Sharp Microwave Drawer Oven Class Action Settlement

Class Eligibility

You may be a member of the settlement if you are a U.S. resident who either: (1) was the first person that purchased or received a Sharp Microwave Drawer Oven for your personal use; or (2) was the first person to own a residential real property after a Sharp Microwave Drawer Oven was installed in it for the owner to use; with either scenario happening between January 1, 2009 and August 5, 2020.

You are EXCLUDED FROM THIS SETTLEMENT IF you are: (a) an officer, a director, or an employee of Sharp or its parents, affiliates, or subsidiaries; (b) an insurer of Class Members; (c) another entity claiming to be a subrogee of a Class Member, or another entity claiming subrogation to the rights of the owner of a Sharp Microwave Drawer Oven; (d) a secondary owner of a Sharp Microwave Drawer Oven, including, without limitation, a purchaser of a used Sharp Microwave Drawer Oven, purchaser of real property containing a used Sharp Microwave Drawer Oven, or any other owner of a Sharp Microwave Drawer Oven who was not the first person to purchase or receive said new Class Microwave; (e) a third-party issuer or provider of extended warranties or service contracts; (f) anyone who has previously released your claims against Sharp; (g) any personnel of the Court overseeing this proposed settlement, and any such personnel’s immediate family member; (h) any personnel of the Settlement Administrator, and any such administrator’s immediate family member; and (i) someone who has validly exercised your right to be removed from this Settlement Class in a timely manner.

Estimated Benefits

1) Limited Extended Warranty for the Arcing Event (with all other parts of the microwave keeping their original warranties);
2) Labor costs reimbursement of up to $150, for microwave inspections & repairs only if related to an Arcing Event (with Receipt from the repair technician as proof);
3)***Labor costs reimbursement of up to $200 for adjacent cabinetry repairs only (with Receipt of cabinetry repair as proof — ***and this reward may only be availed IF the Class Member OPTS OUT of receiving a replacement Microwave Oven, as stated in Option A below);
and
4) ONLY ONE of the following benefit options:
(a)*** Replacement Microwave Drawer Oven***, or
(b) $250 cash payment, or
(c) $500 voucher for any Sharp-branded product.

Case Summary

Sharp Electronics Corporation (“Sharp”) is accused of manufacturing their Microwave Drawer Ovens with a design defect, causing their premature failure due to electrical sparking (or “arcing”) within one of the parts known as the waveguide, found at the top of the microwave, and which may extend to the magnetron. This lawsuit also claims that Sharp also violated warranties and other manufacture and sale obligations of said microwave oven. Sharp denies such claims and agreed to this Settlement to avoid trial costs and risks.

Deadlines

1. If your five-year Limited Extended Warranty expires after January 7, 2021, you have until two years after the occurrence of a Documented Arcing Event for which relief is being sought to submit your claim.
2. If your five-year Limited Extended Warranty expires prior to or on January 7, 2021, you have until May 7, 2021 to submit a claim for a Documented Arcing Event.
