Class Eligibility

You may be a member of the settlement if you purchased, for personal use and not for resale: (1) Roundup® Ready-to-Use Weed & Grass Killer 3; (2) Roundup® Ready-to-Use Weed & Grass Killer Plus; (3) Roundup® Weed & Grass Killer Concentrate Plus; or (4) Roundup® Weed & Grass Killer Super Concentrate, packaged with a label containing the statement, “targets an enzyme found in plants but not in people or pets,” or an essentially similar statement, within the Class Period determined for each State, as is detailed here.

Between $0.37 to $10.63 per household (NOTE: there may be reductions with pro-rated distribution if Claims exceed the Common Fund allocations for Class Members)

Conditions:
(1) Class members may submit claims for refunds equivalent to around 10% of their weighted average retail price (after rounding) during the relevant class period.
(2) Without Proof of Purchase: Claims are limited to 1 unit/household/year within the Class Period (except for the Roundup® Weed & Grass Killer Super Concentrate product, for which claims are limited to 1 unit per 2 years).
(3) With Proof of Purchase: Claims for refund can exceed the unit per household per year.

Case Summary

Monsanto Company is accused of having made false advertisements and misleading claims about certain Roundup® – Weed & Grass Killer products, as well as breach of warranty and unjust enrichment.
While the Defendant, Monsanto, denies any wrongdoing and the Plaintiff’s allegations, it has agreed to the settlement to avoid further time and expense on litigation.

“These limits may be exceeded by claimants that can produce actual proof of purchase. If claims exceed the amount left in the Common Fund after all other expenses are deducted, the amount refunded will be reduced pro rata. If funds remain in the Common Fund after all claims and expenses have been paid, any remaining amounts will be donated to one or more Court-approved organizations (‘cy pres distributions’).”
