Class Eligibility

The Class includes everyone who is, or was, insured under a Florida Automobile Insurance Policy issued by USAA that suffered one or more Total Losses to their vehicles during the period from October 17, 2008 through October 15, 2016 that was determined to be covered by USAA; or received from USAA an Actual Cash Value Payment(s).

Case Summary

This settlement includes United Services Automobile Association, USAA Casualty Insurance Company, Garrison Property and Casualty Insurance Company and USAA General Indemnity Company.

The lawsuit claims that USAA or persons acting on its behalf improperly failed to include the appropriate amount of sales tax when making some Actual Cash Value Payments, in adjusting claims for Total Losses under Florida Automobile Insurance Policies, during the period from October 17, 2008 through October 15, 2016.

USAA maintains that it complied with the terms of the insurance policies and applicable law. USAA has denied all allegations that it acted wrongfully or unlawfully.

    You are not going to get a firm date from anyone. Even the judge and class counsel have no clue how the case will progress.

    The scary part is, in the court’s ruling paperwork, they said every class member must cash their check within 180 days of its issuance date, otherwise that class member will be considered forfeiting their rights to the settlement and claim.

    If no one can provide settlement members with dates on reimbursements, or even check up on confirmation numbers they can provide, who isn’t to say the lack of information is one big ploy to pass that 180 day limitation in an effort for USAA to not pay out? It seems a little shady, the lack of ability to provide any information when provided a website given confirmation number.

    It is kinda ridiculous that we have not been given any updates this year so far. A little more communication would be appreciated. Please remember you are representing men and women from the military and we are depending on you guys to do the right thing. Please advise us all on what’s going on and stop replying with these fake generic replies. It undermines your whole reason for this suit.     I received our check from the settlement I just want to be sure it is legitimate. My husband and I never sent in any forms in regards to this. We just received a check in the mail with all the information enclosed in the envelope. Is it safe to deposit the check?

    I can’t see the check therefore I can’t speak to its legitimacy. If you go to the bank in person they will let you know if it is a valid check.
