The Settlement Class includes all residents of the United States who purchased for personal use, and not resale or distribution, one of the following “Covered Products” between May 1, 2007 and June 5, 2017 (the “Class Period”):

  • TripleFlex with Vitamin D3
  • TripleFlex Triple Strength
  • TripleFlex Triple Strength B/B
  • TripleFlex Triple Strength Twin Pack
  • TripleFlex Triple Strength LSG (Liquid Soft Gels)
  • TripleFlex Triple Strength with Vitamin D3
  • TripleFlex Double Strength (formerly TripleFlex® Maximum Strength)

NatureMade® Glucosamine products, including the following (all versions, regardless of the number of tablets/bottle):

  • Glucosamine 500 mg Tablet
  • Glucosamine 1000 mg Tablet
  • Glucosamine with Vitamin D [Vitamin D3]
  • Glucosamine 1500, MSM 1000 with Vitamin D [Vitamin D3]
  • Glucosamine 500 mg Chondroitin 400 mg
  • Glucosamine Chondroitin with MSM
  • Glucosamine HCL + MSM with Vitamin D [Vitamin D3]
  • Glucosamine MSM
  • Triple Strength Glucosamine Chondroitin

Berkley and Jensen (BJ’s) private label glucosamine products manufactured by Pharmavite, including the following (all versions, regardless of the number of tablets/bottle):

  • Berkley and Jensen (BJ’s) Triple Strength Glucosamine Chondroitin
  • Berkley and Jensen (BJ’s) Glucosamine 500mg Chondroitin 400mg
  • Berkley and Jensen (BJ’s) Glucosamine Chondroitin with MSM
  • Berkley and Jensen (BJ’s) Glucosamine/MSM
  • Berkley and Jensen (BJ’s) Glucosamine HCL + MSM with Vitamin D [Vitamin D3]
  • Berkley and Jensen (BJ’s) Glucosamine, MSM + Vitamin D Tablet [Vitamin D3]

Estimated Amount

$12.50 to $150

The level of compensation received will be impacted by the number of valid claims, access to proof of purchase and choice in settlement fulfillment with those opting to receive products obtaining a higher overall value.

Case Summary

The lawsuit claims that the labeling and packaging of products containing glucosamine and/or chondroitin made by Pharmavite LLC, including TripleFlex and products made for BJ’s by Pharmavite (specifically listed in Question 5, below), contain false, deceptive, and misleading statements. The lawsuit does not claim that these products are unsafe, and makes no claims about the safety of the products.

Pharmavite denies each and every allegation of wrongdoing, liability, and damages that was or could have been made in the lawsuit. Pharmavite denies the claims made in the lawsuit and denies it has done anything wrong. Pharmavite stands by these products, their labels and packaging, and their safety and efficacy.

    I have purchase many products from Nature Made. I broke out in a rash using both B complex . The omega oil gave me a upset stomach. The prenatal vitamins made me throw up. I am not pregnant, but have continued to use prenatal vitamins.

      This is not a refund. It is a settlement. Settlements need to be finalized by a judge before payments are released. Judges don’t finalize settlements after the deadline to submit claims. The deadline in this case is in November.

    The final hearing was in December, after the final hearing the judge allows time for appeals. If no appeals take place the class action administrator will move forward with check distribution.

    Hi my husband filed a claim and never recieved his refund or supplements as part of the settlement. My mom said she also filed a claim and hasn’t received hers either as of today nothing. My husband used my moms address because we were moving they are two different households different last names so im not sure whats going on can you please look into this my husband is Nicholas deane and my mom is judy mehard. My husband and I always use my moms address as a mailing address when we are inbetween moving but neither of them have recieved anything. Thank you

    I filed a timely 100% legitimate claim and have received NOTHING. No check or what I preferred which was replacement products. WHAT A SCAM! I guess that’s what scammers are good at and they never quit. I am very unhappy and going to contact the attorney general’s office as well as the FTC!
