Case Name
Pettit v. Procter & Gamble Co.,Case No. 3:15-cv-02150, District Court for the Northern District of California
Case Summary
In one lawsuit (Pettit v. Procter & Gamble Company), the Plaintiff asserts that, although the packaging on the Freshmates wipes states that the wipes are “flushable,” “septic safe,” and “safe for sewer and septic systems,” the wipes are not suitable for disposal by flushing down a toilet, are not regarded as flushable by municipal sewage system operators, do not disperse upon flushing, and routinely damage or clog plumbing pipes, septic systems, and sewage lines and pumps. Plaintiff alleges that P&G is liable for: (a) violations of the California Consumers Legal Remedies Act, Cal. Civil Code §1750 et seq., (b) false advertising in violation of California Business and Professions Code §17500 et seq., (c) fraud, deceit and/or misrepresentation, (d) negligent misrepresentation, and (e) unfair, unlawful and deceptive trade practices in violation of California Business and Professions Code §17200 et seq. In the second lawsuit (Ramcharitar v. Procter & Gamble Company), the Plaintiffs make similar allegations regarding the Freshmates wipe and allege that P&G is liable for: (a) breach of express warranty, (b) negligent design, (c) negligent misrepresentation, (d) failure to warn, (e) violations of the Florida Deceptive and Unfair Trade Practices Act, Florida Statutes §501.201 et seq., (f) unjust enrichment, (g) violation of the Magnuson-Moss Warranty Act, 15 U.S.C. §2301 et seq., (h) violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, §805 Ill. Comp. Stat. §505 (2007), (i) tortious breach of warranty, and (j) fraud. Plaintiffs seek to pursue their claims on behalf of themselves and others who purchased the Product in the United States, except for purchases in New York.
P&G denies that there is any factual or legal basis for Plaintiffs’ allegations. P&G contends that the labeling of the Product was truthful and non-misleading. P&G therefore denies any liability. P&G also denies that Plaintiff or any other members of the Settlement Class have suffered injury or are entitled to monetary or other relief.

After using and flushing Charmin wipes, my toilet backed up into my bedroom and walls and shower. I had to call a plumber and had to have the bedroom, bathroom, closet cleaned by a professional. My walls and floors needs to be replaced. Help because I know that these wipes caused this according to the plumber.in
ADMIN – Hi Eunice,
This settlement is not intended to cover plumbing expenses. If you intend to claim those you must hire your own attorney.
I bought this product and got a very bad rash and infection from this product.
ADMIN – Hi Linda,
This product is not known to cause rashes and infections. The settlement has to do with plumbing issues.

ADMIN – Hi Mary,
I just checked the link and it appears to work. Perhaps you need to try again.
Use this product an when I used it… I had to call the plumber out to unclog the system.
I had to call for plumbing services during use of this product.
I purchased 2 pack on 1/10/19 at rite aid because it said it was flushable …. $1200 I learnt it got stuck in the sewer line after 2 uses… I still have the full and unused package unfortunately I discarded my rite aid receipt for refund
ADMIN – Hi Evelyn,
You can still file a claim without a receipt.
Turned out not to be very good or flushable.
caused some plumbing problems
I purchased 3 packs from rite aid for my mother and they backed up our sewer line. After snaking it 4 times we had to call a plumber. I didn’t keep my receipt because I didn’t anticipate them damaging my sewer line.
My toilet needed to be fixed from flushing wipes
I put 1 wipe in the toilet at a time and still messed my plumbing up
I bought them when I was sick and used them. Bought them specifically because they said flushable which I assumed meant biodegradable.
I had to call a plumber many times, spent $2500 new plumbing pipes..
Thanks for the support
The claim form does not allow you to fill in the number of packages, the store name or the state. I tried IE10, Chrome and Firefox.

If people can’t figure out how to follow the link to file a claim – then how do they figure out how to make a comment? And, while scrolling down to make said comment, how do they not notice all the previous comments and replies?
Obviously this product isn’t a flushable item..
I used them and had issues.
I filed a claim when would I get the check?

I used this product and had an allergic reaction
I was a messy situation for myself and family.
Hey admin,
I’ve used your site for quite some time and every time I can’t believe how many people think they’re submitting a claim by making a comment on here. I would be so frustrated. You’re a good dude.
Hi D, You’re a sharp observer. Thanks for the boost. Cheers.
CLOGGED TOILETS
Yes. I, too, used this product the first 10 or so flushed down easily but after that my toilet started backing up. I had to use a plunger. I called my fix-it plumber guy, and he suggested I stop using flushable wipes. That charge was $75 for him to come unclog my pipes.
plugged the toilet….spent much money trying to unclog
my toilet clogged after purchasing these
Used this product so any times and for a long period of time.
Have bought and used so many of this product.
cost me a lot of money to repair pipes
I filed a claim (I believe) because I had purchased these wipes and flushed them. Can I verify that I have entered, and additionally, we have now had $7000 worth of blocked sewer lines due to wipes clogging the lines. I believe that the wording of denying liability assumes there is no additional restitution, but was curious if there was anything else that could be done.

I have used this and my toilet clogged all the time and have since sadly had to stop using them
I had toilet problems for years until i was advised to stop using them.
Used this product and clogged up plumbing. Had to use drains and snake lines
The flushable wipes flooded my toilet for weeks. They just fixed it yesterday. It started on August 15th.
Is it too late to file a claim?

Use this product and I had to call the plumber out to unclog the system.
I bought several Charmin Freshmates Flushable Wipes because they were on sale and after using them a little over a month. Had to call a plumber and he came out and had to use a water closet auger to clear the clog that was caused by these flushable wipes. He told me to stop flushing them or better yet, just buy toilet paper.
Have had similar issues and had to contact my plumber friends to resolve this.
I had major problems due to these wipes but I missed the deadline. I had to pay for emergency routing of my pipes and flooded my entire basement
We have purchased a lot of these and didn’t have slightest idea there was a class actions lawsuit
I bought a lot for my granddaughter. I had a backup in the toilet a few times.
Any checks issued yet?

We used these wipes. In 2016, our 1st floor bathroom we never use, backed up. Door was shut so we didn’t catch that everytime we flushed our upstairs toilet, everything was coming up through the 1st floor toilet. One day, I came home and our house smelled like sewage. Roto Rooter came and assessed damage. He found about 400 of these wipes through out pipes. It was $1,200 for them to clear everything. Then we had to gut our guest bathroom and part of our 1st floor surrounding the bathroom. So…$30? Why don’t you just burn the money in a fire pit because that is essentially what Charmin caused in damages by saying their wipes were flushable.
I bought 2 of these a week for the last 5 years. They are supposed to be flushable but they keep stopping the toilet up.
We definitely had clogging issues.
I had to pay over $2500 for multiple plumbers, $ 2100 to fix my plumbing & I still have over $3500 min to finish fixing my bathroom & finished basement where the plumbers flooded the basement by flooding my basement with sewage- not to mention 3 floors of damaged wals
Are they taking late claims? The reason I ask is I am definitely eligible for recompense and sometimes the Corp sets money aside for future claimants who were in fact eligible at the captioned time period then and there and therein to file a claim.
