This lawsuit is about model-year 2004 to 2010 U.S. specification BMW 5 Series (E60 and E61) vehicles (“Class Vehicles”). The lawsuit alleges that certain electronic components located in the spare tire well of the trunk in the Class Vehicles are susceptible to water damage, caused either by clogged sunroof drainage tubes or by some other means of water ingress (the alleged “Defect”). BMW AG, which manufactures BMW vehicles, and BMW NA, which distributes and warrants BMW vehicles in the United States, deny these allegations and stand behind and support their products.

      I’m still waiting on results. I had a notification in the mail said no action needed. And a wait for a reply if my vehicle was subject to the class action suit. Also is there a recall on the engines with the check engine light and excessive oil leak? A BMW shop foreman told me that the 545 v8 was Notorious for this oil leak and emissions code.

    I sent in the class action postcard that alerted me of this lawsuit, although I feel the estimate is pretty light. I have a 2006 550I with 76, 000 original miles. I have babied this car… And it is the first and only car I have ever kept and paid off.
    I was extremely upset when my GPS and complete radio unit… Everything in the middle of the dash became fuzzy, then went completely black. I took the car to the BMW dealership in Winter Park who informed me there was an extensive electrical shortage, and rendered my car “unfixable”.
    With the year and low miles, that was something I wasn’t expecting to hear or told to “junk it”…. By the dealership itself.
    I actually went out and leased a new vehicle because I was told it was a fatal flaw. Not only did they NOT mention ANYTHING about the lawsuit or that this was a known problem, I actually spoke to the dealership in Daytona yesterday who NEVER mentioned the issue was at this point in a major class action settlement. Am I expecting above and beyond service? Did some punk millenial never look at my car at all? I feel that it was a careless and inappropriate thing to document on the computer… (Try selling a car deemed unfixable by the BMW dealership), and on top of it, STILL not mention this by now, notorious problem. If this is a $1500 repair, then I am going to seek additional legal action. People tell you a flipid statement… Which was devastating to me… A car is a major investment as it is, not to mention a losing one as it already is as time goes by. I was quoted that the repair would surpass the worth of the car.

    I have an ’06 525i. I knew nothing about this until receiving the postcard a couple of months back, but the car has had a history of various electrical and electronic gremlins for some time. I’m wondering two things:
    1. Is there a listing anywhere of what systems are affected by failure or damage to the parts subject to inspection, so I might be able to determine if my issues could be related to this, and;
    2. Has there been any update regarding approval (or not) of the proposed settlement?

    I was just notified of this problem and lawsuit on July 9, 2017 by the BMW service technician after diagnosing my electrical outage on my 2007 530i to be caused by water in the spare tire storage well. What are my opinions given it is pass June 28 and I was unaware of the lawsuit.

    I received the mailer but had not done the repairs yet. I have a 2008 528i which the components stopped working after getting wet. According to the mailer, there was nothing to do until the settlement was agreed which they stated would be after a date in July. It states after that I could take my vehicle in for repair. My car does have over 120K miles but the mailer didn’t specify a mileage. Am I able to take my car in for the repair?

    Greetings!!!

    I have the same model car and got the letter also. I have very weird issue going on, Sudden change in the acceleration gives me transmission malfunction … will it because of this?
    Now when I am asking how is cost to fix it, so they are saying 5/6 grand but not sure it will fix it.

    I dont know what to do. Can anyone guide on this.

    I purchased a 2007 3 series in 2011 from Gossett Motor Cars in Memphis, Tennessee. I started having trouble with defective Bridgestorne Tires and the dull back windshield. The car did not start after leaving the post office in 2014,again in 2015 after driving through a small puddle of water in my driveway, after each repair the electrical was not repaired. After a new battery was installed, the cable to the battery kept disconnecting. Finally, during a five car pile-up the airbag deployed after front bumper damage only. My insurance company would not fix it, then settled for $5,000. I complained to the Arkansas Insurance Company but didn’t get help.

      I’m with you Karla. I brought my car (’09 5 series) to the dealership several years ago when the car had 122 k miles. Now with 145k they will do nothing about this. BMW has proven over and over they don’t stand behind their Ultimate Machines.

