You are a member of this class action if you purchased or leased Mercedes-Benz vehicles in the United States that are Model Years 2005-2007 equipped with M272 (V6) or M273 (V8) engines bearing serial numbers up to 2729..30 468993 or 2739 ..30 088611, respectively. You can verify your serial number by checking your past repair orders. Class Members may also enter the Vehicle Identification Number (VIN) on the settlement website to see if their vehicle qualifies for benefits from this Mercedes class action settlement.

In this settlement the plaintiffs allege that Mercedes produced certain vehicles equipped with defective gears in their balance shafts (in the event of the M272 engines) or with defective idle gears (in the case of the M273 engines). These defective gears wear out prematurely, excessively, and without warning, causing the vehicle to malfunction, the ‘check engine light’ to remain illuminated, and the vehicle to have symptoms such as misfiring or catastrophic stops.

    What if you don’t have the car anymore but had to pay out of pocket

    If you have documentation that includes the VIN, mileage at the time of the repair and expenses associated to the repair as well as proof of ownership you can still claim.

      We also paid out of pocket due to the warranty had expired. We would like to appeal the decision we received stating we had a warranty and the warranty covered the repairs.


      I filed on the claim because I was notified of the settlement and my car was one of the ones that it applied it. I mailed in all my forms and receipts, they notified me they received them. That was back in Dec. I read online that the deadline to mail out checks was Feb. 18th, I have received nothing. I’ve been trying to contact them about when I could expect something in the mail and no response. I wish I knew who else I need to contact. Kinda left in the dark about this.

      Balance shaft needs to be changed we have all the codes from the check engine light we saw be told we need to change the motor would be cheaper the motor has 41k on it and we are being quoted at $5200 for motor with same mileage.

So far I only replaced an air/oxygen sensor and I am not sure if my balance-shaft is acting up hence I do not know the car symptoms to this.       Having the same problem had other repairs done 2 weeks ago picked up my vehicle engine light was still on had Mercedes check it out said i had a balance Shaft problem couldn’t leave it becuse they gave me an estimate of 5500 to 7500, The same day i just paid for other repairs wish was a total of 2,550 in another 139.00 for Mercedes to do more diagnosis please i need some type of assistance my number is 504)296-0706

    My 2006 with 115K miles has the engine light on and I have taken it to the local Mercedes dealership here in Houston Texas (July 2015). I was given an estimate of repair for the sprocket and gear of $9,957.63!!! So from what I can tell at this point they will only have to cover 37.5% of this cost of repair? or is this dealership increasing the cost of repair and trying to make some $$. Not sure what others are paying and if I should look into finding another Mercedes dealership to take my car to…. HELP!!

    miles original. Is there any help for me since the mileage is low and the car has not demonstrated the

    I have a 2007 ML350 and the “Check Engine” light is on. I took my car to my local Mercedes-Benz dealer and yep! it is the engine defect issue. Ok, fast forward 1 month later after the judgment… NOTHING! My car is still broken and nothing is being done about it. This is my first and maybe my last Mercedes Benz if this isn’t handled correctly. And so far it’s not! This is unbelievable!

    Back in Nov., 2014, I received this quote regarding my 2006 ML 350:

    The estimate for the check engine light repairs are below:
    Engine balance shaft $6885.00

    I was to told then about a possible settlement. I received a letter in April stating that my vehicle is part of the settlement. What is my next step? Do I have pay and hope for a reimbursement? I don’t have funds to get this serviced. I contact my Mercedes service center and they are clueless, even though they alerted me to this last year.

    I have a 2006 C230 with 117K miles with engine light on, I took my car to the Mercedes dealership and it does qualify via the serial number. I have asked the dealership several times now since the settlement about repairing my vehicle, I get no response. When I had my car there in July, they gave me a quote of just under $10K for me to pay to have the car fixed. Since this settlement, is the dealership supposed to fix my vehicle for free? Can a Mercedes dealership refuse to fix my car?

