using a debit card, and the purchaser must have paid a transaction fee.

      Don’t give anyone the last 5 digits of your bank card. You don’t have to give any information to get the settlement if you are in the class suit. You only have to contact them if you think that you should get more from the settlement. Certain Sites can scam you out of your settlement! Have a blessed day you all! 😀

    A lot of good this lawsuit turned out to be. ARCO has and is in the process of converting their stations to a two tiered pricing, meaning a price for CASH and a price for DEBIT/CREDIT card price. Using your card will cost you 10+cents more a GALLON. ARCO customers paid 35cents before to use of a card regardless of the number of gallons purchased, NOW ITS 10 CENTS PER GALLON! The result is the LAWYERS will make money while the customers get to pay 10+cents more per gallon when they use a card. THANK YOU LAWYERS!

An if it’s so called illegal why isn’t the state stopping these fees with such a huge company with tons of locations across CA. I thought the State regulates gas stations for pricing,measurements,taxes etc…

    This looks like a classic delay tactic where the longer it’s delayed, the more people are going to lose their rightful award. I’m absolutely sure that MANY of the plaintiffs have moved, changed bank accounts or even died waiting for BP and the lawyers. This is a clear case of manipulation of the system and should be taken into account by the jury upon the final decision under the scope of punitive damages (punishment). If this isn’t true… Tell me why there are no updated documents showing the appeal and progress. Does the court just forget about it until the defendant decides to respond, that’s not the way it’s supposed to work.

      So I also received a postcard haven’t thought much about it until I gave my debit card at Arco at the pump – requested debit punched in my pin; thinking it was cash price which is a .10c difference per gallon. When I looked over at the pump while it was pumping I noticed it was the same as credit price. Apparently Arco doesn’t view ‘debit’ the same as cash. Confusing. It’s basically still happening and if not worse because it’s .10c a gallon instead of the .45c a transaction.

    I was offered $200.00 not to sue but that was so long ago I almost forgot that . However they are the ones that forgot they made the offer. Also the threat of suits doesn’t seem to bother them not only do they not honor their word but still charge 10 cents a gallon to use our card.I finally wised up and buy from Fred Meyers not only do they not charge me for the card but the gas is better.Also they give a 3 cent discount which usually brings the better gas as cheap if not cheaper than Arco’s rip off card scheme.

      They have not paid out anybody on this at all. BP is going to appeal this to the Oregon Supreme Court. It’s up to the supreme court to set a date and get this thing done. So as long as these attorneys sit on their ass and procrastinate month after month after month after month we may not see $200 for a very very long time. All I can say is Mark your calendar every six months and Google class-action lawsuit against BP and see if there’s been any update. And please people would you quit posting about California this only pertains to Oregon. If you people want to sue them in California you do it but it has nothing to do with this Class action lawsuit.

    The Oregon Court of Appeals on Thursday upheld a $409 million jury verdict against BP, the oil and gas-producing giant, for misleading gas station customers by tacking on a 35-cent debit card fee to their purchases without proper notice.

    A Multnomah County Circuit Court jury ruled in 2014 that BP must pay the money to more than 2 million individual customers who bought gas in Oregon from ARCO and am/pm stations using their debit cards over nearly three years from 2011 to 2013.

    The stations were independently operated but beholden to follow rules handed down by BP, according to the Appeals Court decision. The rules included a prohibition against advertising the 35-cent fee on large street signs visible to people driving. The stations also didn’t show the fee at the pump, the ruling said.

    David Sugerman, one of the attorneys representing the plaintiffs, said it wasn’t until customers had filled up their tanks and walked up to the register to pay that they were notified of the 35-cent debit card fee.

    “The gas was already in your car, you would go inside, and congratulations, your $10 of gas is now $10.35,” Sugerman said.

    Attorneys for BP have said the fee was clearly advertised within the stations and that the company wasn’t misleading customers.

    “BP strongly disagrees with the decision by the Court of Appeals and will appeal to the Oregon Supreme Court,” said BP spokesman Brett Clanton. “We continue to believe that our debit card practices were lawful and consistent with our goal of providing our customers quality fuel at the lowest possible cost.”

    After the verdict, the class action-members of the lawsuit were due $200 each, as called for under Oregon law. But they haven’t been paid, because of the company’s appeals.

    The amount due will continue to rack up annual interest of 9 percent, pending the outcome of an Oregon Supreme Court decision.

    In siding with the class-action plaintiffs, the Appeals Court rejected arguments from BP that the $200 to be paid to each wronged customer was constitutionally excessive.

    The Appeals Court also disagreed with BP’s contention that it didn’t violate state consumer rules. The court noted that only customers paying in cash would get the gas price advertised on street signs. At the time, almost all ARCO and am/pm stations accepted cash and debit cards, but not credit cards.

    The company argued that Oregon’s Gasoline Price Advertising Rule didn’t apply to its “flat-fee” debit card add-on.

    ARCO and am/pm have more than 25 gas stations in the Portland area and dozens more throughout the state.

I come to Oregon all the time because that’s where I grew up. We have been GAS STATIONS that hike up their prices after getting gas.     Ampm in California still charged $0.35 as of today. They have a waiver and state law allows them to charge up to a dollar if they want. Just don’t give a r c o any of your business. There are a bunch of scammers. So now they charge $0.10 a gallon extra for credit debit cards. So 20 gallons now is going to cost you an extra $2 instead of $0.35. Only one made any money here is the attorneys. Screw the little people again.

    I don’t remember being charged a $.35 fee to use my debit card, but I remember being charged a higher price per/gallon at the pump if I used any credit card, and that ended up raising the total bill quite a bit when I filled up my motor home ‘s 85 gallon tank!!! …………. so I got the notice back in 2018, but have heard nothing sense.     I have received a postcard in the mail for this. I got a letter in 2011 completely forgot about it. I was in KS.(active duty) at the time. Now in NC I got another postcard on 05MAY19 stating that people in the lawsuit will be awarded at least 185$ split disbursement within 30 days 15JUL19 and 15JUL20. Has anyone else got their check? Has anyone else received this post card? Also in the action it states a 3%? is that 3% simple interest of what I spent in 2011 up to 2019?

    Have the checks for the settlement been mailed out, yet? If so, who are the checks coming from? I just wanted to know so I can keep an eye out. I had read that the first batch of checks were to be mailed out in August of 2019.
