  9. Craig says:

I had carpet installed along the entire basement of my residence. In addition, we purchased a love seat, sofa and new mattress for our master bedroom during that time period. Since then, we’ve divorced and I no longer own the love seat, sofa or mattress, but, I paid for such items intially in 2005.

Bottom-line, I have no idea whether or not any of these products contain polyfoam. Can I still file a claim? I want to ensure I cannot be penalized if I truly do not know if polyfoam is in these items.

    ADMIN – HI Craig,

Generally speaking all upholstered furniture and all carpet underlayment contains polyurethane foam.

      ADMIN – Hi Jared,

Please visit us more often to enjoy the comments of our dear visitors. Would love to send you checks but as you probably know I make no money from this project so there is no money to be sent. I thought on the claim form-it states that the IRS said this is not taxable?.

    ADMIN – Hi Kevin,

  75. charnese says:

Is the status of the settlement known? The closing date was feb 29 im just confused as to how long after settlement closing date will disbursement begin?

    ADMIN – Hi Charnese,

It normally takes a few months or even years before payments are issued.

  76. Umpa Lumpa says:

Formula will most likely look like this based on the recent posted court document:

    Example:
    $1000 goss cost of item
75% value = $750 now consider the pro rate formula based on the full number of claims and gross value of claims and it is estimated that the amount one will get is about 6.9% or so but this can range from 20% not likely to below 10%. So on the case of 6.9% the take home check amount will be a measly $51.75 which you can use to buy some pampers for the overfed potty pooper. Makes one wish we had pursued law school in hopes of one day hoarding on a case like this riding the coat tails of the gross lawyer 35% take on the full case value. I hope they spill fine wine on their lavish foamy lux bed set. Time for me to go back to willy wonka for more sugar patties…

    ADMIN – Hi Umpa,

You can still go to law school. You would make a fine lawyer.

  77. Kathleen Mangelsdorf says:

Recliner, chairs, $2000.00 mattress set, pillows The list goes on.

    ADMIN – HI Karen,

    Have you filed your claim?

  78. Mattutt says:

Hello- The form requests my SSN, which I’m not comfortable giving out without know more about who is getting it or how it will be used. Can I submit without it or is there another way to verify the needed info?

    Thanks,
    Matt

    ADMIN – Hi Mattutt,

The social security number requirement is to avoid fraud and duplication. I don’t believe there is an alternative. Your social security will be in the hands of the class action administrator.

  79. john says:

Would this also include memory form?
I have some memory products. But not sure if that counts.

    ADMIN – Hi John,

I don’t believe memory foam is made of polyurethane.

  80. Nancy says:

I actually have some of these furniture items and mattresses. I would like to replace them, but waiting for the claim payments to be sent in case I need to prove I purchased them. ADMIN – Hi Nancy,

    This settlement has closed.

  81. Chadd Weber says:

No, still waiting on the appeals if any…If you hear anything let us know.

      ADMIN – Hi Lou,

I will let you know as soon as I hear something.

  82. Allen Payne says:

If the settlement had closed why is the claim web site still accepting claims as of 03/28/2016. ?

    ADMIN – Hi Allen,

Most likely because the admin failed to turn off the form. You still have to adhere to the terms which indicate that the claim must be submitted online or postmarked by the deadline.

  83. K Edwards says:

I purchased a mattress topper 4 or 5 years ago. I didnt know about a claim/ settlement. I would like to fill out a form. Thanks

At the moment we do not have any updates.

  99. yale moslowitz says:

april 2017 when do the checks get mailed???

    ADMIN – Hi Yale,

It make take another year before we see any monies.

    • Bonnie says:

Why will it take another year before $$ is disbursed? We sent in the claims on time…just curious why this is taking so long.

      ADMIN – Hi Bonnie,

There are many legal complexities related to compliance when it comes to settlement distribution.

  100. IZOLA TAYLOR says:

What is the percentage or about how much will the checks be?

    ADMIN – Hi Izola,

This settlement is not yet to the point where there is a determination of the amount.