    I have the 2006 C230 with 117K miles, it has a qualifying vin # for the class action suit. I have sent in paperwork to the administrator, along with the quote of 10 thousand from the dealership here in Houston for repair/replacement of cam shaft/sprocket. My car engine light codes exact what is for this cam shaft issue. I am trying to find out if this 10K is overpricing of the repair? Now that there has been a settlement, the dealership has not returned my messages as to them fixing my car. Can a Mercedes dealership refuse to fix a vehicle?
    Also, with my car being a 2006 with 117K miles does that mean I am responsible for paying for most of this repair or is the entire repair to be covered?

    we had our vehicle at Mercedes a few months back and they stated teh repair we needed was under this settlement and we field as we could not afford teh repair at teh time. However it now says if our vehicle has over 125K miles on it we get no reimbursement…so its a recall but we cant get any reimbursement for it and its the repair our vehicle needs? 2006 R350 with 150K miles

    I just want to clarify I have a 2006 c230 the vin number has been checked and is covered under this settlement . the car has less then 80000 miles and is less then 10 years old and has been diagnoised that it will need this repair made. So I would have to pay for the this repair if it is at a standard mechinice shop and then send the bill and the completed form to Mercedes to get my 37.5 percent refund correct?

    My 2006 R350 was just diagnosed with this camshaft problem. It would appear that I am just past the 10 year old limit yet under 125,000 mile limit. Too late to join the class action law suit. While the car runs well and I like the car, I am likely facing a $6000 repair. Who would buy it if I try to sell it? The repair amounts to half of what the car is worth. Have had three other repairs of $1000+. I have had minivans with much lower reliability ratings that have had far fewer and less costly repairs. Thought I was buying a quality vehicle.

    Hi I bought a MB ML 350 2006 with 115000 miles. a couple a month ago and my check engine light comes on from time to time went to the dealership, they told me three of the sensors needed to be replaced around 1000$. The car has less than 39,000 miles. I was never notified of any problems with the car, although I always get scheduled repairs by the dealer. Do I have any recourse.

    I am reading through all these posts and I just want to say, please contact Mercedes! I have an 06 ML350 that was just diagnosed with this repair. I am 10K over the mileage and was unaware of this lawsuit as well. I sent a letter to Mercedes as soon as I got the estimate of repairs. Something has to be done for all of us who were not aware of this class action suit and are stuck with a ticking time bomb of a vehicle. Mercedes says “The Best or Nothing” in regards to themselves. We need to band together and make them prove it!

    I just bought ML350 2007 with 112k on it. An independent mechanic will do the work next week. About how much should I expect? It sucks that Mercedes cars have these issues.     I own a 2007 Mercedes-Benz 4-Matic which is among the affected models (verified from VIN #). I did get check engine light at 63,000 miles and also noticed hesitation in shifting gears, took it to MBZ dealer in PA, they replaced transmission control module and some other parts for which I paid more than $2000. though the problem with shifting gears is still present, that my car still drives (now has 68,000 miles) and 6 months short of it’s 10th year.

    I have two questions:

    1) I filed a claim for above repairs but got a response that my claim do not qualify either due to deficient docs, or repairs that are not covered as part of Class-Action. How and Where I can appeal my claim since I strongly believe this issue is related to balance-shaft ?
    2) I want MBZ to provide me warranty on balance shaft for next couple of years since I have such low mileage (68k), but my car will be soon 10 years old. As what I have heard the total failure of the part happens between 60,000-80,000 miles and I am afraid that it’s going to happen sooner or later since the symptoms are already there.

    Please help me in reimbursement for computer control module repairs and many other repairs that I have already paid and also an extended warranty at least on the ‘Balance Shaft’.

