Class Plaintiffs allege that the Aspen-brand Series BB evaporator units, including the coils, pans, and all component parts, were defectively designed and manufactured and, as a result, prematurely rusted causing rust to discharge through condensate drains and leave rust stains on property and/or blow rust particles into the homes. Aspen disputes these allegations that its product was defectively designed, manufactured, assembled, supplied, sold, distributed and/or warranted.

We are also waiting to hear about the settlement. We had to replace our 2 units due to rust completely through. Replacement of units was over 8K. Please let us know the settlement!

Hi I’m a home owner as well a team check a team of people went into my home and went to the attic they took pictures of the back of the home and there’s rust all over the walls window and floor and air evaporator it’s still the same will the replace the evaporator coils and clean the wall from rust everywhere and how am I getting $220 dollar’s for damages is this legit.

Did you go look at the walls to see if there was evidence of rust in the stucco? It is possible that more than two of your rentals have a problem.
these are occupied rentals. i will have to submit all of them. there should be a list somewhere but ok.

I did not get a distribution check. Is it true that distribution checks were sent out in July 2018. That is right now. The inspector checked my AC unit I do have the coil still.

Good Morning William, I have tried to no avail to speak w/someone on the phone# provided. I purchased my home at 1631 Fieldbrook Street, Henderson, Nv 89052 in October 2015. In late Spring of 2016 I requested a cooling check by Alaskan Heating & Air, Las Vegas when the cooling did not seem to be working in the house. It was recommended that if the unit was repaired it may/may not last the summer so it was decided to replace the entire unit to avoid a breakdown and costly repair during the heat of summer. I have no photo’s of the old unit, although I was told at the time that many of those same units had problems here in the Sun City Anthem Community. Please contact me as to how I should proceed. When you filed your claim you agreed to the terms irrevocably. The check is all you get. The defect in the units is not severe enough to require replacement.

I haven’t received a check from this lawsuit, my neighbor got his, I filled out the form that was mentioned in the “yellow card” I got in the mail. Yes my home got damaged from the ac unit. Aspen built in 2004, I need some answers why I didn’t get my check.
