Class Eligibility

Class Members of the Pure Via Sweetener class action settlement include all natural persons who purchased (for household use or personal consumption) Pure Via products in the United States between Jan. 1, 2008 and Oct. 6, 2014.

Eligible Pure Via products include any Pure Via sweetener in a packet, spoonable jar, liquid, and baking blend forms of any size or quantity.

Case Summary

According to the plaintiffs Pure Via Sweetener manufacturer Whole Earth Sweetener Company LLC and Merisant Company misled consumers in their marketing and labeling of Pure Via by including statements indicating that the product was “all natural” when in fact it contained numerous highly processed ingredients. Whole earth Sweetener Company LLC and Merisant Company deny the allegations and stand by their marketing practices and labeling; but have agreed to settle to avoid the uncertainty and costs associated with litigation
