Case Name
Oaks v. Sears, Roebuck and Co. Civil Action No. 1-15-cv-11318 United States District Court for the Northern District of Illinois, Eastern Division
Case Summary
The lawsuit alleges that certain barbecue grills, with model numbers 01566, 03495, 16142, 16154, 23673, 23676, 23681, 23682, 23683, 23766, 34172, 34176, 34178, 34308, and 34611 (the Grills), sold by Sears were manufactured with firebox trays made out of galvanized steel, making the firebox trays defective and resulting in the firebox trays rusting and failing prematurely. Sears denies the claims of Plaintiffs, denies all allegations of wrongdoing, fault, liability, or damage of any kind to Plaintiffs or the Settlement Class, denies that the Grills were defective in any way and that it acted improperly or wrongfully in any way, and is entering into this Settlement to avoid burdensome and costly litigation. The Settlement is not an admission of wrongdoing.

  1. Jackie back says:

    I don’t currently have a receipt

  2. john says:

I put these grills together for the home depot.
These stores do not make the grills. Kenmore does. You can’t hold Sears liable. These no proof that these did fail.

    • JAMES M KOONTZ says:

You do realize sears owns Kenmore, right?

    • Bill says:

I also own a company that put grills among other things together for Home Depot and Lowes. I actually have one of these on my deck and, yes, the pan rusted and failed.

    • Slatino says:

This is a settlement in which Sears is offering to provide $180 gift card, $125 check, or firebox replacement in exchange for not having to admit wrong doing. All anybody who joins this class cares about is getting some redress from Sears for their defective grills. There are hundreds if not thousands of people who will be a part of this class. Sears would not sign on if they weren’t concerned about their liability for their grills.

  3. Yvonne Smith says:

this is was a real defective equipment

  4. Kimberley wolff says:

I love Sears they have qualtyreliable products.who is perfect.probly not made in the united States by Americans for Americans.Kim Wolff the grill stil made a wonderful gift.

  5. James Philip says:

I got same problem, it was completely defective, Un fortunately i don’t have receipt.

    • Slatino says:

Go to the Sears you purchased the grill from they should have a record of your purchase and that will satisfy instead of your receipt. Sears should have a history of your purchases on their database.

      ADMIN – Hi Slatino,

On March 1, 2017, the admin filed an unopposed motion for disbursement of the funds after appeals were dismissed. Presently there is no timeline for payment.

      • Chris says:

Stores can only go back an year if possible and provided the customer gave them their information at checkout. This is why they ask for phone #

  6. Heidi Bates says:

Its unfortunate that a receipt is required. I like most almost never keep any receipts for items i may purchase!!

    ADMIN – Hi Heidi,

I encourage you to keep all receipts for purchases over $100

    • Adrienne Baumgartner says:

Heidi, Who in Gods name keeps receipts for 5 or 6 years? We received on as a gift from my family for Fathers Day in June, 1912. Guess it’s good for you, so that’s one more rebate that you can screw a legitimate purchase from being paid.

      ADMIN – Hi Adrienne,

The role of a class action administrator is to distribute as much of the money as possible while preventing fraud. The rules of a settlement are often decided by a judge. In your case however, since the grill was purchased in 1912 which was the very beginnings of Sears you do not qualify. These grills did no exist then.

  7. pat says:

if my serial number on my kenmore grill is one of the defective models and i back that up with evidence can i be eligible for the one time payment…

    ADMIN – Hi Pat,

I believe you have to file a paper form and select the receive as a gift option if you were not the original purchaser.

  8. Mark says:

Regarding my receipt issue, I contacted Sears Credit Card Services and they promptly sent me a courtesy copy by USPS within a week. The Kenmore gas grill that I purchased started rusting with 18 months of purchase (June, 2013) even as it was constantly under cover. The rust is so bad now that unless I want to call the fire department, I dare not fire it back up.

  9. VP says:

Can the replacement part be purchased from Sears for self installation?

    ADMIN – Hi VP,

    It is worth checking.

  10. Christy Moore says:

I filed a claim with all required info. I requested the $180 gift card. When will I receive this?

