Case Summary

In a class action, one or more people called Class Representatives (here, Plaintiffs Jason Alan and Shane Flaum) sue on behalf of people who allegedly have similar claims. This group is called a class and the persons included are called class members. One court resolves the issues for all of the class members, except for those who exclude themselves from the class. Here, Plaintiffs alleges that Doctor’s Associates willfully violated FACTA by printing point-of-sale receipts for credit card and debit card transactions at its Subway restaurants that displayed the expiration date of the credit or debit card number. Doctor’s Associates denies these allegations and denies any wrongdoing. The Court has conditionally certified a class action for settlement purposes only. The Honorable Cecilia M. Altonaga is the judge in charge of the lawsuit.

      Ticked. I don’t keep subway receipts either, I also got rid of my debit card due to theft in a large city by some grub hub app. Took me a week to get it corrected with Simmons Bank, even though I knew about false charges through paypal and my email before even hit bank. No I don’t have receipts or last four digits because I got rid of debit card due to Simmons Bank couldn’t handle in timely manner. Now I just go to bank and take out cash. However Subway owes me and im sure they have a list THEY can look on. I guess myself and my husband need to stop eating at subway if they can’t compensate me.

    I received the claim postcard. I remember buying food at subway during that time but I don’t keep 2 years old food receipts guys. Is the receipt needed???

    Hi guys, i received the postcare, i have made multiple purchases in subway during the specified time frame, however i do not have the physical receipts, but only credit card transactions. Will that be enough to claim?

    I go to Subway a lot, Subway is my go to sandwich shop, and I have used my debit card and credit card over the years, but I have never kept the receipts. will I be able to file a claim without the receipts? this worries me because I have never notices.

    I have receipts from subway where I used my debit/credit card within the date range. The last four digits are displayed but not the expiration date. Can I still submit?

    What state does this apply? Is it nationwide? I have 3 purchases made at subway during the time frame listed at stores in the Florida area. I dont have receipts but have my bank statements.

    I completed online form however only allowed one space for date and one space for credit card I went to Subway often about 50 times and used different credit cards. I gave my receipts back because I did survey to get a free cookie so I don’t have receipts.

    Wow, guess they want you to get Bank statements showing the debit transactions @Subway some people eat Subway for lunch @least twice a week know I did. Unfair by failing to set basic claims amounts, seriously who keeps their lunch receipts for 1yr 2 months & 23 days this class action lawsuit is a complete Fraud & farce!!😒

    If you received a notice file your claim. This is based on the fact that they printed more than the legally allowed credit card #s on the receipts they issued.

    I received two postcards – both with my exact name and address, and with consecutive claim numbers (one digit apart). I wouldn’t think that I should file two claims, but why would I get two postcards?

    I think this question might have already been asked, but I also got two postcards with two completely different claim numbers. Does it matter which one I use? I’m guessing I probably shouldn’t file both.

    Please only file one. Often claims get dismissed as duplicates when you submit both cards even if it was their mistake to send you two.