    This whole debacle is a joke. BMW makes billions of dollars selling cars in the U.S. They knew that this problem was there, yet they tried to avoid taking care of the customer. It cost me over two grand to repair my car… what does fifteen hundred suppose to do? To make matters worse, why are we still waiting on the measly check? I filled out my claim for reimbursement in May along with receipts from BMW. I think that consumers should file personal lawsuits. I wonder if the lawyers are waiting on their money? BMW is not what they use to be. They will charge you three hundred dollars for an oil change, but drag their feet on partial reimbursements. So so sad.

    This is a joke…people canNOT schedule their repairs. I called my local dealership and was told they do not have or know when they will have the parts to complete the repair!! My car is approaching the 120k mile limit, am I supposed to just not go to work or anywhere else?? The car leaks like a sieve and has damaged multiple electrical components inside the cabin! What a joke this $1500 is; most of us have already paid twice that and other electrical components continue to be affected.

      How do I escalate to class council? I just got a notice of deficiency reading that my claim was denied because the the VIN was not written on the invoice. I sent in an invoice of repairs and also a valuation report with the VIN after my vehicle was destroyed by starting on fire. They had my name and VIN to include me in the lawsuit in the first place. I called and they said to expect a call back in a week! It is clear they are looking for loopholes to avoid paying out. I’m still resubmitting the info but this is ridiculous.

    I called today and was told they are awaiting approval of a “distribution date” and that they would need to go to court to obtain an order approving it. I was told by the KCC help line personnel that nobody has received their check yet and that no date has been set for the hearing on setting a date. Does anybody have information on this? I hope not as in the last 5 months I have paid for 3 modules to be replaced as well as multiple other issues. I had a water test and it definitely was taking in water through the trunk and the vents.     Was the ruling in fact only for 2007-2010 5 series models with 160k miles at the time of the inspection?

It almost seems like the settlement administrator and defendants are conspiring to take as long as possible to issue the checks in hopes that people may change mailing addresses and thus cannot cash their reimbursement check they never receive.     So much bitterness!! It seems to me you are the kind of person who would prefer for the administration and attorney costs to be low to ensure the bigger portion goes to the class members. If this is your stance rest assured you are very much in alignment with the way our judicial system works. Class action administrators often have very small teams validating a large number of claims thus delaying approvals. There is no conspiracy whatsoever just the reality of the way things work. In addition to reaching out to class counsel you can become an advocate for a more fair and efficient system for mass torts as well as an advocate for quality control in car manufacturing. In engaging to initiate changes not only will you help yourself you will also help others. No conspiracy here and nobody is trying to keep the change.

    I wanted to give an update here because I know that a lot of us have been frustrated about how slow this case is proceeding to settlement and checks being issued to claimants. I have called both class council offices to complain about KCC’s handling of the settlement process. They have assured me that there have been a lot of complaints. The class council information can be found on KCC’s page under frequently asked questions. There phone numbers have not been listed so I will provide them here:

    I have calls into both offices. Haven’t heard back but hope to soon. KCC is saying that there have been no checks issued due to a need to go back to court and get a final settlement approval. I don’t know if this is true.

    I would encourage everyone who is interested in getting more information to contact one or both of these numbers and try to get clarity for your questions on the process. I hope this will help us all get our checks and move on from this.

    As stated above, it is interesting that KCC is telling class members that the claims will need to be approved by the court when the settlement language states nothing about any sort of “distribution date”. In fact, page 19 of the settlement states that “[d]efendants will make payments for valid claim reimbursements required under the Settlement. Payments will commence being made within thirty (30) days after the Effective Date.”

    This is completely contrary to what KCC is telling class members. They are saying nobody has received any checks yet. What gives? Where are they coming up with the idea of going back to court to ask for a “distribution date”?

    We received our check yesterday! Finally! We submitted our claim Mid May of 2017. We were reimbursed over $1,300 for the repairs that were made on our 525. It took a while of not knowing anything but I am happy with the outcome. 🙂