    ADMIN – Hi Christy,

Most likely you will receive it after the deadline which is set for 2018

  11. Carlos Marquez says:

Check your online Sears account purchase history! I just did and found the online order information. It also has in-store purchase history.

  12. dameta Fields says:

I usually love Kenmore but this one was of poor quality.

  13. Shaun M. says:

The claim form also affords the option, in absence of a receipt, to rely on Sears records. Since I purchased this grill in 2012, and used my club card, they surely must have a record. I bought the grill in the Sears store in Ramona, CA. I now live in North Carolina, so going to the store is not an option. I submitted very clear pictures of an incredibly rusted through fire box. I have always kept the grill under cover and int he garage in the winter. The level of corrosion of the fire box was incredible, considering there is no other rust anywhere on the grill itself. I’d just like to get it fixed, and don’t want to go without a BBQ for an entire summer waiting.

  14. MProbert says:

    Fact: Sears is Kenmore.
Fact: If you purchased a grill at Seats they have a record of the purchase. No receipt needed.
Fact: Sears will not directly stand behind a defective grill if it the warranty has run out (approx. 1 yr.) unless you purchased a “plan”.
Fact: The settlement company has indicated to me NOT to expect any form of compensation ($135 cash or $180 “gift certificate”) for at least 6 months.
Fact: My Sears has indicated they can/will do nothing further to remedy or replace my grill.
Fact: I paid $279.99 ion May 1st, 2014. The burner plates went within 18 month. Sears locations do not stock. On line replacement cost and freight was nearly HALF the cost of the grill.
Fact: The remained of the fire box and burners rusted out in March, 2017. A settlement form was received (coincidence?) within a week.
Fact: Next grill will not be purchased from Sears. . . nor will I make ANY new purchases from Sears.
Fact: Customer Service is no longer a Sears benchmark. .

  15. Vic says:

If you missing receipt, go to Sears and ask them to go into computer and print out proof of purchase. I did, they have the record!

  16. Lauren Grady says:

Have same problem with Model 146.16132110. We bought it in July of 2012. Why can’t we file a claim too?

    ADMIN – Hi Lauren,

Because this class action is specific to the models listed.

  17. Tom cruise says:

People forget they got many years of use from these grills. Does anyone ever clean or maintain, clean fire box after use, probably not.

  18. Kristine Farley says:

Ridiculous that we have to wait that long, I wanted to replace my grill THIS SEASON!!!!!

  19. Luz Figueroa says:

Does anyone know when will oaks vs sear compensate the customers?

    ADMIN – Hi Luz,

    It won’t be until 2018

  20. Angela Shaw says:

I don’t have the recipe anymore I still have this grill, with a broken and rusted firebox that is falling apart

  21. Jeff says:

I bought my kenmore grill from Kmart and have receipt. Is this ok? It’s one of the model numbers.

    ADMIN – Hi Jeff,

    File your claim.

  22. Steven Silverman says:

I have the exact same problem with a Model 1486156210. It was purchased for me as a gift at Christmas 2012 and the firebox rusted out. I have written to Sears Customer Service, as well as directly to Mr. Edward Lampert and received no reply. I still have the grill although it cannot be used any longer. I also sent pictures along with the letters. Very poor service.

  23. Kristine Farley says:

it is crazy how long the process takes, I requested a gift card for a new grill (thinking I could replace the old one and actually use it tbis season…)They agreed in April-what’s the holdup???

    ADMIN – Hi Kristine,

    Contact the class action administrator.

  24. Pam S. says:

I filed receipts for old and new grill along with rusting picture of fire box. I received notice of deficient claim for a type 5 claim that I need documentary proof of Sears charge or quoted an amount over $300 for repair as my new was over $300. I am not looking to get the amount over $300, just the $300. I don’t think I should be type 6 as I have all the documentation and proof.

    ADMIN – Hi Pam,

I am not the admin for this settlement. Your best bet is to reach out to the admin directly.

  25. Teena Franklin says:

Love kenmore products but they are not lasting as long as they should 1 week washing machine went out the next the dryer went out.

    ADMIN – Hi Teena,

You do realize this settlement is for defective grills and not washers and dryers?

  26. K perrin says:

Hello I received a letter regarding the gift card entitlement however there’s no gift card just an account number how do I use it

    ADMIN – Hi K,

You use it just like a gift card. The agent will enter the number and pin when you make your purchase.

