Taconic Employee W-2 Data Breach Class Action Settlement

Class Eligibility

You may be a member of the settlement if you are a current or former Taconic employee whose W-2 data (or personally identifying information, e.g., name, address, or Social Security number) was exposed in a data breach that occurred around January 30, 2017.

Estimated Amount

Up to $3,000, depending on time spent & costs incurred.

Claim A: Class Members who suffered a fraudulent tax return filed after January 30, 2017 will be eligible for a $150 payment per tax return year.

Claim B: Class Members who suffered identity theft after the data breach may claim $100 per incident, plus out-of-pocket expenses outlined under Claim E.

Claim C: Class Members who qualify for payment from Claim A or Claim B and spent at least one hour working out the tax fraud or other identity theft incident can submit a claim for time lost dealing with the consequences of the data breach, and they may be reimbursed $25/hour, for a maximum of 10 hours.

Claim D: Class Members who are not qualified for payment under Claim A or Claim B and spent at least one hour working out the results of the data breach can file a claim at $25/hour, for up to 3 hours of their time.

Claim E: Class Members who can prove out-of-pocket financial losses linked to the data breach via documentation may claim reimbursement for those losses up to $3,000.

“Before submitting a claim for reimbursement of expenses in Category E as described above, Settlement Class Members who previously enrolled in Experian’s ProtectMyID service offered by Taconic must attest to have first submitted their claim to Experian and have that claim denied or exhausted.”

Proof of Right to Claim

Yes. All Class Members seeking cash reimbursement must submit a Claim Form. They have to provide documentation and/or a self-verifying statement about time spent dealing with the data breach.
