AT & T U-verse TCPA Class Action Settlement
Class Eligibility
The Court decided that everyone falling under the following definition is a member of the Settlement Class:
All subscribers to those wireless telephone numbers identified as having lodged a complaint prior to November 18, 2015, regarding receiving a communication from AT&T regarding an AT&T U- Verse account for which they were not the accountholder (excluding subscribers of AT&T wireless and/or U-verse services). You can find the list of affected numbers on exhibit F of the settlement agreement

Each class member who submits a timely claim will receive a base payment of a pro rata share of the Settlement Fund, up to $250 per claimant. If the number of claims is such that the base payment is not sufficient to exhaust the Settlement Fund, the remainder of the Settlement Fund will be distributed on a pro rata basis to the claimants based on the number of automated collection calls made to the person’s telephone number, as reflected in the AT&T call records produced in discovery. This pro rata distribution will be capped at $500 per call, the standard statutory damages under the TCPA.

Case Summary
The Plaintiff filed the lawsuit on behalf of himself and a nationwide class in the United States District Court for the Northern District of Illinois, Eastern Division (the “Lawsuit”) against Defendants AT&T Services Inc. and Illinois Bell Telephone Company (collectively “AT&T”) alleging violations of the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227. Specifically, Plaintiff claims that AT&T placed calls regarding its U-verse service that utilized an automated telephone dialing system or a prerecorded or artificial voice message to the cellular telephone numbers of individuals who did not consent to receive such calls. Plaintiff sought to recover for himself and for each person who received such calls statutory damages of $500 per violation, subject to trebling for any willful or knowing violations of the TCPA. AT&T denies that it violated the TCPA, denies that any calls that may have violated the TCPA were made willfully or knowingly, and denies that Plaintiff and members of the Settlement Class are entitled to any damages.

I’m not sure of the 361, part of telephone number is correct. It was a guess at that part of number, it was to long ago.
I have received phone calls from a prerecorded voice message and I did not consent to receive those calls.
Constant issues with the contract that was signed or not signed! There was never a contract signed except for three months of free hbo and premium channels other than that we had basic cable and Internet and constantly had issues with cable going in and out. With the bill being wrong. Every three months having to call
And find out why the bill went up super high!! Ended up leaving and going with another company

Bad service and very bad customer service I don’t like this company at all I move from this company to the other so lost a lot of money

Overly expensive
My son & I had a AT&T cellphones prior to 2015, Dallas TX 75206 and got automated messages plus!!
Terrible customer service, prices on bills are always different

I have att uverse phone and internet. The internet is awful and so is the phone service. I get probably 8 to 10 calls a day and have been on the do not call list for a long time

I remember having problems, but like many others who have replied, I don’t remember the number. I had a stroke about 6 years ago, and memory is an ongoing issue. What do we do if, even after looking at the list, we just don’t know?

Did anyone else get a letter asking for you to fill out a W-9?

I received a letter asking for ss# because it says that I am eligible to receive more than $600. But in the information in this article and another I read online, it says payouts are capped at $500. Anyone care to explain?

Contact the class action administrator directly. You want to make sure you are not falling victim to a fraud.
Each call is capped at $500, so more than likely you qualified for more than one call. I received the letter and the w-9 form for this settlement. I sent it back thru usps certified mail to ensure delivery and verification of the recipient.
i also received a w-9 from the settlement administrator, which was dated 12/5/17. Has anyone else who received a w-9 form heard anything about a payment timeframe? their giving a deadline in March is a bit discouraging…
and in response to the comments above that mention a previous account with at&t: if i am not mistaken i believe this settlement was for those who were contacted regarding an at&t account for which they were not the account holder. calls were made repeatedly to non customers

Just because you received a claim number doesn’t mean you will receive a check. The settlement checks have been distributed already. I received mine last month. They had records of which numbers were dialed.
