Class Eligibility
The Settlement Class under the Settlement includes: all United States resident Executive Club Members who redeemed Avios for an award ticket during the Class Period and who paid a BA-imposed fuel surcharge, so long as that United States resident Executive Club Member provided BA with a valid United States address at the time of booking.

Case Summary
Plaintiffs filed a lawsuit in which they alleged that BA charged fuel surcharges to Settlement Class Members on frequent flyer reward flights that breached the Executive Club Contract between BA and Settlement Class Members. BA denies that it did anything wrong, believes that the EC Contract permitted it to impose a fuel surcharge, and that the fuel surcharges that it imposed on Settlement Class Members were appropriate under the EC Contract. Accordingly, BA has vigorously defended Plaintiffs’ allegations. The Parties, however, have agreed to settle the Litigation to avoid the cost, delay, and risk of continuing the Litigation.

      I am having the same problem. I have redeemed Avios during the time period covered, but I do not have a claim ID. I emailed the claims administrator but just got a form response with a copy and paste of who is part of the class, which I already read. I also called the 833 number and it’s just an automated system with no one to actually talk to, it only has the information that is already on the website. Frustrating.

    I have been calling the 1-833-261-2496 for many weeks and still have been unable to reach
    a human being to answer my questions under the Settlement Agreement with British Airways.
    I would appreciate receiving information on when BA is required to automatically post the
    requisite Avios to my Executive Club Account. I am an Active Executive Club member who
    has not opted for the “Cash Option”.
    I would also appreciate knowing the total amount of Avios I will receive.

    They will not settle for my kids trips because I paid for their tickets. Sounds like a con to me. Exact email response.

Only the Executive Club member who actually purchased the reward tickets and paid the accompanying BA-imposed fuel surcharge during the class period is eligible for Avios. Therefore, if you purchased tickets on behalf of your children, you are the only person eligible to receive Avios.

    I purchased BA tickets for BA flights during the time period under the Dover-BA class action suit and did not receive Avios due me under the settlement. Please deposit the missing Avios to my BA Executive Club Account, George H. Benz, 90763814, promptly and respond to my request. We did comply with the Class Action deadline of July 29, 2018.

    Subject: Fuel Surcharge Class Action WG344-GB6489

    Dear Sir/madam,

    We are requesting your good office to issue a replacement check (copy attached) due to serious health emergency. Mr. Lal Sani was admitted to the hospital on November 29th due to kidney failure. He could not get a replacement liver and was confined to the hospital. He was just recently release but now requires a permanent dialysis. Mr. Sani was unable to check his mails until late last week.

    I am still an active Executive Club Member and I am not sure I ever received my cash settlement even though I submitted my form on time and received a confirmation. How can I find out now? The telephone number is automated and I can’t speak to a person, the website is no longer active, and the email address no longer works. What are my options for following up?
