Case Summary
The lawsuit claims that Wendy’s was responsible for the Data Breach and asserts claims such as: breach of implied contract, negligence, violation of the Florida Deceptive and Unfair Trade Practices Act, violation of the New York Business Law, N.Y. Gen. Bus. Law §§ 349 et seq., violation of the Tennessee Consumer Protection Act, Tenn. Code Ann. §§ 47-18-101 et seq., violation of the New Jersey Consumer Fraud Act, violation of the Texas Deceptive Trade Practices – Consumer Protection Act. Wendy’s denies these claims and says it did not do anything wrong. The restaurants affected by the breach were independently owned by franchisees and were not owned or controlled by Wendy’s itself.

      When I ate at Wendy’s, their square patties were red on the inside. When I got their fries with chili and cheese, there was green mold on the cheese and the chili was cold. Then I got a frosty only to get half water and half whatever. I don’t appreciate Wendy’s doing what they’re doing with their food nor do I appreciate the prices for the crappy food and service. The Wendy’s I’m talking about is West Virginia off Patterson Drive; don’t go there nor eat there. You will regret it nor would you get your money back.

    I purchased food from the Wendy’s restaurant on Midway Drive in San Diego. Wendy’s would deny the claims. I worked for Wendy’s when I was 18 years old. At that time, I soon found out the Manager was stealing monies from the register. New employees who worked the register were always short $100 or more. No one could understand why. A couple of years later it hit the Union Tribune in San Diego about what the manager was doing. I’m not surprised.

    At one time, I worked at the Wendy’s in the Florida Keys but have always been a customer, still am, at the Wendy’s where I live now – Huntsville, AL. and The Woodlands, TX. where I lived for many years. Wendy’s has always been one of my favorite fast food restaurants.
