Ski Free® Voucher by Shell Class Action Settlement

Class Eligibility

The Settlement includes all persons who, in the states of California, Michigan, Oregon or Washington, between November 1, 2009 and the date that the Court enters the Order Granting Final Approval, purchased ten or more gallons of fuel at a Shell-branded station that offered the Ski Free® promotion, and received a Ski Free® voucher at the time the purchase was made.
More specifically, the Settlement includes four Settlement Classes:

  • The California Class: All persons in the state of California who (a) between November 1, 2009 and the date that the Court enters the Order Granting Final Approvalpurchased ten or more gallons of fuel at a Shell-branded station that offered the Ski Free promotion, and (b) in connection with such purchase, obtained from that Shell station that participated in the Ski Free program a Ski Free® voucher.
  • The Michigan Class: All persons in the state of Michigan who (a) between November 1, 2009 and the date that the Court enters the Order Granting Final Approvalpurchased ten or more gallons of fuel at a Shell-branded station that offered the Ski Free promotion, and (b) in connection with such purchase, obtained from that Shell station that participated in the Ski Free program a Ski Free® voucher.
  • The Oregon Class: All persons in the state of Oregon who (a) between November 1, 2009 and the date that the Court enters the Order Granting Final Approvalpurchased ten or more gallons of fuel at a Shell-branded station that offered the Ski Free promotion, and (b) in connection with such purchase, obtained from that Shell station that participated in the Ski Free® program a Ski Free® voucher.
  • The Washington Class: All persons in the state of Washington who (a) between November 1, 2009 and the date that the Court enters the Order Granting Final Approvalpurchased ten or more gallons of fuel at a Shell-branded station that offered the Ski Free promotion, and (b) in connection with such purchase, obtained from that Shell station that participated in the Ski Free program a Ski Free® voucher.

Case Summary

The Lawsuit is about the Ski Free® promotion offered at participating Shell-branded fuel stations throughout the states of California, Michigan, Oregon and Washington. The Ski Free® promotion, as advertised, provided purchasers of ten gallons of fuel with a voucher for a “free” ski resort lift ticket. Plaintiffs claim that the Ski Free® vouchers did not entitle them to a free lift ticket. Instead, the vouchers were a “buy one get one free” offer that required the purchase of a full-priced lift ticket in order to receive a free one. Plaintiffs also claim that the vouchers contained a variety of date, time, resort, and other limitations, and that the Defendant’s advertising of the Ski Free® promotion violated various state consumer protection laws and other state statutes and gave rise to common law causes of action for breach of contract.

The Defendant denies all of the allegations made in the Lawsuit.
