Case No. 01-15-0002-7497
Arbitrated by The American Arbitration Association

Case Summary

Claimant Robert Stone filed his claim with the American Arbitration Association on February 26, 2015. Claimant asserts claims against Universal Protection for: (1) failure to pay minimum and overtime wages for all hours worked; (2) meal period violations; (3) rest period violations; (4) waiting time penalties; (5) failure to reimburse for necessary business expenses; (6) wage statement and record keeping violations; (7) unfair business practices; and (8) penalties pursuant to the Private Attorneys General Act (“PAGA”). Claimant seeks recovery of unpaid wages, restitution, injunctive relief and penalties. Claimant also seeks an award of attorneys’ fees, interest, and costs.

  6. Daniel J Norvell says:

    Good morning ADMIN,
My name is Daniel Norvell and like others that send there forms in, I too have not heard as to the outcome other than what I read online. I would like to know when the payments will be made and mailed out, as well the amount if other than what is stated on my paperwork.
    Thank you,
    Daniel Norvell

    ADMIN – Hi Daniel,

To get information on a claim you have to reach out to the actual class action administrator and not to me. I am simply the admin to this website.

  7. Ronda McCollum says:

    From Ilym Group:

    Dear Class Member,

Yes, Final Hearing was on March 22, 2018.

The arbitrator approved the settlement, we still need both parties to receive conformation from the court before funding and disbursements can occur.

Once the parties receive confirmation from the court, settlement checks will be going out about three months from confirmation date.

  8. Wendol V Brooks says:

    Good Afternoon.

This is Wendol Brooks, and I am a part of the class action lawsuit. I read the response dated April 19, 2018. It has been approximately one month now and was inquiring if the parties involved received confirmation from the court for disbursement.

Can you confirm whether this has been received or not and if so, when can I expect receipt of payment? Thank you for your assistance.

    ADMIN – Hi Wendol,

I hear they are scheduled to process these payments soon.

  9. Whitney says:

Any new updates on the confirmation from the courts?

    ADMIN – Hi Whitney,

    None at the moment.

  10. RUEBEN E VEGA says:

Anything new today I’m waiting as well??

    ADMIN – Hi Rueben,

    Nothing.

  11. Eric says:

I mean so what are we waiting for here. They did us wrong and that’s why they got this lawsuit and they continue to prove what type of sleezy company they are.

    ADMIN – Hi Eric,

The defendant is not tasked with managing the timeline of distribution.

  12. Cassandra Duenas says:

    ADMIN – Hi Cassandra,

  13. Juan Lopez says:

any updates on when the checks will be mailed?

    ADMIN – Hi Juan,

I have not seen any new updates.

    • Juan Lopez says:

Hearing was in March we going into June and still waiting on the Final Confirmation Order from the Court? Really takes that long?

      ADMIN – Hi Juan,

Some settlements will remain under appeals for years. So yes, it does take that long.

  14. Amy says:

Hello, I’ve read everyone’s post in regards to the final hearing being approved by the arbitrator, some comments and concerns were about receiving our checks. I see back on April 21st (Admin) you replied with “I hear they are scheduled to process these payments soon.” Now I’m seeing a recent comment was made on the 30th of May by (Admin) Some settlements will remain under appeals for years. So yes, it does take that long. So what exactly is correct information? I understand settlements can take time and (Admin) your just passing info to us BUT what exactly is true here? I’ve also heard that they were going to start issuing checks sometime in June or July?

    ADMIN – Hi Amy,

Even if the arbitrator has achieved a final resolution it can be a while before the court sends the order. A couple of community members spoke to the administrator who said maybe June or July but there are no guarantees or obligation to stick to any particular date.

  15. Pjones says:

    Where is the money?

    ADMIN – Hi Mr. Jones,

The Arbitrator has approved this settlement and at this time the Parties are waiting to receive the Final Confirmation Order from the Court. Once we receive this Order, we will be able to schedule a date for the mailing of the settlement payments. Please check back periodically for case updates and the payment mail date.