  101. N Roles says:

I filed a change of address with them this week. As part of their response they noted, “At this point we don’t anticipate distribution to occur until the mid-summer of 2017 at the earliest.” (direct copy and paste from email)
    Hope this info helps.

  102. MIA says:

This is soo strange because I received an email from the fund administrator advising that distribution will occur sometime this summer, never do they say in a year. I really don’t know who to believe anymore.

    ADMIN – Hi Mia,

Feel free to send your email to us so we can check and see if it is the real thing. You can send it to questions@classactionrebates.com

  103. Cynthia O. says:

Is there any update regarding the distribution time frame?

    ADMIN – Hi Cynthia,

For some reason I recall reading first quarter of 2018

  104. Tiffany says:

I was told by the administrator that they expect distribution no sooner that mid summer 2017 into early fall 2017, however, on one of the websites for this class action stated that some checks went out spring of 2016.

    http://www.flexiblepolyurethanefoamsettlement.com
This is what it said: Distribution
Settlement checks related to the Vitafoam, Carpenter, Leggett & Platt, FFP, FXI, Future Foam, Hickory Springs, Mohawk, and Woodbridge Settlements were mailed on June 17, 2016. These checks were mailed following the Court’s Order approving distribution of Settlement funds, which is available for viewing under the “Court Documents” section of this website.

On March 31, 2017, a second settlement payment was mailed to eligible Class Members. This payment represents funds received from Hickory Springs and Woodbridge since the initial distribution in June 2016.

    ADMIN – Hi Tiffany,

When did you contact the admin for the settlement? Usually the best is to reach out in writing via email so you can get a written reply and see if they match.

    • Tiffany says:

I emailed a couple of weeks ago and was told that there was no definite time of distribution but would likely no sooner than mid summer 2017. The other information I posted was directly from a website. Hopefully they will distribute in June. That would be great!!

  105. J.R. says:

Hi there, Several people called late last week and they were advised that checks will be going out next month (June 2017). No other information was provided.

    ADMIN – Hi JR,

I heard similar info from other community members.

  106. MN612 says:

IS there any clarification on the allocation plan? or anticipated payouts?

    ADMIN – Hi MN,

    None at the moment.

  107. LA says:

Seems there are two separate sites… one being handled by GCG and the other by AB Data
Not sure if claim needed to filed separately on each site. Seems strange as most of the same parties are involved on both sites and I didn’t notice consolidation of cases.

    ADMIN – Hi LA,

I believe one is for direct and the other one for indirect purchases. Let me check.

  108. Renee says:

Are there any dates on distribution?

    ADMIN – Hi Renee,

It appears it will take place in 6 to 8 weeks.

  109. Web says:

This is a copy/paste from the polyfoamclassaction.com regarding sending of checks.
    *******June 1, 2017 – Important Update*******
The Administrator is in the process of finalizing claims. Once complete, a motion will be filed with the Court for final approval of distribution. We anticipate the distribution will occur in the next 6 to 8 weeks.

  110. Valerie aviles says:

Willschecks be mail this week we be six weeks from June 1valst????

    ADMIN – Hi Valerie,

It appears that way. I will update our Facebook page when people start receiving checks.

  111. tb says:

If you are getting a check, they have not been issued and likely won’t be issued this week even though they anticipated 6-8 weeks from June 1st. Also, unless you claimed an extremely large amount of purchases, you likely will not even receive a check. They are not sending out checks to anyone who is receiving $10 or less. This lawsuit was a “scam” as some people are putting it. You can go on the court documents section on their website and see that for yourself. There are individuals who claimed millions of dollars worth of purchases and they are the ones who will get the money. Those of us who were honest and claimed what we actually spent, are not getting payment. If you do get payment, it will be pennies compared to what you claimed. If you have your claim #, you can look up to see if your claim is eligible by going to the court documents on the poly foam web site. It will not tell you how much you are getting, just how much your claim was for.

