To be a member of this class you must have purchased certain milks or dairy products since 2003 (including half & half, cream cheese, sour cream, cottage cheese, yogurt or cream) your purchase must have been made in one of the following states:

NOTE: eligibility requires that you must have purchased your dairy products from a retailer and not directly from the producer

          I live in Michigan and filled out the required form when this first came out maybe 2016?..can’t remember . I have since moved but still in MI. How will I be able to receive a refund of $6 to my new address if it ever happens? Also, what if the number of claims are more than the $’s being distributed and the refund ends up in the negative? One of your admin’s reply to a consumer at the beginning of comments said there are millions of checks being written..Is there even $6 mil in the settlement? Not really concerned about the $6 refund but just wondering…….

          I believe this distribution will happen via email using digital checks. It is mathematically impossible to have refunds in the negative. This is a pro rata settlement.

          So when I read we were getting 50 bucks in reality we were only getting 6 bucks which barely gets you a gallon of milk…. not fair when you account for tons of milk products I bought and come to find out you guys are still “sifting” through our money….. come on really? I get you had a lot of files but it shouldnt be too hard to send people 6 bucks especially when you had two months to do it and the deadline for our checks was march…. in the end these kinds of things always rip you off in the end :/

    I’ve been out of state for a month with a father who’s been ill and in ICU. I heard about the suit two weeks ago while in the hospital in Arizona and had no internet access. I’ve returned home to apply and mentioned it to my colleagues who heard nothing about it. Was this suit advertised in Southern California? Is there going to be another time frame to submit?

    In my opinion, it doesnt look like anybidy but the attorneys will gain from this lawsuit. In the e-mail i received, it stated “an email will he sent to you shortly after the deadline for you to choose an option for immediate payment. This email has never been sent to me. According to an “admin” who is responding to people, he/she is advising “now you wait”, “it could take years before you see any money”, “who knows when tye payout will he”. This lawsuit led ppl to believe they would get refund ASAP because it didnt have to go through the courts. The farmers already agreed to a settlement amount!!

      The Fresh Milk Products Price-fixing Class Action payout amounts have been finalized. We received more claims than anticipated, which lowered the expected payout amounts on a fixed settlement fund. Individuals will receive $6.79, and entities will be receiving $190.13.
      The appeals deadline has now passed, but unfortunately, there were 3 appeals submitted by objectors to the settlement, which means payments cannot start until those appeals are resolved. It is now in the hands of the U.S. Court of Appeals for the Ninth Circuit.

    All of us got a big confirmation notice that we will receive the payment but when? It does not matter $6 or $8, if you can possibly deny the payment to 10,000 claims $6 each and keep the money that is your Economic Gain for $60,000. While marginal utility for $6 is for us is quite low but total utility for $60,000 for you is definitely a good amount.

    Please sent the money asap so that we do not need to spend more time on sending you email because the opportunity cost of our 15 min time sending you an email is much higher than $6 we are supposed to get.

    You can find the information for class counsel by referring to the long notice. Even when customers receive coupons the attorneys involved will receive their fees as prescribed by the judge. As for the amount of the settlement, both parties make an estimation as to the # of people that are likely to claim and come up with an approximate amount. When more people than expected claim the amount goes down. Attorneys do not get paid more their fees are fixed.

Admin- I don’t know if it’s possible to remove these posts, but a few of these people have their physical addresses and phone numbers up.     And to everyone else- yes, a lot of big class action lawsuits wind up with small settlements for individuals. If there are a lot of people in the class. It’s the same reason you often only get a small piece of actual wedding cake at a wedding. If there are 100+ people sharing the cake, everyone just gets a little, even if it’s a big three tiered cake. If, for some reason, half the guests can’t attend, there’s more cake for the handful of people who do show up. My word.

So if a huge corporation owes you money they can delay your refund, But if you owe a company money, they hit you up with late fees and higher interest. So once again the working class gets the shaft. So if any interest is being added we deserve that as a refund for the patience we all have tried to live with since January 2017.

The Judge Jeffrey White is the one dragging his feet on the distribution of funds, so much so it is even frustrating the lawyers. If you do a little research you will see the lawyers submitted a letter to Judge White stating it as nicely as they could on May 2nd. Judge White has yet to respond to this letter. I strongly encourage everyone to start contacting Judge White’s office to express you displeasure with his lack of movement on this case.

    After reading a lengthy Settlement Agreement I am beginning to believe that since the judge has not signed the final payment agreement that the Attorneys from both sides of the Class action have rescinded the settlement in its entirety and we all have been duped into this scam without any recourse tp refile another class action. Plus if this is not a scam, I believe that the reason why we are to receive $6.00 is that the final settlement of $52 million only $26 million was put into an escrow account at Hunting National Bank and out of that the class action members refunds are dispersed. I pray that I am wrong, but once again I am just voicing my opinion.

    Will the lawyers get more money, now that it’s allegedly being appealed? I saw on page 7, that the lawyers will receive the first $19,73,5219 (yes, that’s almost 20 million dollars). Which leaves the people getting about $32M.
    So I am curious….will the lawyers get MORE of our $32M? Or were these new costs assumed in their $20M fee? Or will the milk industry have to pay MORE (for the lawyers)?

    Also, if someone is challenging the amount that means that we could possibly get LESS than the $6.79 currently planned…..would the lawyers ALSO receive less? Or is it just the consumers $32M that would be reduced?

      Yes ADMIN….have the courts impose a real and serious financial PENALTY (and/or imprison top management) on ALL price gougers. As it is now, the milk producers are likely not admitting responsibility, and just paying back $52,000,000 of the $162,000,000 they stole from us. And they could easily do again next year. There isn’t a penalty involved here; just pay back to consumers (maybe 30 cents on the dollar) and richer lawyers, because they got caught….THIS TIME.
      In other-words, give them encouragement or an incentive NOT to gouge and lie to consumers any more.

    I think it’s funny people who had no idea they were being “cheated” are crying about thier $6.89 being delayed. No where does it say the people responsible are the ones who appealed. Literally anyone can appeal and hold up the funds. In fact I’m sure the the companies are tired of paying for this costly defense and would prefer to put it behind them. Some people that ran daycares and such are waiting on something like $190 but it don’t matter. If the appellate court wants to take 10 years guess what we’re gonna wait 10 years. I was involved in the red bull lawsuit a few years back. It took them 3 years to mail me my 4 pack of red bull. It just showed up long after I forgot about it. Your money will eventually come you just have to forget about it. I check back like once or twice a year just out of curiosity. But come on people your getting upset at the wrong people. The people running this website are just providing information for you. They don’t have to.

I know that there were 3 appeals a few months back, but a friend let me use her account at that time and I saw that there were some court dates set for december. Have any of those appeals been dismissed? Have any new dates been set? Or are they just waiting on the judge to make some sort of decision? He was supposed to make a motion in january of 2017, but never did until June. That was only after class members began calling the court house AND a news reporter began calling around.     The Fresh Milk Products Price-fixing Class Action payout amounts have been finalized. We received more claims than anticipated, which lowered the expected payout amounts on a fixed settlement fund. Individuals will receive $6.79, and entities will be receiving $190.13.
    The appeals deadline has now passed, but unfortunately, there were 3 appeals submitted by objectors to the settlement, which means payments cannot start until those appeals are resolved. It is now in the hands of the U.S. Court of Appeals for the Ninth Circuit.