  27. Richard Dell'Anna says:

I received a notice that i am entitied to a $180.00 gift card, they included an account # and a PIN # but no instuctions as how, when or were to go to receive this gift card. Does anyone know what the next step is. .

    ADMIN – Hi Richard,

I believe that number is your gift card number

  28. Gary says:

I requested a replacement fire box – does anyone know when those will be shipped and does Sears send someone out to replace the part?

    ADMIN – Hi Gary,

I don’t have an answer for you. Perhaps you need to email the admin.

  29. Joe says:

I see other’s have received their gift card letter, Who do I need to contact about this? I have not seen anything since I submitted the original claim and I do have a claim number from the submission. Any information would be great!

    ADMIN – Hi Joe,

Reach out to the class action administrator.

  30. Gary says:

How do I go about changing my request for a replacement firebox to the in-store credit of $180? Any ideas would be appreciated.

    ADMIN – Hi Gary,

You may no longer request changes.

  31. Ed says:

I filed for my store credit for $180.00 on March 2, 2017 and have not heard a thing from Sears since. The grill was the worst piece of junk I have ever purchased. Have since gone back to a Webber, absolutely perfect. I’m wondering if I will ever see a dime from this. I haven’t spent bought a single thing in Sears since. No mystery why they are closing stores all over.

    ADMIN – Hi Ed,

I would contact the class action admin. This was paid out a few months ago,.

  32. Annette Burdick says:

I have replaced the firebox tray already and purchased a new one a few years ago, which is obviously made of galvanized steel. Should I not use it anymore?

    ADMIN – Hi Annette,

For issues related to safety you are better off reaching out to the manufacturer.

  33. Harry Wellens says:

I filled out all the paperwork for fixing my grill. I have not heard anything yet. I see some people have received notices from sears. The site for getting information has not been updated since February 2017 -a year ago? That site says don not go anywhere else for updates.

    ADMIN – Hi Harry,

I would reach out to class counsel.

  34. Mike Rockefeller says:

I brought my letter of settlement of $180 to the sears store in Lincoln, NE, and none of the employees have any idea of how to us the Account # and PIN. They suggested i call the number on the form, which only gets me a recording of the subject of the lawsuit. Repeat question from several in this thread, how does one apply this Account number and PIN ?

    ADMIN – Hi Mike,

Try reaching out to the administrator using their main contact info

  35. Jim May says:

My grill is less than 2 years old and is falling apart. I filled the paperwork out months ago. As of now I cannot use my grill because Sears parts cannot supply repair parts.

They should have to buy them back.

  36. kathy says:

I have a Kenmore grill just like the ones on this list which is just like the ones here on this list mine is nothing but junk, the model # is not on the list for the one I have and it is the very same one I called Kenmore they refused to deal with it I did buy mine at KMART so I called them and they refused to deal it. So now I have a grill that is falling apart that I can’t use and I paid over $300 for it..

    ADMIN – Hi Kathy,

Maybe you should consider reaching out to a class action attorney and get another lawsuit started.

  37. Karla Young says:

I put in a claim months ago and I have not heard back anything..

    ADMIN – Hi Karla,

Reach out to the class action administrator.

  38. Craig R. says:

I filed my claim online, but have since moved and I haven’t heard anything back prior to our move. Is there a way to contact them for change of address or check on the claim?

    ADMIN – Hi Craig,

I believe this was paid out a few months ago and the administration is no longer available to attend to escalations. Try the contact information we provide above but chances are you missed out.

    • Peter Steitz says:

I submitted a claim on September 5, 2017 requesting the $180 Sears gift card. While I could not find the receipt of purchase, I did have photos of the grill, model and serial number, and the defective burner box, which flared up dangerously the last time I tried to use it. I have not received any compensation or any other communication in response to my submittal as today’s date (May 21, 2018). How can I find out the status of my claim? When I call the number I get only the auto attendant, no answer from a real person.

      ADMIN – Hi Peter,

This is the company handling the settlement. Try reaching out to them directly.

  39. pete says:

Is it possible to add a model number to the suit? I have model 148.16656010 with the same exact defect purchased 8/29/10. I can provide a receipt/pictures.

