    I had carpet installed along the entire basement of my residence. In addition, we purchased a love seat, sofa and new mattress for our master bedroom during that time period. Since then, we’ve divorced and I no longer own the love seat, sofa or mattress, but, I paid for such items intially in 2005.

    Bottom-line, I have no idea whether or not any of these products contain polyfoam. Can I still file a claim? I want to ensure I cannot be penalized if I truly do not know if polyfoam is in these items.

    No you will not receive full purchase amount. On settlements for price fixing you generally don’t receive a full refund. Instead you receive a pro-rata share of the pool based on the dollar amount submitted.

    $1000 goss cost of item
    75% value = $750 now consider the pro rate formula based on the full number of claims and gross value of claims and it is estimated that the amount one will get is about 6.9% or so but this can range from 20% not likely to below 10%. So on the case of 6.9% the take home check amount will be a measly $51.75 which you can use to buy some pampers for the overfed potty pooper. Makes one wish we had pursued law school in hopes of one day hoarding on a case like this riding the coat tails of the gross lawyer 35% take on the full case value. I hope they spill fine wine on their lavish foamy lux bed set. Time for me to go back to willy wonka for more sugar patties…

    I was told by the administrator that they expect distribution no sooner that mid summer 2017 into early fall 2017, however, on one of the websites for this class action stated that some checks went out spring of 2016.
    This is what it said: Distribution
    Settlement checks related to the Vitafoam, Carpenter, Leggett & Platt, FFP, FXI, Future Foam, Hickory Springs, Mohawk, and Woodbridge Settlements were mailed on June 17, 2016. These checks were mailed following the Court’s Order approving distribution of Settlement funds, which is available for viewing under the “Court Documents” section of this website.

    On March 31, 2017, a second settlement payment was mailed to eligible Class Members. This payment represents funds received from Hickory Springs and Woodbridge since the initial distribution in June 2016.

    If you are getting a check, they have not been issued and likely won’t be issued this week even though they anticipated 6-8 weeks from June 1st. Also, unless you claimed an extremely large amount of purchases, you likely will not even receive a check. They are not sending out checks to anyone who is receiving $10 or less. This lawsuit was a “scam” as some people are putting it. You can go on the court documents section on their website and see that for yourself. There are individuals who claimed millions of dollars worth of purchases and they are the ones who will get the money. Those of us who were honest and claimed what we actually spent, are not getting payment. If you do get payment, it will be pennies compared to what you claimed. If you have your claim #, you can look up to see if your claim is eligible by going to the court documents on the poly foam web site. It will not tell you how much you are getting, just how much your claim was for.

      There has never been an exact known timeframe for distribution. Any previous date mentioned was an estimate. As an update, there is currently no known timeframe for distribution. A motion to approve claims and to authorize distribution was filed on July 10, 2017. This motion is awaiting the Court’s decision. It is not known how long it will take the judge to make a decision. If approved, it will probably take at least one month from the approval date before distribution takes place.

      At this point it is not known how much eligible claimants will receive.

      Didn’t like 2 months ago there were saying in 6-8 week. Some people said they told them mid summer?

On August 3, 2017, the judge filed an order giving class counsel until August 17, 2017 to submit billing records. Once counsel submits this information, the judge will then take it under review.     Please understand that check distribution for settlements has nothing to do with your submission date. Instead, after the deadline passes there is a window for appeals. If the appeals go through and the case is finalized you still have to wait for the admin to validate the claims. Stuff like this takes years and years.

    The motion for the court to approve distribution was filed on July 10, 2017. Unfortunately, two objectors with minimal economic interest file an objection to the motion. That has now been fully briefed and the Court has the matter under advisement and we are all waiting for the decision. Nothing can happen until the Court rules. Even then, as happened earlier, there is the possibility of appeals from that decision which can cause further delay. We all hope that does not occur as we, as counsel for the Class, want the distribution to happen soon.

    The above is the best information available todate.

    Payment amounts are being verified if you call. Claimants are reporting that they are going to receive .006% of what you actually claimed. That means that if you claimed $3000, your piece of the pie is around $20. Definitely not really worth the wait but I guess that is $20 more than you had!!!

    This settlement was not related to quality. It was an antitrust settlement related to price-fixing. The administrator had to make decisions that best addressed those impacted the most. I too filed for less than $2,500 and got nothing.

    I have about $3400 in claims with receipts so guess I will see nothing either. And not even hear anything from them???? After signing my rights to pursue this matter away to ‘them’ at their beck? If you look around the universe you will see class action lawsuits are a cash cow for a hand full of big law firms who actually concoct many of these. Lawyers are the only ones getting rich – just look at a detailed billing submitted to the court sometime. Wow, wish I could make $2700. an hour plus a huge expense account. They also conspire to keep our medical and drug costs way way high by encouraging stooges to sue (contingency of course) over every little side effect that would otherwise be in normal range. I do know a lawyer that has a yacht down in the Virgin Islands named – you guessed it – “The Class Action”!!!
