Class Eligibility

The settlement includes all natural persons residing in the United States (including all territories and other political subdivisions of the United States) who:

  • Received, in connection with the purchase or lease of a new or used vehicle, programming on a promotional basis from Sirius XM that ended no later than Apr. 5, 2016
  • Were the recipients of one or more telephone calls made by or on behalf of Sirius XM to their wireless, cell or mobile phone numbers after Feb. 15, 2008 and before July 5, 2016
  • Never were or became paying subscribers prior to July 5, 2016

Excluded from the Class are any employees, officers, or directors of Sirius XM, and any attorneys appearing in this case, and any judge assigned to hear this case as well as their immediate family and staff.

            I can give a good reason… I cashed my $81.41 check and had it returned by my bank along with a $15 fee. My bank says Huntington National Bank, the settlement adminstrator’s bank, rejected it. I called them, ended up on long holds and transfers, and finally was told the bank was not going to do anything — either about the possibility that they made a mistake or that the check is fraudulent. I’m astounded. Only got a recording at the settlement administrator. So I not only didn’t get the payment, I’m out $15 (so far), time and money visiting my bank, and about 2 hours of wasted time on the phone (so far).

    I took part in a class action lawsuit against ATT by postcard. This is no lie.Though I was told that I would receive $500 per call, I expected, maybe a grand. When I opened the envelope from FedEX, I nearly passed out. It was a check for $55,000! I deposited the check immediately.
    Funny thing about it was the calls were made to my ex-girlfriend’s phone that was on my account. We got back together after a few months. I didn’t tell her about the money until after we resumed our relationship.

    I got the three month service. I had to mail my confirmation emails to the p.o box address. But the catch is you only receive 100 of 200 or more channels. I called Sirius. They stated that it was the “free service” package and it do not include certain channels. This is bull crappeth, of course. I will look further into this and keep posted.

    Yes, I am another person waiting for my refund check since September 2016. Like others say, nobody to talk with on the phone number given, and the email addy, you get a “failure domain” notice and your email returned. So there is no possible way to follow up on this.

      Yes, I called the number and it was only a recorded call-gated system.
      However, today I received an Expiration Notice of my free 3-month trial (which I never signed up for) so I contacted Sirius. They said they do not know who signed me up for this (it was signed up for on 5/22/2017) but went ahead and cancelled the trial. I told her that I filed a claim for the rebate and never wanted a free trial.
      Furthermore when I got the notice, I wanted to see if the trial was in fact in place on my radio, and it’s not. It’s just the recorded sales pitch to sign up for the service. So, I’m not even receiving the trial anyway.
      I’m concerned that now it looks like I signed up for the free trial and won’t receive a rebate check.
      Thoughts on what I need to do next?

    I’m not sure how the others feel on this thread, but it almost feels like we have been duped on the free service option. Per the settlement for free service: ‘The free service will not be available for any vehicle that has a currently active paid subscription associated with it as determined Sirius XM. Any class member who converts to a paid subscription between registration and shortly prior to the date on which cash will be distributed to class members who has filed online for claim forms will be converted to the cash payment option instead. Amy member who converts to a paid subscription after the cash distribution date, but prior to the commencement of free service, will have the opportunity to ask to receive the free service in their subscription.’ In short: since cash hasn’t been distributed yet, don’t sign up for an active sirusxm service otherwise you lose your free service. 🙁

    Kathy from the law offices just called back and she said payments should be received within the next couple of months since the appeal is over. As far as the 3-month free service, if you have not received it yet, she had offered to help y’all out if you give them a call. You’ll need to provide your name, vehicle VIN and your radio ID if you are currently utilizing Sirius services. Their phone number is 713-751-0400. I hope this helps and clears up some confusion.

    The settlement website ( reads that payments will be dispersed out sometime in November 2017 NOW that a settlement had finally been reached and approved.
    It is only the 11th of the month, so I’m sure those of us that opted for cash payment will be receiving any day.

    Was award 3 months of Sirius radio around dates of 8/24/17-11/30/17 worked for about 3-5 days never worked again stated I need to call to sign up for membership called about 2x and they said they could renew subscription. Tried calling 888-509-2570 but no live person to speak with. plus now it states its to late to ask of money. Worst company and service for those 3-5 days weren’t that great seemed like I have to much static.

    My husband name and my name was on the vehicle (I was the co-signer). Check came in my husband’s name. He has passed away. Would their be a way to receive check with both of our names on it?

    I believe you can deposit a check if you are the rightful owner of the estate by showing his death certificate and other supporting information to the bank. As an alternative you can call the class action administrator and request for the check to be reissued. You will have to provide his death certificate as well as any will or probate document that shows you as the person entitled to his estate.

    Got my check but I’m afraid to deposit it. I don’t want my information stolen and sold to another third party and then more robocalls and fraud. $81 isn’t worth having my identity stolen, should have been more.
    On another note, I wish somebody would do something about these damn car warranty scammers. They call non-stop even after I tell them to stop. And I don’t even own the vehicle they’re calling about anymore! I’ve told them this but they just keep calling. They normally call from a number that’s my homestate according to the area code but when I’ve asked they’re in another state and just spoofing the number. I don’t even live in that state anymore anyhow. Interstate telemarketing calls are illegal I’m pretty sure and they’re breaking the law. I feel harassed and they won’t stop.

    Received check a couple days ago. It looks fake. I can faintly see void at top (security function for copying but I usually don’t see it that well) and it specifies not to cash anywhere but a bank? I am afraid to deposit it in case it is a scam

    There should be another check coming in the future for unclaimed money in the escrow account. Here is how the settlement reads (yes, I read all 96 pages), “Provided that the costs of so doing would not result in the distribution to Class Members of a de minimis amount, the Escrow Agent shall then make a Second Cash Distribution in equal shares of the then-remaining amount in the Escrow Account to all Class Members who cashed their check from the Initial Cash Distribution.”

    Class Action Administrators are audited by courts to make sure that they are doing their job. If you did not escalate about your missing check in a timely manner the funds became part of the second distribution.

    Went to my bank about week later and deposited it. Approximately two weeks later, receive a letter from my bank,
    Bank of America informing me the check is UNPAID, RETURNED AND THEY CHARGED ME $12.00 RETURN FEE ON THE CHECK.

    CALLED 6 different numbers for SIRIUS, NO ONE CAN HELP.

    So…I too just had my check returned and was charged a $12.00 fee from my bank. Same story as others, I tried the 888 number and no human answers. I’m starting to think this entire settlement is a scam and will contact my state AG about it.