  16. M. H says:

Hello i think you all moved to fast putting out the outcome you should have just waited tell checks were going out ( nice job )

  17. Edith Matthews Jones says:

Good Day, I am checking to see if any updated can please be provided. Today date June 18th. 2018 Please reply, Thank you☺

    ADMIN – Hi Edith,

This is the last update from the administrator

    SETTLEMENT UPDATE:
The Arbitrator has approved this settlement and at this time the Parties are waiting to receive the Final Confirmation Order from the Court. Once we receive this Order, we will be able to schedule a date for the mailing of the settlement payments. Please check back periodically for case updates and the payment mail date.

  18. Juan Lopez says:

About to be 3 months and still no update besides they are waiting for final confirmation? I’m starting to think these checks are never going to be mailed.

    ADMIN – Hi Juan,

Most settlements are eventually paid out.

    • Childplease says:

ADMIN – FUNNY MOST SETTLEMENTS are eventually paid out !!!! Like who the lawyers and you ADMIN!!!! WHILE EVERYBODY HAS TO WAIT FOR THERE MONEY..WHO Deserve it and work for it….

      ADMIN – Hi Mr. Thomas,

I don’t get paid a penny. I do this for fun.

    • theresa says:

Admin I think don’t have a clue and they just keep giving half answers because they don’t want to give definite answers to anything. Yes, the settlement amount is huge but it does not take that long, they just wire transfer the money more than likely. Can you give us a ball park figure as to when we will see checks mailed out? Or are you going to keep giving generic answers so that way no one can

      ADMIN – Hi Theresa,

We are not associated to the class action administrator therefore we don’t have insider info. You could try contacting class counsel
      Attorney Heather Davis – PartnerContact:heather@protectionlawgroup.com(844) 294-3095 Ext. 103

  19. Walter Hochrein says:

Show me the money! Momma needs new shoes and daddy needs guitar strings!
No seriously, these things take time folks! What the admin said was correct. This could be hung for alooooong time! We’re talking $30 Million dollars folks. Guilty or not $30 Million just doesn’t change hands that quickly. If the shoe were on the other foot, would you want your $ to be paid out that quickly or would you exercise all your rights to keep from paying one thin dime out until it’s benefited the loser before it’s left their bank or the insurance companies vault of cash.
I’m not holding my breath or quitting my day job either way!

  20. Ms_vampirity says:

Has anyone received a letter, Money or Update?
    Please keep us informed.

  21. Ronda McCollum says:

Response I received from the Ilym Grp….

    Dear Class Member,

  22. Marietta Manuel says:

April 2018 an ex-Universal Protection employee with less time than I, received a $500 check. What is the delay? It is now July 19, 2018.

    ADMIN -Hi Marietta,

Have you contacted the class action administrator to ask the specifics about your claim?

  23. Juan Lopez says:

I called them earlier today. They have an update. Court has sent final confirmation and they will mail out checks now. Funny part is she told me to expect checks towards the end of October lol.

    ADMIN – Hi Juan,

So they are mailing the checks now but you should expect them in October????

    • Juan Lopez says:

Her words where We received confirmation and are going to start processing the checks. She said expect the checks sometime towards the end of October.

    • Childplease says:

The administration is full out it …its stated 14 days after the July 20 …not some time in Oct b.s

  24. Mike says:

Link to Final Confirmation Document on their web site https://upssettlement.com/important-documents/ it is the one titled order confirming arbitration award and final judgement. it says they have 14 business days after funding to issue checks.

    • Childplease says:

Yep…I don’t know y they keep saying in October you will receive the money !!!! 14 day after July 20…they on some b.s talking about the end of Oct

  25. Laurice says:

I just saw on the BBB website the Ilym Group got a F.

