Class Eligibility

The Settlement Class includes: All persons and entities who provided broker price opinions on behalf of Brokerpriceopinion.com, Inc., First Valuation, LLC, First Valuation Services, LLC, First Valuation Technology, LLC, Cartel Asset Management, LLC, Walter Coats, or ValuTech, In. between December 2, 2007 and the date of preliminary approval and who have not been paid for their services in accordance with Defendants’ terms of payment.

Each person who submits a Claim Form will receive a proportionate share of the $1,020,000 that Brokerprice agreed to pay to brokers for past amounts due. The determination of each Settlement Class Member’s share will be based on information from Defendants’ business records. Case Summary

Class Representatives allege that Defendants failed to pay brokers for the broker price opinions the brokers completed on Defendants’ behalf. The Class Representatives allege that Defendants were unjustly enriched by failing to pay the brokers.     I am a park of this lawsuit, my name is Debra Lawson my number is 832-439-4221. I have not received any information about my payment by mail I understand this suit has already went to court and been awarded. I was trying to get information on when I would receive a payment. Thank you

    I also submitted a claim and have not heard anything. Yet I saw something on line saying the hearing was on May 18th, 2018. If you hear anything different, please let let me know.

    Anyone who lives in the Denver area needs to go to the court hearing. I am not an attorney, just a lowly broker, but it ought to be interesting. Walter Coates now has his house (over 850K) on the market. I am assuming he wants to sell it to avoid liens. I am guessing after it is discovered he is not in compliance with his agreement, that he will close up shop and file a bankruptcy. Just an FYI. I don’t think anyone will get paid from here on out. I did work for them, but was told since the lawsuit, they were paying 90 days. I got paid for the first 2 months and was encouraged. They now owe me for 5 months worth of work!!! I plan to go to the hearing.

    I have never seen one penny and they owe me $700.00, all from BPO’s I completed in 2016. I filed all of the proper forms and think this is nothing but thievery. I can’t even image that a business could get by with this.

    Being May 18 has now long come and gone, anyone heard anything further? I am guessing nothing is going to come out of all this for vast majority of us who haven’t been paid but it would at least be nice to know something. Being referred to an out of date website is frustrating…. and just adds icing to an otherwise sour experience.

    Class action settlements take a very long time to resolve. Sometimes up to a decade. We wish we could give you more info but we only have what the class action administrator discloses.

    I’ve had a chance to speak to Jennifer about the settlement and wanted to give you an update. Now that the judge has signed the order we can expect the following in the coming months:

    November 5, 2018 – This is the date that the settlement become effective

    December 17, 2018 – JND is expected to mail the first distribution to class members

    January 7, 2019 – BPO’s first bi-monthly report due and every 2 months thereafter

    At the moment we do not know the amount of the 12/17 distribution. We won’t know this amount until defendants provide their accounting to the Settlement Administrator.

    Any update on status after they have now filed bankruptcy? Should have guessed they would still find a way to get out of paying even just pennies on the dollar of what they billed agents out of!
