You are part of the Settlement if:

You submitted an employment application to Lowe’s; and

You were the subject of a background check procured by Lowe’s for employment purposes between:

  • (1) October 9, 2012 and May 6, 2015 (if you applied for employment with a Lowe’s store), or
  • (2) October 9, 2012 and July 5, 2015 (if you applied for employment at Lowe’s corporate headquarters through an external source), or
  • (3) October 9, 2012 and July 9, 2015 (if you applied for employment with Lowe’s corporate headquarters at a kiosk).

Case Summary

According to the lawsuit at the time the plaintiffs applied for a job, Lowe’s pulled a background check about them. Lowe’s asked the Plaintiffs to sign a disclosure and authorization form that contained a liability waiver, which according to the Plaintiffs violated the Fair Credit Reporting Act, 15 U.S.C. § 1681b(b)(2) because it contained additional language other than a disclosure under this law..

    They don’t allow you to fill it out online. You have to print up the PDF.
    How do we know if they did a background check?
    I filled out an application with them during that time, but they don’t tell us if they did a background check.

    I never received notice that I was part of this class action suit..After researching the state of North Carolina employment laws it is very transparent that North Carolina is a right to work state or a at will state if you prefer.I have dire concern about how this will effect my future chance of employment at lowes or any other company since my name and personal information will now be part of a data base..I am also upset because I was never contacted to be apart in what I feel may be a frivolous lawsuit..I have questions as to if the original complaints in the case (Brown) had a criminal background that prevented them from being hired,how much did Brown receive in the settlement,how much did the many attorney’s receive in the settlement? I have tried going on the website provided and contacted the phone number provided starting on 12/22/2016 on numerous occasions without a single reply! I wonder is this a valid law suit or is it a drive by case where someone is simply manipulating the Constitution to allow federal laws of states rights? Please contact me..

    Whatever happened to this settlement? I was enlisted in this and never submitted a form because it said do nothing and you was entitled to be part of the settlement.
