Class Eligibility

You are a member of the settlement if you purchased Algal-900 DHA dietary supplements (CVS-brand) that had “clinically shown to improve memory” or “clinically shown memory improvement” on the packaging and/or labeling. The class period is from November 15, 2008 to September 30, 2016.

Estimated Amount

If you submit proof of purchase that contains the actual price paid for the qualifying product with the claim form, you will receive a full cash refund for the price you originally paid.

If you submit proof of purchase that only contains the product’s package and not the actual price paid for it with the claim form, you will receive a cash payment of the average retail price of the qualifying products.

If you submit a claim without proof of purchase, but CVS’s records show that you purchased the qualifying products using an ExtraCare account, you will receive a credit to your account in the amount of your purchase(s) as indicated in CVS’s records.

If you submit a claim without any proof of purchase, but CVS’s records show that you purchased the qualifying items online through www.CVS.com and there is no ExtraCare account related to your purchase, you will receive a voucher towards any CVS item, in the amount of your purchase(s) of the qualifying products.

If you submit a claim for without any proof of purchase and CVS does not have any history that you purchased any qualifying products, you have the ability to received a maximum of $5.50 in cash or a $7 voucher for the purchase of any items sold at CVS. Only one claim per person and two claims per household without proof of purchase.

Class members with proof of purchase will receive a higher payment.
