Class Eligibility

All persons and entities who purchased at least one flight segment between the United States and Asia, Australia, New Zealand, or the Pacific Islands from the defendants or their co-conspirators, predecessor, subsidiary or affiliate any time from Jan. 1, 2000 and the effective date of the settlement, which is the date when the court has entered judgement and time for appeal has expired.

For the Japan Airlines settlement class, flights originating in the United States and Asia/Oceania will apply. For the other settlement classes, only flights originating in the United States apply.

The Defendants and their co-conspirators are:

  • Air New Zealand (Non-Settling Defendant);
  • All Nippon Airways Company, Limited (Non-Settling Defendant);
  • American Airlines, Inc. (Alleged Co-Conspirator);
  • Asiana Airlines, Inc. (Alleged Co-Conspirator);

Japan Airlines Settlement Class

All persons and entities that purchased passenger air transportation that included at least one flight segment between the United States and Asia or Oceania from Defendants, or any predecessor, subsidiary, or affiliate thereof, at any time between January 1, 2000 and the Effective Date.

Air France, Singapore & Vietnam Airlines

All persons and entities that purchased passenger air transportation that included at least one flight segment between the United States and Asia or Oceania from Defendants or their co-conspirators, or any predecessor, subsidiary or affiliate thereof, at any time between January 1, 2000 and the Effective Date.

Thai Airways

All persons and entities that purchased passengerair transportation that included at least one flight segment between the UnitedStates and Asia or Oceania from Defendants, or any predecessor, subsidiary oraffiliate thereof, at any time between January 1, 2000 and the Effective Date.

MalaysianAir

All persons and entities that purchased passengerair transportation that included at least one flight segment between the UnitedStates and Asia/Oceania from Defendants or their co-conspirators, or anypredecessor, subsidiary or affiliate thereof, at any time between January 1,2000 and the Effective Date.

Cathay Pacific & Qantas

All persons and entities that purchased passenger air transportation that included at least one flight segment between the United States and Asia or Oceania from Defendants, or any predecessor, subsidiary or affiliate thereof, at any time between January 1, 2000 and the Effective Date.

Case Summary

According to the documents of this settlement multiple airlines conspired to impose “airfair increases, including surcharge increases, on international air passengers that were in substantial lockstep both in timing and amount.” In making this move the airlines violated antitrust laws.

The airlines involved in the price-fixing class action lawsuit were charged with violating the The Sherman Act, which includes the federal antitrust laws.

The airlines deny the allegations but have agreed to settle to avoid the cost and uncertainty associated with a long trial

    Do you think stamps on our passports will be sufficient for proof of purchase? In the early 2000’s, most of my tickets were purchased from travel agents and I don’t have a copy of the receipts anymore.

    Is Israel considered in Asia?

    Geographically speaking, Israel is part of Asia. For this class action I don’t believe it is included since the airlines listed seldom have routes that begin or end in the United States and end in Israel via Transpacific. Most flight routes to Israel are Transatlantic regardless of the origination point within the Continental U.S.

    Even if the name of the settlement includes the word “transpacific” it appears the terms of the settlement include your flight. Please check with the class action admin directly but, from what I read you should submit a claim.

    I’m a little confused by the effective date, would travel between NZ and the USA in April of 2015 be claimable?

    Per the website *The Effective Date is the date all of the following conditions have been met: (a) the Court has entered Judgment; and (b) the time for appeal has expired, or if an appeal occurs, the Judgment has been affirmed and no further appeals are possible.

    As of today some of these conditions have not being met.

    March of 2012 my husband and I flew Quantas Air from Los Angeles, Calif to Melbourne, Australia. We tried to upgrade to Business class because of my husbands disabilities. The price quoted was more than half the price we paid for Economy. Do we qualify?

    You don’t qualify. This settlement is for all persons and entities who purchased at least one flight segment between the United States and Asia, Australia, New Zealand, or the Pacific Islands. France is not in Asia, Australia, New Zealand or the Pacific Islands.

    Another appeal was held july 10, 2017. I am awaiting the download to get update. It was an en banc hearing. If the appeal is denied there may be two or more hearings to get final numbers won’t say anything promising for six months give or take.