  26. Mike says:

To Clarify the documentation says they have 15 Calendar days to fund the account after final confirmation , and then 14 more Calendar days after funding to issue payments. Even with that being said the end of October seems a little Tardy.

    ADMIN – Hi Mike,

    It sure does.

  27. Nita says:

Ok it’s been 14 days so what’s up with our checks ?

    ADMIN – Hi Nita,

    • Rachelle Hodge says:

They did in the 17th. And I heard we are all in for a disappointment. The amount given to us in the letters was a lie. It’s not even going to be half of that. 1 lady expected 1,000 and received 47.00.

    • Lisa Maddison says:

Hi I called them and they said they mailed the checks out on oct 17. Anyway this guy on another board said he received his settlement check yesterday. It came from Kentucky. He worked for Universal Protection Service for 4 years and the check was in the amount of 42.00. I’m like are you serious? So needless to say, I am upset.

      ADMIN – Hi Lisa,

There was a check from Monitronics that went out for $42 are you sure this guy is reporting the right check

    • Kristen Price says:

Hi what is a number l can call to find out about the checks

      ADMIN – Hi Kristen,

  38. Lisa M says:

I read on another board that this guy received his settlement check yesterday. The check came from Kentucky. And he worked for Universal Protection Service for 4 years and his check was in the amount of $42.00. He could not believe it.

    • Not Thrilled says:

      Hey Lisa M.

That is really terrible if that is true. I know everyone was sent a letter in the mail back in dec or Jan of an estimate of what you would receive. I sure hope that it is not true because boy! This company will go down.

  39. Amy says:

Has anyone received there check yet? Im still waiting and I live in LA county.

    • Catt says:

Yes some one got a check for $900 today 10/23/18

      • Lisa Maddison says:

Somebody today said they received their check for 50k and they only worked for the company for 4 months. I call bs on that.

      • Allied says:

Hey Catt, are you in southern california?? The ones who received the checks for such a crappy amount i believe that is from a settlement that was already settled.

Work Weeks during the timeframe of February 26, 2011 through April 30, 2012 shall be weighted as 5% of a standard workweek for any Class Members who already settled a portion of their claims during that timeframe through the Davis/Mitchell-Straub settlement. For Class Members who opted out of the Davis/Mitchell-Straub settlement that had a class ending period of April 30, 2012, such Class Members’ Work Weeks will be calculated beginning on February 26, 2011 and weighted 100% of standard Work Weeks

  40. Allied Universal says:

40 Dollars!!!!!!!!! worse lawyers EVER!!!! Mr. Stone get yourself a better lawyer next time…

  41. Another One says:

It seems like some people are receiving checks but in different amounts?? Im not sure how that is, But im hoping i get what was “estimated” to me. Yes it is FREE money to all of us, BUT when i read $42 or $43 or $900, those are big gaps. All we can do is be grateful on a “free check” given to us.

    • Damein says:

It’s not a free check! It is money owed to us by Universal Protection Services due to them not giving breaks and felling to pay overtime wages. Everyone that is apart of this lawsuit worked and, deserves what is owed to them!

  42. Nothin yet says:

I haven’t recieved anything yet as of the 26th

  43. Bricke Fraijo says:

I’m in San Bernardino CA. And we haven’t received a check yet and we are all expecting more then what I have read too. I know every one will be very up set

    ADMIN – Hi Bricke,

    ADMIN – Hi DH,

I don’t think that is the case. Settlements always take a long time.

  45. Mike B says:

I received my settlement agreement on 12/26/17. I signed settlement agreement & mailed it on 12/29/17. My estimated portion of the settlement is $667.39, based on 155.22 number of workweeks (total hours worked during Class Period /40). To date, I’ve not received a check. It was my understanding that checks were scheduled to be mailed on 10/17/17. Settlement Number 01-15-0002-7497.

    ADMIN – Hi Phillip,

By your narrative your check was probably stolen in the mail. You can try reaching out to class counsel but I doubt they can help.