    ADMIN – Hi Pete,

Your best bet would be to reach out to a class action attorney and start a new case.

  40. Mary Jo Valko Warner says:

early on I filled in all the appropriate paperwork and gave documentation of purchasing the $385 grill because of it’s proposed durability… of course, the pan rusted… all I want is a replacement pan or equivalent. Will I ever hear from anyone?

    ADMIN – Hi Mary,

Have you tried reaching out to the class action administrator?

  41. darlene pruttt says:

i purchased kenmore grill thru layaway at kmart will they have in there acct

    ADMIN – Hi Darlene,

Even if they had a record the deadline to file has passed.

  42. E Muchnick says:

I’m in the process (on the phone now) of making my forth call after filing in December. I was told in March I had been approved and payments made my the end of April. May 8 my next call was told someone would contact me within 10 days … May 21 I was told someone would contact me within 7 days … Now June 1, 2018, oh crap, now I am told it is going back to sears for them to verify again that I bought a grill from them…Wait, they are the ones that told me I bought a grill, filled out the warranty info and now I should file the application for the claim. I will probably never get anything!

  43. Judy Martin says:

I filed my claim with proper documentation Jan 2017, resent requested info about 6-8 months ago. Have not heard anything since, so I call the Rust Consulting Admin yesterday to see what was going on. After the operator pulled y records, said she had to send it to “someone(powers to be)” to review my claim. She could not tell me why it had not been reviewed for payment in all this time. My question is who is responsible for making sure Sears is honoring their settlement? Because, from all the comments on this page, it appears that Sears is reneging on their promised settlement to the injured parties. If this is so, who do we go to for resolution.

    ADMIN – Hi Judy,

Class counsel and the class action administrator are responsible.

  44. Jenny Perreault says:

I have called the claims administrator several times over the last 18 months regarding my claim. I keep getting told that not all gift cards are sent out and to check back next month but no info is available over the phone. This is ridiculous. Just today I sent an inquiry to rust consulting per the Admin advice listed on other comments. I am running out of hope, especially since I chose the gift card method and my only local Sears store in closing in a few months.

    ADMIN – Hi Jenny,

Get a hold of class counsel.

  45. Luz figueroa says:

When will we be compensated for the defective grills.. it already was seen in court so why haven we received our gift card. Can anyone answer that

    ADMIN – Hi Luz

People started receiving checks last week.

  46. Kurt R says:

I too had issues with receiving my court ordered relief. After reading these blogs and the reply’s from the ADMIN, I mailed a letter to the “Claims Administrator @ Settlement Administrator” and within 6 weeks I received a Gift-Card # and PIN # in the form of a letter not a plastic card. Redeeming it via SEAR’S website under the “My Accounts” drop down list for gift cards was easy and the funds were immediately spent (just incase…).

  47. Lyz figueroa says:

I’m still waiting on my settlement from oaks vs Sears when will I be paid it’s been 2 years and I don’t know who I can contact or even ask about this issue. Any help will be appreciated. Thank you
    Luz Figueroa

    ADMIN – Hi Luz,

Reach out to the class action administrator.

  48. Victoria Reed says:

I have a Kenmore Gas Grill. Dont use it much. Model 23681. Notice a month ago it has rusted out. Its past the closed date for this settlement. What can I do? I have everything I need except someone to resolve the issue.

    ADMIN – Hi Victoria,

You could reach out to Sears customer service.

  49. Todd Stiffler says:

The telephone number is now disconnected! Never got my rebate. Every time I called they would say the checks will be out at end of month. They always said my claim was approved. Why is it disconnected?

    ADMIN – Hi Todd,

That usually means distribution already took place. Try reaching out to class counsel. My suspicion is that your check was lost or stolen in the mail.

  50. Donnell Cooper says:

Hello I recently experienced a massive fire explosion from my Kenmore Grill which was also purchased from a local Sears store about 2yrs ago. Can you provide any details on how to proceed on how to file a claim with Kenmore on the defective equipment?

    • Angelica (Admin) says:

Hi Donnell, Sorry to hear that, but we cannot answer your question. We are just a class action newspaper. Second, this case’s claims deadline already passed — please review the deadline above.
