Plaintiffs contend that Defendant’s marketing and labeling of its Products is misleading. Defendant contends that its Product Labeling is accurate, denies making any misrepresentations and, therefore, denies any liability. It also denies that Plaintiffs or any other members of the Settlement Class have suffered injury or are entitled to monetary or other relief. Defendant also denies that this case can be certified as a class action, except for purposes of Settlement.