    I am so angry at Mercedes and the class action lawsuit on this matter I can spit nails. I completed the necessary documents and sent it back in for this class action lawsuit. Did not receive any follow up. Unfortunately when I did do research I discovered that the matter was closed and I was not included. I purchased my vehicle in May 10, 2013. Experience a check engine light for the first 30 days. When I returned the vehicle I noticed the service person didn’t note the issue and I didn’t think much of the notation on the receipt (this will later come back to haunt me not once but twice). They turned off the light and gave me a none concerning reason, but again not noted on the receipt. I return the car again when I noticed that the vehicle had a hole in the back floor (covered by carpet). I took the vehicle in for an evaluation for the check engine light issue as well as the floor repair. The dealership was remodeled and had a different set up and a new new name (maybe purchased by a new owner?) I was sent to the cashier desk to pick up my vehicle I ask for info on the check engine light. I was told I had to wait to speak to a service person. Plus I noticed the engine light issue wasn’t noted on my receipt only the carpet. I waited for 25 minutes and returned to the cashier who handed me the person’s card. I had to return to work and the dealership is approximately 45-60 minutes drive back to my city to work. I later called the service person and left numerous messages that entire week and never received a call back. I end up taking my vehicle to a mechanic that specializes in Mercedes and it was then I was informed that my balance shaft is the reason my check engine light is on. My car is unable to pass smog and when speaking with another dealership today they are aware that Mercedes USA is not going to help me and do not know how I fell off the radar in this matter and the cost to repair is now at $7800.00. Now I have a car that I only can dismantle and sell the parts or donate it. In the state of California you can not sale an automobile that can not pass smog. Now I have no vehicle to drive! I will never ever deal with this car manufacture again.

    My low mileage ( 62,000) 2007 E350 was just diagnosed with the dreaded balance shaft problem and my dealer quoted $7800 ( plus tax) for repair. I bought the car in 2011 from the same dealer with 13,000 miles. The car indeed has the problematic engine parts as per a VIN check.I was unaware of the subsequent class action suit. Mercedes Customer Service says tough luck, case closed, which I find infuriating and unacceptable. Whose responsibility was it to inform me of the class action suit. Can/should the dealer unilaterally cut me a break now?

    I have a 2006 ML350 with 118K miles and it definitely has this issue. Engine light is on, the codes are there, and engine serial number checks out. Misfiring, rattling in idle position, all symptoms present. Problem is, it’s passed the submission deadline and I just bought the car last summer. What are my options and what can I do since I bought the car after the lawsuit deadline?! Is there anything Mercedes can still do for these cars since they fucked up in the first place? 10 years is not enough!

    I leased, and then bough, my 2006 E350 when it was brand new. Now after only 117,000 original miles over 12 years, the car has “self destructed”. My mechanic says the repair would cost more than the car is worth. I can see from the numerous comments that Mercedes Benz will deny all liability for its admittedly defectives vehicles unless one knew about the class action and joined it. I did not know about it and was newer informed by Mercedes that they had sold me a defective vehicle. My only resort is to sue them in small claims court. The maximum judgment amount would be $10,000. but Mercedes has already admitted liability and that would be the cost of repairing the car.

    Seems to me that the hard-rule here for 2005-2007 is missing a KEY piece of information regarding the engine numbers that are covered. I have been informed that engines starting w/ “34” in 2005-2007 were covered for this warranty.

    However, I have the exact same problem with a 2007 E350S which has an engine number starting w/ “35”. I am interested to know if a similar or the same problem was reported on the engines that came after those covered by the warranty claim or if another class action suit is the only recourse.

    Hello, Hoping someone can point me in the right direction. E350 2009 was taken to two auto repair shops. Both came to the same conclusion. It’s this exact issue. I never knew about this problem never got a recall shop estimate 6500.00 – 7,500
    I have 98,000 mile on it.
    Both shops said I should send it to the junkyard. I rely on this car. Now it’s worth nothing. With Covid I don’t have a penny to fix me/be more do I have any funds or enough credit to purchase another car. 🙏🙏🙏🙏HELP RACHEL
