Case Name
Liptai v. Spectrum Brands Holdings Inc., et al., Case No. 2018CV000321 Dane County Circuit Court, State of Wisconsin
Case Summary
This lawsuit is about the branding, identification of the manufacturer, identification of the warrantor, and the “cup” capacity of the covered products. Specifically, the Class Represenstatative alleges that defendants misrepresented that the covered products are manufactured and warranted by Black & Decker and Farberware, when in fact they are not. The Class Representative also alleges that defendants represented that the coffee makers produce a certain number of “cups” but that they did not produce 8- fluid ounces per “cup.” Defendants deny these allegations and the Court has not ruled who is correct. The parties reached an agreement to avoid the time and expense associated with further litigation.

I had purchased a BD can open in 2016. A sale item that, I thought, was a good deal. The can open broke within 30 days.

    ADMIN – Hi Garry,

This settlement is not about quality

  6. P says:

I have some of these items, but I’m curious: how does the cup measurement issue affect items such as can openers and electric knives?

    ADMIN – Hi P,

It relates to the point of manufacture of all appliances.

  7. David King says:

I have a BD coffee maker, can opener for my wife, toaster, and few other things. Few I threw away because they no longer worked.

    ADMIN – Hi David,

I don’t think this settlement has to do with appliances that break.

    NO180/600 (RPM)

    ADMIN – Hi Ronald,

A drill is not considered a small appliance.

  13. EZ says:

I don’t know how they expect you to have the model numbers on hand still. I bought a coffee grinder on sale at a brick and mortar store a few years ago and gave it away as a gift.

I just wrote “COFFEE GRINDER” in the model number field. Hopefully that works.

    ADMIN – Hi EZ,

I don’t think it will but keep us updated.

  14. Shawna Fulton says:

I have can opener, toaster, coffee maker

    ADMIN – Hi Shawna,

It sounds like you are a member of the class.

  15. Tink says:

Lol. It is ridiculous that people act like they bought specifically B&D items consistently for every item listed.
    Come on People l!

    ADMIN – Hi Tink

Perhaps they are huge fans of the brand…

  16. Lynda Ehrich says:

Bought a can opener; it stopped opening the cans shortly thereafter (about 3 months, I think). You could hear the motor running, but it wouldn’t actually DO anything. Tossed it; don’t know the model number. Can I qualify?

    ADMIN – Hi Lynda,

You need to know the model

  17. Christine Carrizoza says:

What do I need to do if I no longer have the items in question?
I had to replace them because they were defective, so I did not keep the other ones and I did not get any refunds from the store where I purchased them either, just so you know.
    Please advise.
    Thank you so much!

    ADMIN – Hi Christine,

Without the model # you will not be able to file. Try reaching out to the class action administrator to see if there are other options.

  23. William Arnold says:

I have used Black & Decker in the past and item was good. I bought the steam iron a couple months ago now and I can tell you it is the most worthless thing I ever purchased. I’m throwing it away. I wouldn’t go to the expense of sending it back as they state “don’t take back to store bought from”. You want junk, buy this one. I’ll tell you up front the thing is worthless. In fact I’ll tell you I would be ashamed to sell something like this iron and make the statements they did as to how good it is. Worthless, worthless, worthless. I get peeved every time I have tried to use it, which isn’t more than about 3-4 times.
