Class Eligibility

There are two classes in this settlement: Shake & Powder.

You may be a member of the Shake class settlement if you are a U.S. consumer who purchased Defendant’s:
– Cytosport Whey Isolate Protein Drink;
– Monster Milk: Protein Power Shake;
– Genuine Muscle Milk: Protein Nutrition Shake; and
– Muscle Milk Pro Series 40: Mega Protein Shake
between Jan. 23, 2011 (Jan. 23, 2009 in Michigan) and May 5, 2020.

You may be a member of the Powder class settlement if you are a U.S. consumer who purchased any of the following powder products that had the phrase “lean lipids,” “lean protein,” “lean muscle protein,” or “new leaner formula” on the label:
– Muscle Milk: Lean Muscle Protein Powder;
– Muscle Milk Light: Lean Muscle Protein Powder;
– Muscle Milk Naturals: Nature’s Ultimate Lean Muscle Protein;
– Muscle Milk Gainer;
– High Protein Gainer Powder Drink Mix;
– Muscle Milk Pro Series 50: Lean Muscle Mega Protein Powder; and
– Monster Milk: Lean Muscle Protein Supplement
between Jan. 23, 2011 and Dec. 31, 2018.

Estimated Amount

$1+ for Shake Class Products ($1 per purchased Shake Class Product, subject to pro rata adjustment, for up to 25 products on the list, without proof of purchase needed, or a maximum claim of $25. Shake Settlement Class Members with proof of purchase will have no cap.)

$3+ for Powder Class Products ($3 per purchased Powder Class product weighing 2 ¾ lbs. or less, and $5 per purchased Powder Class product weighing more than 2 ¾ lbs, for a maximum claim worth $25 if without proof of purchase. Powder Settlement Class Members with proof of purchase will have no cap.)

Proof of Purchase

(For Shake Settlement Class Members) No, if you purchased 25 Shake Class Products or fewer on the list. Yes, if you seek claims for more than 25 purchases on the Shake Class Product list.

(For Powder Settlement Class Members) No, if you purchased Powder Class Products worth $25 or less on the list. Yes, if you seek claims for more than $25 worth of purchases on the Powder Class Product list.
