Case Name
IN RE: ASPEN SERIES BB EVAPORATOR COIL LITIGATION Case No. A-14-710463-D; DEPT. NO. XVI District Court for Clark County Nevada
Case Summary
Class Plaintiffs allege that the Aspen-brand Series BB evaporator units, including the coils, pans, and all component parts, were defectively designed and manufactured and, as a result, prematurely rusted causing rust to discharge through condensate drains and leave rust stains on property and/or blow rust particles into the homes. Aspen disputes these allegations that its product was defectively designed, manufactured, assembled, supplied, sold, distributed and/or warranted.

  21. Mary McAuliffe says:

Good Morning William, I have tried to no avail to speak w/someone on the phone# provided. I purchased my home at 1631 Fieldbrook Street, Henderson, Nv 89052 in October 2015. In late Spring of 2016 I requested a cooling check by Alaskan Heating & Air, Las Vegas when the cooling did not seem to be working in the house. It was recommended that if the unit was repaired it may/may not last the summer so it was decided to replace the entire unit to avoid a breakdown and costly repair during the heat of summer. I have no photo’s of the old unit, although I was told at the time that many of those same units had problems here in the Sun City Anthem Community. Please contact me as to how I should proceed. Thank you in advance,

    ADMIN – Hi Mary,

You need to contact the class action administrator directly.

  22. Nancy rubi says:

I received a check for 1 unit but I have 3 air conditioning units in my home my neighbors were all paid for the 3 units. My phone number is 951 313-7521 my address is 7037 Villada St n Las Vegas 89084

    ADMIN – Hi Nancy,

    Contact the class action administrator.

  23. Philip Needham says:

Received check for 2 units today. How much does it cost to replace the units? Can we choose to replace the units instead of this “doesn’t make a dent in the cost check”? Thank you for your time!

    ADMIN – Hi Phillip,

When you filed your claim you agreed to the terms irrevocably. The check is all you get. The defect in the units is not severe enough to require replacement.

  24. Patel says:

I got this following email today.

” I am the inspection scheduler for your zip code 89002.

Your home on …………. is on our submitted claim form list for this zip code, thus I tried to call the phone number you provided.

So I thought I’d try to email to set up the inspection of your A/C units to verify they are part of the Class Action lawsuit. If they are then you will receive about $220.00 for each A/C unit that is part of the lawsuit.

Give me a call to set up the 15-20 min visual inspection at my phone number below.

You can also visit the Class Action lawsuit info website at

If you have a management company handling the property, they or the tenant can call me directly too.

    Thank you,

Is this legitimate or some kind of gimmick?
Is it ok for the so-called inspector to allow entering the attic to check some silver box ?

    ADMIN – Hi Patel,

It looks real to me. You may want to double-check by calling the class action administration

  25. Thamer arafat says:

    ADMIN – Hi Thamer,

To obtain answers you must reach out to the class action administrator. Their contact info is posted above.

  27. LAURIE J DROBKA says:

Since Total Class Solutions did not send a 1099 tax form for this settlement, does anyone have the TIN so I can complete my taxes?

  28. Loretta Hellrung says:

Hi – I have 2 Aspen Series BB Evaporator Coil Units and was never notified that there was a class action suit.
What can I do about this please?
    Thank you.

    • Angelica (Admin) says:

Hi, Loretta. Thanks for your message. However, since we are only a newspaper of class action settlements, we have no direct connection to the cases we report about. As soon as we hear of open settlements, we post the news here; what happens to the settlement after that, we no longer post about. It’s up to our subscribers to follow up directly with their respective claims/settlement administrators and/or check directly on the settlement website (always linked above) for updates. Hope you eventually got in touch with the settlement admin.

  29. Shawna M Goodman says:

Is there a deadline for claims?

    • Angelica (Admin) says:

      Hi Shawna,

Upon clicking the direct settlement website links above, it appears the pages have already been taken down.