  112. Valerie aviles says:

Just call the number no checks in six to eight weeks maybe at the end of summer along await

  113. Midnight in Montana says:

I read on another website that check mailings will begin on July 24, 2017. I’m also seeing an approximate 1-10% payout on claim amount. Not really sure.

    • wi 2 says:

We are not getting checks!! Those who claimed a ridiculous amount and had proof are the only one’s getting checks. The rest of us, if we get anything, it will be pennies compared to what you claimed. This whole lawsuit is ridiculous.

  114. Wi says:

ADMIN, Could you explain why the amount we claimed is different than the amount posted on documents on miller court Documents? Thanks

    ADMIN – Hi Wi,

The amount you claimed personally? The amount you are receiving? Please clarify your question.

  115. trina says:

Where do you go on the website to look how much you gone get with your claim number.

    ADMIN – Hi Trina,

    The documents section.

    • Wi says:

The amount shown on documents is only the amount claimed not the amount your getting

    • john says:

Eveyone say’s go look at the documents. But there are 26 of them. But this is the one file:///C:/Users/John/Downloads/PF-%20DECLARATION%20OF%20ERIC%20J.%20MILLER%20REGARDING_WEB.pdf
It doesn’t say how much you will get, just how much you claimed.

      ADMIN – Hi John,

The gist of this is that you won’t get a ton.

  116. Nathan says:

ANY ONE THE PERCETAGE OF THE CLAIMED AMOUNT?

  117. Val says:

Just call the settle.ment they stated the checks might come in sept or?

  118. john says:

    It now say *******Important Update*******
A motion to approve claims and to authorize distribution was filed on July 10, 2017. This motion is awaiting the Court’s decision.

I thought it was already approved.

  119. Renee Giles says:

Previous sites state the courts are in recess and it will be late Aug or early Sept. I can’t understand why they are going back and forth with this. What happened to the 6-8 week time frame. How complicated can it be for the Judge to rubber stamp the check.

    ADMIN – Hi Renee,

Judges are in the business of seeking fair settlements. Sometimes that takes time.

  120. S.B says:

What is the Facebook page name

Our Facebook page name? Look us up doing a search for Class Action Rebates.

  121. j says:

What’s going on with this now?
It’s like every time I go to their site, they say something different.

    ADMIN – Hi J,

More delays… Go to our Facebook page to check on the latest update.

    • j says:

      Just got this from them:

Thank you for your inquiry regarding the In re Polyurethane Foam Antitrust Settlement.

There has never been an exact known timeframe for distribution. Any previous date mentioned was an estimate. As an update, there is currently no known timeframe for distribution. A motion to approve claims and to authorize distribution was filed on July 10, 2017. This motion is awaiting the Court’s decision. It is not known how long it will take the judge to make a decision. If approved, it will probably take at least one month from the approval date before distribution takes place.

At this point it is not known how much eligible claimants will receive.

Didn’t like 2 months ago there were saying in 6-8 week. Some people said they told them mid summer?

    • j says:

I’ve been to your facebook. I gotten the same exact email you got.
The thing I don’t understand, it say’s, A motion to approve claims and to authorize distribution was filed on July 10, 2017. This motion is awaiting the Court’s decision.

I thought that once the judge approves it, and all appeals are finished. They automatically pay.

      ADMIN – Hi J,

Class actions of this proportion are far more complex than you can ever imagine.

  122. HS says:

Update from another source: A motion to distribute settlement funds was filed with the court on July 10, 2017. On August 3, 2017, the judge filed an order giving class counsel until August 17, 2017 to submit billing records. Once counsel submits this information, the judge will then take it under review. It is not known how quickly the court will approve the motion to distribute at this time.

  123. Debby says:

I ‘ve received nothing so far but was told back in Feb everything was in order in my claim so I assumed I was go to go and checks should go out this summer Since I’ve heard nothing I sent a message thru facebook to find out I called the toll free number It said checks went out in June I have a copy of my claim

    ADMIN – Hi Debby,

I have no idea who you contacted via Facebook but I doubt it was the class action administrator.

