Ford PowerShift Transmission Class Action Settlement (Focus & Fiesta)

Class Eligibility

You are a Class Member if you are a person, entity, or organization who currently resides in the United States (including its territories), and on or before April 25, 2017, you purchase(d), or lease(d) a 2011-2016 Ford Fiesta or 2012-2016 Ford Focus equipped with a PowerShift Transmission that was originally sold by Ford in the United States or its territories.

If, on or before April 25, 2017, while serving in the United States military overseas, you purchase(d), or lease(d) a 2011-2016 Ford Fiesta or 2012-2016 Ford Focus equipped with a PowerShift Transmission from a dealer under contract with the United States government, you are also a Class Member.

Case Summary

This Settlement resolves litigation against Ford alleging that Ford defectively designed the PowerShift Dual-Clutch Automatic Transmission in certain 2011-2016 Ford Fiesta and 2012-2016 Ford Focus vehicles (“Class Vehicles”).

The Actions allege that the PowerShift Transmission in the Class Vehicles was defectively designed and manufactured by Ford, causing it to slip, buck, kick, and/or jerk, resulting in the sudden or delayed acceleration of the vehicle. Plaintiffs have asserted nationwide claims under federal and state express and implied warranty laws and under consumer protection statutes.

CLAIM SUBMISSION DEADLINES:

Claim Description & Deadline

1) Claims for cash payments/vehicle discount certificates/clutch repair reimbursement for repairs that were performed on your vehicle on or before April 7, 2020. –-> October 5, 2020
2) Claims for cash payments/vehicle discount certificates/clutch repair reimbursement for repairs that were performed on your vehicle after April 7, 2020. –>180 days after the repair(s) for which you seek payment
3) Claims for a one-time $20 cash payment if you experienced Transmission problems and sought relief, but a Ford Dealer refused to make hardware or software repairs because the Dealer claimed that there was nothing wrong with the vehicle and did not subsequently make hardware or software repairs. –-> The later of (1) 180 days after the date on which the Ford Dealer refused to make repairs, or (2) October 5, 2020.
4) Requests for repurchase arbitration. –> The later of (1) six years after delivery of your vehicle to the first retail purchaser, or (2) October 5, 2020.
5) Requests for breach of warranty arbitration. –> Expiration of the statute of limitations for express warranty claims established by the law of the state in which you purchased your vehicle.
