Toys R Us Class Action Settlement

Class Eligibility:

The settlement covers anyone that used a credit card or debit card at Toys R Us between 12/4/2006 or 1/5/2007.

Estimated Amount:

The settlement provides as follows depending on the number of purchases you made and whether you have proof of purchase (credit card statements or receipts).

  • Tier A – Two $15 vouchers (if you made 3 or more purchases and have documentation)
  • Tier B – One $15 voucher (if you made 1 or 2 purchases and have documentation)
  • Tier C – One $5 voucher (if you made 1 or more purchases, but do not have documentation)
Proof of Purchase:

NOT required for the basic lower tier $5 voucher claim. The two higher tiers of vouchers ($15 and $30) documentation (receipts or credit card statements) are required.

Case Summary:

Toys R Us is alleged to have violated the Fair and Accurate Credit Transactions Act (FACTA) by printing more than 5 digits of your credit/debit card on receipts between 4/12/2006 and 1/5/2007. Toys R Us denies the allegation, and we think with merit argued that even if it violated the law nobody was hurt by their mistake.

The parties settled the case before it went to trial and was decided before a court.

This settlement’s requirement for the top two tiers of payment to provide receipts from 2006 is beyond ridiculous. We are also unimpressed by the requirements to mail a paper form rather than an electronic form.