  124. Debby says:

I also want to include I purchased a lot of foam padded furniture, and several sets of mattresses to which I had receipts (paperwork) during the claim period I never received any mail or emails from those over this case or any requests for receipts as proof of purchase or any updates although my email has not changed I have went back thru my emails periodically and can’t find any contacts from anyone

    ADMIN – Hi Debby,

When you filed you had the option to submit proof of purchase. I believe this settlement will be paid up soon.

  125. Debby says:

    Hi
I read online and contacted GCG thru facebook they said are the administrator handling the direct purchaser settlements

  126. j says:

    Just got this today,
Thank you for your inquiry regarding the In re Polyurethane Foam Antitrust Settlement.

There was never a known date for distribution. Any previous information you received were the estimates at that time. As for an update, there is currently no known timeframe for distribution. A motion to approve claims and to authorize distribution was filed on July 10, 2017. This motion is awaiting the Court’s decision. It is not known how long it will take the judge to make a decision. If approved, it will probably take at least one month from the approval date before distribution takes place.

  127. Rickey Johnston says:

I sent my claim in September 2015 and still no check, when will I get my check.

    ADMIN – Hi Rickey,

Please understand that check distribution for settlements has nothing to do with your submission date. Instead, after the deadline passes there is a window for appeals. If the appeals go through and the case is finalized you still have to wait for the admin to validate the claims. Stuff like this takes years and years.

  128. RENEE says:

    Are there any updates?

    ADMIN – Hi Renee,

    None at the moment.

    • Marie says:

Someone posted on top class actions no checks until 2018 .could this be true.

      ADMIN – Hi Marie

      Entirely possible.

  129. Angela Hendrix says:

Hello is there a phone number wanna required about the checks ?

    ADMIN – Hi Angela,

This admin did not publish a number. All contacts must be via email.

  130. John says:

OK, I emailed the class console, he said; Thank you for your inquiry.

The motion for the court to approve distribution was filed on July 10, 2017. Unfortunately, two objectors with minimal economic interest file an objection to the motion. That has now been fully briefed and the Court has the matter under advisement and we are all waiting for the decision. Nothing can happen until the Court rules. Even then, as happened earlier, there is the possibility of appeals from that decision which can cause further delay. We all hope that does not occur as we, as counsel for the Class, want the distribution to happen soon.

The above is the best information available todate.

I don’t know what that means though.

    ADMIN – Hi John,

That means that we are on wait mode.

  131. Crystal says:

Here’s the latest update from the Adminstrator website: IMPORTANT UPDATE
On October 30, 2017, the Court entered the Distribution Order. Payments are expected to be distributed to Eligible Claimants within the next thirty days.

    • sarah says:

The Claims Administrator has received 96,246 Claim Forms representing total purchases of
more than $52 billion (Doc. 2172-1 at ¶ 10). Following extensive investigation and audits, the Claims
Administrator accepted 42,652 claims representing over $22 billion in eligible products, or over $17
billion in Qualifying Claims (id. at ¶ 27; Doc. 2181 at ¶ 7). The Claims Administrator rejected 53,594
claims as ineligible for a variety of reasons (id. at ¶ 29). As of last month, the balance of the
Settlement Fund totaled over $103 million, with an additional $6.25 million yet to be deposited (Doc.
      2182 at ¶ 3).

    • Pat says:

How do we know if we are considered to be an eligible claimant? I mailed my proof of claim on 2/27/2016 and received return notification that my claim was received.

      ADMIN – Hi Pat,

Based on what you are telling us you are likely a class member.

  132. Berths gillus says:

The wait is finally over, checks going out within next 30 days.

  133. Bertha gillus says:

Did anyone else see the latest update, they gave the admin and attorney a bigger piece of the pie!!

    ADMIN – Hi Bertha,

Those lucky attorneys and administrators!! Just remember, without attorneys willing to risk their own money to go after a settlement you will never get any piece of any pie.

  134. Bertha gillus says:

    So true, Thank You

  135. Valerie aviles says:

Does anyone know the percentage of the money were getting???

