VW said the arbitration clause, buried in clause 11 of its lengthy “Goodwill Package Cardholder Agreements” – is part of the bank terms for the gift cards and is not designed to fool consumers into waiving their legal claims against Volkswagen.
But Williams-Derry cautioned that “the clause is worded extremely broadly, and the courts have history unfortunately of interpreting these clauses expansively.”
The agreement dictates that any arbitration must brought in Sioux Falls S.D., a location “that is an extremely inconvenient” for the vast majority of VW diesel car owners, Williams-Derry said.
VW is doing everything to kill their brand! They are arrogant and must think we are really stupid…. “No one but a few misguided souls did all this. REALLY – how many patents do the own and file ALL THE TIME – but after solving a problem so one else could solve to bring their engines into compliance in America, no one thought of filing a patent and no one ever wondered what was going on in the GERMAN engineering back rooms.
REALLY – I don’t want to use generalizations but history would suggest they might want some control over what was going on.
Give me and everyone else who purchased a car under false, really criminal, circumstances our money back. Stop crying over how tough it is for VW. AND DO IT QUICKLY WITHOUT SLICK ARBITRATION clauses – being the last paragraph on 3 pages. It disgusting! What a bunch of “entitled” jerks! If you had any understanding of America, you would have at least offered new products replacements to keep your client base… idiots! Customers like me are “priceless”! But you will find out that price, your Brand Reputation.
This is a serous crime! VW should be banned from importing ANY TYPE of motor or automobiles into the USA as they intentionaly put more poisons into the air we breath just for profit! Kinda reminds me of the NAZI party back in the old days. VW must really hate everyone in America to commit such a large crime involving so many inocent VW car buyers who loved the brand only to get screwed by the brand they loved and respected! Shame on you VW, I will never trust that brand ever again, wonder what else they did to push sales, its probably all a lie!
I own two Jetta TDI models. One is a 2009 and the other is a 2012.
I have a factory trained VW mechanic I use for maintenance and oil changes, etc. I have owned six different Volkswagens over the past 15 years. 3 were diesel models. We love the diesels because of the great mileage. I have a 2012 Jetta and paid approximately $ 3,000
to upgrade to the TDI model.
We got two letters and I wrote Volkswagen right back and said I did NOT want the dealership to keep my hard earned money. I requested 4 prepaid Visa cards.
I have not heard from Volkswagen as yet. Unfortunately for Volkswagen, my son works at a Seattle, Washington law firm and my brother-in-law has his own firm in Texas.
I am trying to be patient and see what happens.

VW is a bunch of liars, they lie to congress and the American people. I hope the government will stand up to VW and fine them big. They give us $500 and the dealers get $500. To say deport VW

No way will VW ever get access to my TDI. I love it just the way it is.
