Case Summary

The Defendant companies (Agri-Mark, Inc., Dairy Farmers of America, Inc., Land O’Lakes, Inc., and National Milk Producers Federation), between December 6, 2008 and July 31, 2013, are accused of having violated the Sherman Act, 15 U.S.C. §1, having teamed up and conspired to constrict raw farm milk production by way of untimely “herd retirements” demanding associated dairy farmers to withdraw all of the milking cows in their herds and, starting April 1, 2009, forfeit a 10% incentive payment if they desired to come back to the dairy farming business within a year. The Suit alleges that the primary objective and goal of this contract, combination, and conspiracy has been to eradicate competition, consequently reduce the number of dairy farmers in competition, and generate both short-term and long-term boosts in the prices of butter and cheese.
