Case No. 01-15-0002-7497
Arbitrated by The American Arbitration Association

Case Summary

Claimant Robert Stone filed his claim with the American Arbitration Association on February 26, 2015. Claimant asserts claims against Universal Protection for: (1) failure to pay minimum and overtime wages for all hours worked; (2) meal period violations; (3) rest period violations; (4) waiting time penalties; (5) failure to reimburse for necessary business expenses; (6) wage statement and record keeping violations; (7) unfair business practices; and (8) penalties pursuant to the Private Attorneys General Act (“PAGA”). Claimant seeks recovery of unpaid wages, restitution, injunctive relief and penalties. Claimant also seeks an award of attorneys’ fees, interest, and costs.

Universal Protection denies all allegations and all wrongdoing, and maintains that it has paid its non-exempt security professional in compliance with applicable laws. Universal Protection notes that this Settlement was established specifically to avoid the cost of proceeding with litigation and does not constitute an admission of liability. Neither the Arbitrator nor a court have ruled on the merits of the claims.

    From Ilym Group:

    Dear Class Member,

Yes, Final Hearing was on March 22, 2018.

The arbitrator approved the settlement, we still need both parties to receive conformation from the court before funding and disbursements can occur.

Once the parties receive confirmation from the court, settlement checks will be going out about three months from confirmation date.

  8. Wendol V Brooks says:

    Good Afternoon.

This is Wendol Brooks, and I am a part of the class action lawsuit. I read the response dated April 19, 2018. It has been approximately one month now and was inquiring if the parties involved received confirmation from the court for disbursement.

Can you confirm whether this has been received or not and if so, when can I expect receipt of payment? Thank you for your assistance.

    ADMIN – Hi Wendol,

I hear they are scheduled to process these payments soon.

  9. Whitney says:

The defendant is not tasked with managing the timeline of distribution.

Hearing was in March we going into June and still waiting on the Final Confirmation Order from the Court? Really takes that long?

      ADMIN – Hi Juan,

Some settlements will remain under appeals for years. So yes, it does take that long.

  14. Amy says:

Hello, I’ve read everyone’s post in regards to the final hearing being approved by the arbitrator, some comments and concerns were about receiving our checks. I see back on April 21st (Admin) you replied with “I hear they are scheduled to process these payments soon.” Now I’m seeing a recent comment was made on the 30th of May by (Admin) Some settlements will remain under appeals for years. So yes, it does take that long. So what exactly is correct information? I understand settlements can take time and (Admin) your just passing info to us BUT what exactly is true here? I’ve also heard that they were going to start issuing checks sometime in June or July?

    ADMIN – Hi Amy,

Even if the arbitrator has achieved a final resolution it can be a while before the court sends the order. A couple of community members spoke to the administrator who said maybe June or July but there are no guarantees or obligation to stick to any particular date.

  15. Pjones says:

    Where is the money?

    ADMIN – Hi Mr. Jones,

  18. Juan Lopez says:

About to be 3 months and still no update besides they are waiting for final confirmation? I’m starting to think these checks are never going to be mailed.

    ADMIN – Hi Juan,

Most settlements are eventually paid out.

    • Childplease says:

ADMIN – FUNNY MOST SETTLEMENTS are eventually paid out !!!! Like who the lawyers and you ADMIN!!!! WHILE EVERYBODY HAS TO WAIT FOR THERE MONEY..WHO Deserve it and work for it….

      ADMIN – Hi Mr. Thomas,

I don’t get paid a penny. I do this for fun.

  19. Walter Hochrein says:

Show me the money! Momma needs new shoes and daddy needs guitar strings!
No seriously, these things take time folks! What the admin said was correct. This could be hung for alooooong time! We’re talking $30 Million dollars folks. Guilty or not $30 Million just doesn’t change hands that quickly. If the shoe were on the other foot, would you want your $ to be paid out that quickly or would you exercise all your rights to keep from paying one thin dime out until it’s benefited the loser before it’s left their bank or the insurance companies vault of cash.
I’m not holding my breath or quitting my day job either way!
