You are a member of the class if you consumed food or drink between September 4 and September 13, 2015, at the Hardee’s Restaurant located in Duncan, South Carolina, or between September 4 and September 15, 2015, at the Hardee’s Restaurant located in Lyman, South Carolina, and subsequently obtained a Hepatitis-A Virus (“HAV”) vaccination, an immune globulin (“IG”) shot, or HAV blood test within thirty days after eating at these Hardee’s Restaurant locations, but in no event later than October 15, 2015.

Case Summary
The plaintiffs, Cody Werkmeister and Sherri Young, acting on behalf of themselves and all those similarly situated, have asserted claims against the defendant Hardee’s Restaurants, LLC . The South Carolina Department of Health and Environmental Control (SCDHEC) was notified on September 17, 2015, of individuals employed by and working at the defendant’s restaurants, who had tested positive for hepatitis A, and who had worked at the defendant’s restaurants during their hepatitis A infection. SCDHEC alerted the public about the health risks posed by potential exposure to hepatitis A, and recommended that customers and staff who ate food at the defendant’s restaurants between September 4 and September 15 at the Lyman-area restaurant and between September 4 and September 13 and the Duncan-area restaurant—should receive vaccine due to potential exposure to hepatitis A. SCDHEC held clinics to provide vaccines from September 19 to September 29, 2015. As a result of these clinics, over 4,800 individuals received vaccines for potential exposure to hepatitis A.
The plaintiff, on behalf of himself and all those similarly situated, seek to recover compensation from Hardee’s Restaurants, LLC, for All persons (1) who consumed food or drink between September 4 and September 13, 2015, at the Hardee’s Restaurant located in Duncan, South Carolina, or between September 4 and September 15, 2015, at the Hardee’s Restaurant located in Lyman, South Carolina, and (2) subsequently obtained an HAV vaccination, an IG shot, or HAV blood test within thirty days after eating at these Hardee’s Restaurant locations, but in no event later than October 15, 2015.The compensation sought includes the cost of obtaining the shots, and the value of lost time required to obtain the shots.
The Defendants deny the Plaintiff’s allegations and claims in their entirety, but have agreed to settle the law to avoid the burdens and costs of litigation.

Could you please tell me if there has or had been a suit involving a Hardee’s in LaCrosse Wi? I contracted hep A from one there. The Hardee’s did close soon after that. Thankyou in advance.

I, Franklyn Gardner work in the Duncan, SC area and did eat at Hardees in 2015
and contracted Hepatitis-A and was treated. I have the necessary paperwork from my doctor if needed.

I received a form in the mail and filled it out and send it back. Did I need to send a copy of my medical records for proof of vaccination?

I received a form in the mail and completed it with the dates of the shot Me and my daughter received from the health dept. We did not include a copy of the receipt from the health dept because I thought you would have that information. Do I need to do anything else. I do not want to be excluded from this settlement.

Please accept me and my wife’s claim. We were left out of this settlement due to not receiving a claim form. This was a glitch on your part with our mailing address. I have researched and found that many people were not notified with these forms. We are talking and may submit a class action suit against responsible party.
