Class Eligibility

Under the terms of the Novant Health 401(k) class action lawsuit settlement, Class Members include all current and former participants and beneficiaries who participated in any of the following retirement plans between Oct. 1, 1998 and Sept. 30, 2015:

  • The Savings and Supplemental Retirement Plan of Novant Health, Inc. and the Tax Deferred Savings Plan of Novant Health, Inc. (collectively, the “Retirement Plus Plan”)
  • The Franklin/Upstate 401(k) Plan
  • The Presbyterian Women’s Care Corp. 401(k) Plan
  • The Lakeside/Q-Neck 401(k) Plan
  • The 457(b) Retirement Plan of Novant Health, Inc.

The Retirement Plus Plan Wrap Nonqualified 457(b)/457(f) Plan of Novant Health, Inc. (the “457(f) Plan”) Excluded from the class are members of the Novant Health Retirement Plan Committee, the Administrative Committee and members of Novant Health, Inc.’s Board of Trustees since Oct. 1, 1998.

Estimated Amount


Eligible Class Members can receive a distribution of the net settlement amount divided among all Class Members based on their Modified Average Account Balance during the Class Period.

      What facebook page? I am not aware of such a page. I also understood the funds were to be paid within 6 months of the final ruling and appeal. Would that be before March, 2017?

      Yes, March appears to be the target date but generally it is wise to expect delays.

    Every one does not have smart phones or a computer, how will they be notified their monies from settlement are available and when to expect it?

    If you are reading this you most likely have access to technology. Additionally, if you worked for Novant health you are very likely to be among those of us who at the very least has access to a public library where computer access is complimentary.

    I have not received my check friends have. What is the crieteria or order of how the funds are distributed??

    Never received my settlement check. Me and my mother both worked for Novant during this claim period. My mother recently passed away, but my father received a check on her behalf. My address has changed several times. I desperately need this check. My new permanent address is 1526 Wright Rd, Lexington NC 27292. My phone number is (336)247-6722.     Well worked in and out of Novant in Charlotte my retirement fund was around 42000 however none seems to know me now they sent me a check for .02 cents and said that I had 3.24 cents in account after 15 years of service at different Novant hospitals this is my thanks picked up nursing bulletin read that novant is most secure financial Hospital in region it burns my soul to know how nurses are treated now I sit here at 67 years old with a check in my hand for .02 cents .Nurses be careful with who you work for is what I have to say.!!!!!!!!!!!!!!!!!!

    My mother passed away January 25 2016 with Retirement benifits and a life insurance policy! I contacted the office in Winston Salem and the distributed the life insurance benifits but as the acting Administrator of the Estate I asked if her retirment and the lady said she didn’t have any. Now looking at her tax statements from back in the 90s to now she was in a retirement plan. What can I do to get these funds into her

    Seems no one has any answers but lawyers if nurses said that to a patient I wonder how long patients would stay at the hospital. if this is Administration and no one knows anything it looks like the nurses that work for Novant needs a strong Union in North Carolina maybe funds would not mysterious disappear if there was some acvountablity.
