Case Name

In re Optical Disk Drive Antitrust Litigation
Case No. 3:10-md-02143-RS
District Court of Northern California

Case Summary

The plaintiffs in the optical disk drive class action lawsuit alleged that the electronic companies conspired to fix, raise, maintain, or stabilize optical disk drive prices. As a result of the alleged price-fixing conspiracy, the plaintiffs claim that they were forced to pay more for the affected products than they would have without the alleged conspiracy.

The electronics companies do not admit to any wrongdoing, but they have agreed to the terms of this class action settlement to avoid the cost and risk of going to trial. This class action settlement was preliminary approved with the various companies starting in 2013 through 2015. The original deadline to file a claim to participate in this class action settlement was June 22, 2015, but the date has been extended to March 7, 2016.

Do this law suit apply for the 3 playstation 2’s I have bought and the DVD ? player. I bought them out the store.. And my DVD player didn’t play the movies right and my game stop working within a few months..and the other two don’t read some of my games..

    ADMIN – Hi Ethel,

I am sorry your devices are defective. This class action has nothing to do with product performance or defect. The class action is an antitrust settlement. In simpler terms it means that the manufacturers may have talked to each other and agreed on maintaining certain prices which eliminated competition and hindered the consumer’s ability to secure a better deal. Some Playstation’s are included in this settlement. I encourage you to read the notice and file if you qualify.

  2. Zachary says:

So does this lawsuit only apply to businesses or what? As a consumer I can’t imagine how or why you would buy direct from a manufacturer over a retailer. I have several of the items on this list, but it doesn’t apply to me since I bought from other sources?

    ADMIN – Hi Zachary,

If you purchased your devices directly from the defendants then you qualify. If you purchased from retailers you don’t qualify.

  3. Ben pratt says:

I bought a PlayStation 2 and PlayStation 3 and a blu Ray player

  4. Reginald McFarland says:

I purchased a Toshiba Laptop and a Phillips DVD player, I went to the website to File a claim, but mine will not go through because, on the claim form they have a [part that says (Capacity), Don’t know what to put here. I thought they meant amount of what you claim. Please advise, I would like to receive a part of what I gave up for.

    ADMIN – Hi Reginald,

The form is asking in what capacity you are filing.

  5. John says:

the claim is asking for capacity what is that?

    ADMIN – Hi John,

In what capacity are you filing?

  6. NANCY says:

I purchased several of these devices directly from the defendants. I don’t quite understand the settlement payout for this case. Will each person receive a refund for all items purchased or is it a set price listed above? It says $30 on the main page, then on this page it says “varies”…what will be the payout for this claim?

    ADMIN- Hi Nancy,

You are not receiving a full refund. We estimate that you will receive $30 or less per item.

  7. Jason says:

If I bought a PlayStation 3 from Best Buy, do I still qualify?

    ADMIN – Hi Jason,

    No you don’t qualify

  8. P. Suzuki says:

What am I supposed to enter in the “capacity” field?

Also, I keep getting an error message when trying to submit. Is this because I am not filling out the “capacity” field correctly?

    ADMIN – Hi Mr. Suzuki,

The field is asking in what capacity you are filing. Are you the direct purchaser or a representative?

I owned a small computer business during the period in question and I remember purchasing optical drives by the case. But since the company no longer exists, how can I get what is due me?

I remember buying items years ago but have since lost the documentation, but I still have the items – would that count as documentation? I assume they can look up the serial number?

At this point it no longer matters. This settlement had a deadline of March 7 2016.
