Class Eligibility

Individuals covered by an insurance policy issued by Fred Loya in New Mexico after Feb. 2, 2006 and signed a UM/UIM rejection form before Jan. 31, 2011. This means that passengers who were in the car at the time of the accident may also be eligible to make a claim.

NOTE: Policyholders who settled a UM/UIM claim and signed a final release are not included in the Loya Insurance class action settlement.

The settlement will pay eligible Class Members the UM/UIM benefits due to them for medical expenses, lost wages, and/or property damage resulting from that accident, up to the insurance policy limits, multiplied by 150 percent. For example, if you would have received $5,000 for medical expenses, lost wages and/or property damage covered by UM/UIM insurance through a Fred Loya insurance policy, your payment from the class action settlement would be $7,500.

If any other entity (such as Medicare, Medicaid, a hospital, a health insurance company or another auto insurance company) paid any of your medical expenses resulting from the auto accident, they may have a claim against you. In this situation, your class action settlement payment may be delayed, reduced or paid to the other entity.

Case Summary

In this class action the plaintiffs alleged that Fred Loya’s uninsured/underinsured motorist coverage (UM/UIM) rejection forms did not adequately explain a policyholder’s options before selling them their policies. The plaintiffs allege these rejection forms did not meet the requirements under New Mexico case law and that the affected policyholders should have their policies reformed to include UM/UIM coverage equal to liability limits./p>

The defendants deny the allegations in this class action lawsuit but agreed to the class action settlement to avoid the cost and risk of a trial.

    I had them I was fully covery they don’t want pay a dam dime so im planning take their asses to court I was couver in 50 state of ny and I had um/uim fully coverys they try to get away now they gonna pay

    I hit a deer thanksgiving, weekend Fred Loya is not paying my claim I feel like I have went to hell and back trying to deal with this. They totaled my car but will not pay my claim I had full coverage. The keep giving me a line of excuses and lies when I call to get an update on my claim status. They told me they can not pay me because Christopher Dodge cashed the preliminary check. They need Christopher Dodge to pay them back before they can pay my claim. Christopher Dodge has spoke with them a handful of times and has no idea what Fred Loya is doing. Then Fred Loya wants to pay half the claim until they get payment back from the auto body shop. Then I called to see if they sent the partial payment and they said the claim was back in pending due to loss of my auto keys. I drove the car to them, they have the keys!!!!. They can’t pay me due to missing keys for my totaled out car. Then I waited and followed up again and the check is still not received from Christopher Dodge and the partial check was sent out to the wrong address. 8 weeks later several stall tactics, lies, unethical business practices, negligence when handling my claim and property and I’m still not paid. The company is a fraud and has hundreds of bad reviews, over 150 negative with the consumer affairs and F rating with the BBB. Why is everyone standing by watching this???? Where is the accountability????? How can a company still be in Business with so many complaints?????? I’m about to start a class action law suit on my behalf and the hundreds of others who have been screwed my Fred Loya. It is a shame to allow companies to be unethical and at the consumers expense. I own 3 companies and have never had a complaint but if I did encounter a unsatisfied customers I would be on the phone with my company attorney to get things resolved in a timely manner. This company is just a scam and I refuse to sit back and take anymore or allow anyone else to be a victim of their bad business practices

    Fred Loya Insurance has the most compalints of any company doing business which brings me to the question why should they be allowed to do business? Hands down they need some accountability.