    ADMIN – Hi Valerie,

I hear you won’t get a ton unless you have a business claim like hotels and such.

    • Jamie says:

ADMIN, does 2 or 3 thousands mean a ton? just wondering!! I would be excited to get a couple of thousands at least……..

      ADMIN – Hi Jamie,

Unless you filed for a ton of furniture don’t expect to get that much.

  136. Bertha says:

Hi everyone, this is what I read. Final distribution meeting will be held Dec 19 2017 At 4:30 pm, so don’t look for anything until after that date. It is on coming.

    Is that right Mr/Ms Administrator

    ADMIN – Hi Bertha,

    Correct!

  137. Bertha says:

My mistake that court document was pertaining to urethane lawsuit

  138. Faith says:

Talked with someone at Miller Law and was told checks will go out on the 20th but she could not tell me how much I would receive.

  139. Tiffany says:

Payment amounts are being verified if you call. Claimants are reporting that they are going to receive .006% of what you actually claimed. That means that if you claimed $3000, your piece of the pie is around $20. Definitely not really worth the wait but I guess that is $20 more than you had!!!

  140. wes gigh says:

These amounts are ridiculous. We get screwed twice. Should be illegal.

  141. Karen says:

Well folks, don’t plan on running to the bank with your settlement check. I got mine today, $19.81, which is $19.81 more than i had, but what happened to the $100.00? Oh well gas money.

  142. Char says:

I got mine today it was $117.77

  143. Pisces Morris says:

My check was made out to Tempur Pedic and I was unable to cash it because that’s not my name obviously.

    ADMIN – Hi Pisces,

Please reach out to the class action administrator and request for your check to be reissued.

  144. Web says:

I just found out that my claim of $2500 was too small to qualify for the settlement. What a bummer, I bought in good faith that the products were ok, they were not, and I still got blown off? How does this happen?????

    ADMIN – Hi Web,

This settlement was not related to quality. It was an antitrust settlement related to price-fixing. The administrator had to make decisions that best addressed those impacted the most. I too filed for less than $2,500 and got nothing.

    • Web says:

Well I don’t feel so bad knowing I am not alone. No additional stocking stuffing for grand-kids I guess, but it is what its is…May you and your family be blessed this holiday season.

  145. Michael Peterson says:

I have about $3400 in claims with receipts so guess I will see nothing either. And not even hear anything from them???? After signing my rights to pursue this matter away to ‘them’ at their beck? If you look around the universe you will see class action lawsuits are a cash cow for a hand full of big law firms who actually concoct many of these. Lawyers are the only ones getting rich – just look at a detailed billing submitted to the court sometime. Wow, wish I could make $2700. an hour plus a huge expense account. They also conspire to keep our medical and drug costs way way high by encouraging stooges to sue (contingency of course) over every little side effect that would otherwise be in normal range. I do know a lawyer that has a yacht down in the Virgin Islands named – you guessed it – “The Class Action”!!!

    ADMIN – Hi Michael,

I encourage you to pursue a career in law. This is a country with limitless opportunities. If you feel others are compensated more you can always strive to achieve the same.

  146. Gail says:

How much were the attorneys paid?

    ADMIN – Hi Gail,

You can see that in the settlement agreement.

  147. joseph w grudzinskas says:

I am waiting together with my brother-in-law for the money of claims we submitted. Our claim goes back to 2016 for carpet 3000, bedding 1700, & furniture 1050 dollars. Please contact me as it is the products that must be compensated for: Joseph Grudzinskas

Please contact the Settlement Administrator directly, if you haven’t already done so. The details are stated above; just scroll up. Thank you, and best of luck.

  148. Lynne Razo says:

I submitted a claim on 9/14/15 and contacted your firm at 866-302-7323 to update a new address. I have never heard from you since and cannot get any updates on the status of my claim.

    • Angelica (Admin) says:

Hi, Lynne. Sorry, but there’s been a misunderstanding. Please note that we (classactionrebates.com) are *not* the Settlement Administrator of this case.
