Case Name

Golden, et al. v. Contextlogic Inc. d/b/a Wish.com,
Case No. 17PH-CV01741
Circuit Court of Phelps County, Missouri

Case Summary

Wish.com sells a wide variety of items on its website. Wish often advertises discounts or sale items, along with an “original” or “regular” price and a corresponding percent discount from that “original” price to the sale price.

The Plaintiffs who filed this case allege that the “original” prices are often inflated higher than the real “original” price. As a result, the Plaintiffs allege that Wish.com advertises discounts that are greater than in reality in order to induce people to buy these “sale” items.

The Plaintiffs presently bring claims against Wish.com for (i) violations of the Missouri Merchandising Practices Act; (ii) Unjust Enrichment, (iii) violations of the California Consumers Legal Remedies Act, (iv) violations of the California Unfair Competition Law; and (v) violations of the California False Advertising Act.

Wish.com denies the accuracy of the Plaintiffs’ allegations and denies that it violated any law or caused any harm as alleged in the Lawsuit.

  1. Cheryl Ongley says:

I have purchased multiple items that were advertised with a suggested retail price much higher then the actual quality worth of the product that I received. Very disappointing.

    ADMIN – Hi Cheryl,

Hence the class action. File your claim.

  2. Neda Hampton says:

The Pricing on original price and discounted prices seems fishy

    ADMIN – Hi Neda,

Very insightful indeed. It is because of pricing issues that this settlement was approved.

  3. Cindy Snow says:

Prices did not add up. Thank you Class Action…

    ADMIN – Hi Cindy,

    You are quite welcome.

  4. Penny Loper says:

I have purchased multiple times from Wish. I believe the prices are sometimes inflated.

    ADMIN – Hi Penny,

If you are a class member by all means file a claim using the link provided.

  5. Jennifer Duenow says:

I received several irritating text messages and emails stating that I had a credit and the money can be used on the wish.com website to shop with. Went to website to spend my credit but ended up being for items way overpriced. So much so that the credit wasn’t a credit but a discount on a item that was 2x’s more than anywhere else

    ADMIN – Hi Jennifer,

If you purchased items from Wish file a claim

  6. Dani Lynn Chewning says:

I bought many items from Wish, but I don’t have proof. What do I do now?

    ADMIN – Hi Dani,

How about you log into your account and find proof?

    • Jon Gurian says:

I have used them for years and when i went in i saw that my log has been purged by them. Now what?

      ADMIN – Hi Jon,

Contact class counsel, perhaps they can provide you with some guidance.

  7. Tiffany Lynn Shields says:

I’ve ordered over 100 items from wish what do I do in that case

    ADMIN – Hi Tiffany,

You file for the maximum available.

  8. Evlon Mckain says:

I have proof of purchases I made on wish but I don’t have screenshots from other retailer within 90 days of purchase…

    ADMIN – Hi Evlon,

Why would other retailers be relevant to this claim?

    • Sheryl says:

To the Admin: Because the claim states: ” (2) proof of the “original” prices from other retailers (online or bricks-and-mortar) advertising the identical items you purchased from Wish.com within 90 days of the date you made your purchases.” and so you have to have the proof. What do you do if you don’t?

      ADMIN – Hi Sheryl,

If you are not able to provide proof of either (1) or (2), then you can provide a statement, under penalty of perjury, detailing why you could not find the required documents. The Settlement Administrator (not Wish.com) will determine whether your statement adequately explains the reason you could not provide the required proof. The Settlement Administrator may take into account whether your statement is notarized.

    • Nadia says:

      Hi admin,

The tier 1 & tier 2 levels ask us to attach the following: (2) proof of the “original” prices from other retailers (online or bricks-and-mortar) advertising the identical items you purchased from Wish.com within 90 days of the date you made your purchases. Examples of “proof” may be receipts, screen shots, newspaper advertisements, etc.

      ADMIN – Hi Nadia,

I believe there are archives on the web of old advertisements.

  9. tammy simms says:

I received some jewelry as gifts. My mom bought these and she has passed away since. I received these items. I have found these items at kohls and they were much cheaper.

    ADMIN – Hi Tammy,

This is not the idea behind this settlement. This settlement is about Wish saying they at one point or another sold items for a certain price and then discounted.

  10. gwenda bowman says:

    purchase with my bank card

    ADMIN – Hi Gwenda,

If you are a class member please file a claim

Your PayPal account keeps records of all your transactions.

  12. Jamie Pozezinski says:

I have purchased items from this site that state they are discounted, but then I found them much cheaper only days later.

    ADMIN – Hi Jamie,

That is not the core reason of this settlement, please refer to our main page and read it carefully. There is a good chance you are a class member.

  13. Tara Briscoe says:

I stopped buying items from wish because of this issue and because some items were misleading. I’m still waiting on about 4 items from wish to still arrive. I couldn’t stand being inundated with their emails and so I uninstalled their app and you have to have to have the app to check on statuses of your orders or history of your account, very frustrating!

    ADMIN – Hi Tara,

You can go online and use your login and password.

