Class Eligibility

The Settlement Class includes all individuals (i) who maintained a Credit Card Account with CBUSA; (ii) whose account CBUSA charged off and then sold to a Debt Buyer on or after January 1, 2008, and (iii) who post-sale sought and obtained a discharge of the debt as a result of his/her bankruptcy under Chapter 7 of the Bankruptcy Code, through and including the date of the Bankruptcy Court’s preliminary approval of the Settlement.

Case Summary

This lawsuit alleges that Defendant failed to update its credit furnishing for credit card accounts sold to Debt Buyers where the accountholder’s debts were discharged in Chapter 7 bankruptcy after they were sold. As a result, the entry on the accountholder’s credit report associated with the account (or “tradeline”) continued to reflect that the debts were sold, charged off, and $0 balance, and did not indicate that the debts were included or discharged in bankruptcy.

Based on these allegations, Plaintiff claims that Defendant’s credit furnishing practices have harmed consumers by adversely affecting their ability to get credit. Plaintiff also alleges that Defendant’s credit furnishing practices have pressured some consumers into paying those discharged debts because they feared that not doing so would negatively impact the perception of their creditworthiness to prospective creditors and employers. Defendant denies any and all allegations of wrongdoing and does not admit or concede any actual or potential fault, wrongdoing, or liability in connection with any facts or claims that have been or could have been alleged in this lawsuit or in any similar action. Defendant denies that it attempted to collect discharged debts or otherwise violated bankruptcy discharge injunctions.

    I had filed for bankruptcy in 2009 but also was going through a third party lawsuit at the time for a construction accident eventually the case settled for two hundred ten thousand but the trustee of the bankruptcy took everything that would have been mine except for 8000 dollars, I thought I just got screwed by filing for bankruptcy on 8 cards including chase, Citibank and a few others, my shock came this week when I received this $8500 check as part of the chase settlement! My question is will I be receiving others from the other cards(Citibank etc) or do I have to file something? Thanks for your ti

    My notification (postcard) came very late in the mail. I never realized a claim had to be filed in order to be considered for any award. Most class actions include you, even if you do nothing at all. To that end, if I did nothing at all, will I still be considered based on my Class Memer ID No.? I believe I am entitled to the money that was paid to CACH after the BK7 was filed.

      You could always give it a try but in most cases even if there is a different claim number the admin will check to ensure you actually had various accounts that were affected. If you only had one account and you submitted several claims even if it was their error to send several cards they are likely to cancel it. How about you give them a call to double-check? their phone is posted above.

    I believe my mailman lost the check for I never received it.. I have an app from the post office telling me the mail I will receive for the day.. It said I was to receive this piece of mail on May 12, 2020 and never received it. Can you mail me out another or check if it was cashed by another person? Thanks
