Case Summary

The lawsuit claims that Sam’s Club at times did not fully honor the Freshness Guarantee with respect to certain fresh products purchased at Sam’s Clubs within the United States. Sam’s Club denies any and all liability or wrongdoing with respect to the claims alleged in the lawsuit, but desires to settle the case because a settlement will avoid the risk, expense and distraction of continued litigation.

    You can only be a member of the class action if you returned the items however I just kept the stale cakes cause they were cut into and did not think the store would take them back once cut into. So according to the criteria on the claim form if I answer no to returning items I cannot join.

    I always return stuff when it is stale even if I already opened the package and tasted the product. There is no other way of knowing if the product is stale.
