    anyone know why this is only a california only class action? I am pretty sure the same thing is happening in oregon too. I recently purchaced a ton of Jc penny clothes at that same pricce and it seems that the sale prices are alway the same as the non sale prices.. It seems like a company wide pratice not just one state lawsuit.

Penney class action settlement Class Members include all individuals who while in the State of California purchased one or more private or exclusive branded items of apparel or accessories advertised at a discount of at least 30 percent off the “original” or “regular” price between Nov. 5, 2010 and Jan. 31, 2012 or Jan. 1, 2013 and Dec. 31, 2014.” If you feel there is a similar situation in Oregon you may want to reach out to attorneys whose main area of expertise is class actions to see if they are willing to explore it.

    I bought some suiting and such back in late 2013 totaling ~$250. I don’t have any receipts from then and believe I payed with cash at the time. Do I need to specify this amount in the cash payment claim form, or will the unverified purchase amount not matter for settlement purposes?

    When you file a claim without a receipt the admin expects you to fill the form to the best of your recollection. Unfortunately without a proof of purchase the amount you receive is likely to be capped.

    I also received a postcard with a unique number but I do not see a place on the claim form to enter it nor do I see a link, although I do recall seeing one previously when I first an email about it.

    The claim form only has a place to enter the unique number, not a way to see the qualifying purchases.

    Also, if I have qualifying purchases (and I know I do), will this be considered enough for a full refund or just a capped one?

    Do people really save receipts from that far back? I mean, I’d have boxes of papers if I saved all of them.

    The claim form is intended for you to enter your qualifying purchases.
    The settlement will be based on the number of qualified participants.Here are the terms:
    JCPenney has agreed to make available $50 million to compensate Class Members who file valid claims. The cash component of the Settlement will first pay notice and administrative costs in an amount not to exceed $2,667,000, plus attorneys’ fees and costs and a payment to the Class Representative as approved by the Court. The remaining amount will be paid to Class Members. Class Members can decide whether they want to request a cash payment or a JCPenney store credit of equal value. The amount of the cash payment or store credit will be based on the amount of purchases you made of private and exclusive branded apparel and accessories during the class period and on the number of valid claims that are filed. Please note that you can give your store credit to someone else but it cannot be resold or exchanged for cash. Your store credit can be used for any on-line or in-store purchase, and it does not expire.

    I don’t know if people keep their receipts. In my case I always keep a couple of year’s worth of receipts but every person is different.

    J.C. Penny considers everything sold for 50% off or less to be a full price sale. This has been true for at least 15 years. I worked for them.

    J.C. Penny has been doing this routine since at least 1977 when I worked for them & changed original price tags to a higher price before re tagging merchandise with new “sale” price.

    That is not all they do. They rip me of on 30% price adjustment in 2010. Instead crediting me whole total ticket price then they charged me with 30% off. But I never received the credit from first ticket. So I paid twice for same items. What can I do about that?

    Hello can someone please help me get my cash payment, on 1-26-17 I received an email stating that I selected store credit on my claim form. I responded with a copy of my claim form showing that I selected cash payment. The proof was sent to the claim administrator, I received another email saying:Thank you for contacting Heffler Claims Group
    When you filed your claim form online you selected in store credit,unfortunately we cannot make changes to your claim form. I responded, Thank you for your response I sent detailed information showing that I selected cash payment I enclosed a copy of my claim form with the cash payment box selected can you please accommodate my request.
    Can someone please tell me how I can get my cash payment. If there was a mistake made I didn’t make it so it’s only fair that it be corrected.

    When I got an email from the settlement administrator, I tried using the code and PIN# for my JCPenney rebate online at JCP.COM. It worked, so I thought I would hold onto it for awhile until I needed a big ticket item (I was awarded $350.00). Now my code and PIN# do not work anymore and I never got to use any of the money! I wrote to the settlement administrator and of course they didn’t get back to me. I had no way of knowing that the code would stop working. I will never shop at JCPenney again after this. I used to spend thousands of dollars a year there, and they have lost my business forever.

    i received an email from Heffer Claims Group after I notified them that I did not receive the share of my refund that was settled in the class action law suit. It said: Please use the card and pin number below to make purchases online at the JC Penney store website. Card # and Pin numbers were included in the email. How do I go about using this when I don’t shop online. Also, no amount of the refund was mentioned. I would like more information. I don’t know where else to turn since the email said “no-reply@hefferclaims.com. ”
