Class Eligibility

You may be a Class Member if you are a U.S. or U.S. Territory resident who : (1) bought a new Class Dishwasher (i.e., a KitchenAid-brand dishwasher produced by Whirlpool between October 1, 2010, and June 14, 2019); or
(2) obtained a Class Dishwasher as part of buying a home, residence, or structure; or
(3) was gifted – by a donor meeting the requirements of either subsection (a) or subsection (b) – with a new Class Dishwasher, unused by the donor or anyone else after said donor bought the Class Dishwasher and before they gifted the Class Dishwasher.

Case Summary

Plaintiffs claim a specific defect in the Class Dishwashers, i.e., the tendency for the upper dish rack adjuster wheels’ axles to break, rendering the upper dish rack unusable. Plaintiffs also allege that Whirlpool contravened warranties pertinent to the production and sale of the Class Dishwashers. The Settlement excludes claims of personal injury or property damage, other than damages endemic to the Class Dishwasher itself.
