If you received a postcard, Defendant’s records indicate you are included in the Settlement. Specifically, the Settlement includes all persons in the United States who received a call on their cellular telephones from M3 Financial made using the Global Connect dialing platform (ATDS and/or prerecorded voice messages), and whose number was not listed in the patient or guarantor field, from May 12, 2011 through May 26, 2016 (the “Class Period”), inclusive, as identified in the Class List.

Case Summary
Plaintiff alleges that Defendant violated the Telephone Consumer Protection Act (“TCPA”) by calling persons on their cellular phones using an automatic telephone dialing system or artificial or prerecorded voice, without prior express consent. The TCPA provides, among other relief, that a plaintiff may seek statutory damages of up to $500 per violation, and that this amount may be trebled for willful violations. The TCPA does not provide for the recovery of attorneys’ fees. Defendant denies any wrongdoing, denies that it violated the TCPA, and specifically denies that it used an automatic telephone dialing system or an artificial or prerecorded voice to make calls without prior express consent.

I get robo calls all the time on BOTH of my phone numbers… 719-395-8334 and 719-838-1547. I even got one on Thanksgiving morning. They’re always about staying at some luxury hotel-motel, resorts, and or vacation cruises. The numbers that come up on my caller ID always changes… most are in my 719 area code and many are either out of Pueblo, Colorado Springs, Leadville, Salida, and or Buena Vista Colorado. (Not smiling)

I have got a lot of these calls and there seems. I have reported some to the sheriffs Department in my county. And they have stopped but there are others that keep coming up and if you block the number they just call me back from a different one.

How can I find out if I am included in this suit. I am always getting these kind of calls. I get the ones saying I won a vacation, ones that just say please hold and will be right with you and then they ask a question that tries to get you to day yes, calls saying I asked for information to get my prescriptions in the mail when I never asked for such info and then there are calls that you answer saying Hello but no one says anything for like a minute and hangs up. I am so tired of getting these calls even when you block the numbers and have your number on the “DO NOT CALL” registry list. What can be done about this because I am to the point of no wanting to answer my phone.

I received the post card long ago. I though I was included in the class. The court date you guys spoke of has long ago passed. I’ve had no other communication with anyone. I have not received any settlement, nothing !…No one responds to my inquiries.. I don’t know what the result of the court proceedings were… Is this some kind of Scam ??

Not a scam. Class action settlements are subject to appeals and often take years to resolve.

The Court will hold a Final Approval or Fairness Hearing on May 10, 2018 at 10:00 a.m. to decide whether to grant final approval of the Settlement. If Judge Andrea Wood grants Final Approval, and there are no appeals, the Order will become final thirty days from the date it is entered. If there are appeals, the Final Approval Order will not become final until those appeals are resolved. It is always uncertain whether and when appeals would be resolved. The Claims Administrator will attempt to pay all claims within 30 days of the date the Order becomes final.
At this point I have not seen any forward motion which leads me to believe that the case is under appeals
Is there any update on this claim? I emailed the admin to have my address change because I’m moving and have yet to hear back about anything.

On the website it says the case was granted final approval pn June 29th 2018. It’s now October though so who knows.