  14. Teena Franklin says:

I will never purchase anything from wish again they not right.

  15. Nancy fritts says:

I bought a lot of stuff from wish but how do I copy it

    ADMIN – Hi Nancy,

What are you trying to copy?

  16. Lee Anne Witmer says:

I was also purchased several items but I don’t have a receipt. The only thing I might have is a transaction on my credit card from wish

    ADMIN – Hi Lee,

Why don’t you log in your account and see if you still have records.

  17. A. C. says:

Do you have to reside in the states mentioned on the claim, where the laws are claimed to be violated, in order to qualify as a member of this action?

    ADMIN – Hi AC,

All persons in the United States of America between June 6, 2013 and December 12, 2017 who purchased one or more products at a discount off of the stated “original” or “regular” price, and who have not received a refund or credit for their purchases.

  18. Sharon says:

They continue to do this. It is absolutely ridiculous. I noticed the price hike after I added coupon code so I just didn’t buy. But wow-shady!

    ADMIN – Hi Sharon,

Not about price hike in the cart. Settlement is about false original pricing.

  19. Stella Ordoubegian says:

the items I received were not the right size and jewelry were not even useable

    ADMIN – Hi Stella,

This settlement is not about size or function. It is about price.

  20. Rhonda says:

So they are making it impossible to recover funds, no way I can find things advertised from 2013 or 2014 or 2015 etc!!! I have purchased a lot of things from wish and can show all this through my PayPal account but that’s my only proof. I need help with this!!

    ADMIN – Hi Rhonda,

We are purely an informational website and we are unable to provide personalized assistance. If you feel this condition is unfair you may want to contact class counsel.

I buy from wish fair regularly. I’ve brought to their attention several times, pricing issues, misleading advertisements, bait and switchs, and even shipping discrepancies. And surprisingly they’re still practising all of it. I believe I need in on this!!!

    ADMIN – Hi Anthony,

If you are a class member please file a claim.

  25. Rhebawells says:

Have no record because of change from iphone to this older smart phone.. Made purchases for materials used in painting and drywall that werent after all discounted but paid original prices!

    ADMIN – Hi Rheba,

Without record you are not likely to get a whole lot.

  26. Sherry King says:

What wish is doing as false advertisement everything that I’ve ordered I have not received it has been something else totally different. So I emailed them through their app and they sent me a response back saying that the vendors send different out of the blue items.

    ADMIN – Hi Sherry,

Sure sounds frustrating. If you are a member of the class consider filing claim.

    • Douglas McDonald says:

Wish changed the picture and discription of the item I ordered after I purchased it and after shipment. This is clear bate and switch as well as false advertising. I intend to file a separate class action lawsuit. Do they have a washington state corporate registry? If so please provide this information. I do not see them listed with the secretary of state.

      ADMIN – Hi Douglas,

I encourage you to consult with a class action attorney.

  27. bonnie proctor says:

i ordered two things and never got a refund the products were never received

    ADMIN – Hi Bonnie,

That sounds like a customer service issue.

  28. Alexander Eckman says:

I have been a customer snce well before this suit. I’ve already claimed my measly few dollars though I have made a lot of purchases. My main issue is the same practices they got sued for are still happening. I just looked at a pair of running shorts that were 11$ marked down from 99$. That’s just one item. These are Chinese made items they sell, every last one of them. How is a pair of running shorts supposed to cost 99$? It doesn’t even have a name brand on it that would justify that. THIS IS STILL HAPPENING.

    ADMIN – Hi Alexander,

I would encourage you to select a vendor that you can trust instead of buying through Wish.

  29. Roberta Sashington says:

I purchase a notebook computer around November Or December and paid $65.00 for it off my debit card and never received the product. I text notes to them about it but no answer and no money place back on my card either. Bad Business.

  30. Melissa says:

Never mind! I see it now!

  31. RAMONA E Bushee says:

This had recently happened to me on three separate orders, can i file a new claim, since it happened January 2018?

    ADMIN – Hi Ramona,

No, you cannot file a claim.

  32. Kevin York says:

I have bought.many items from wish dating back a few years and am still waiting on items purchased in November of 2017…I do not get replies or when I do …told on way … I’ve since changed banking and can’t locate receipts… what do I do ???

    ADMIN – Hi Kevin,

There is not much you can do.

  33. Katie Lewinstein says:

I made several purchases and aside from the poor quality, I never received the highest priced item. I emailed them but never heard back.

    ADMIN – Hi Katie,

The deadline for this settlement has passed. You may no longer file.

  34. QueeNia AsheeMa'at says:

Is it too late to file?

    ADMIN – Hi Q,

    Yes

  35. Blanca Martinez says:

Im always ordering items from Wish. Sometimes i never get my items even tho I’ve paid for them. And the items seem to cost more than at other places.

    ADMIN – Hi Blanca,

Refer to the section titled class eligibility. If you meet the requirements file a claim.

  36. Staci says:

It seems every time you go to buy a clothing item on there it goes up after you click buy. Why do people who are extra small get discounts and it goes up for people who are not tiny? A free item is never free if you are not extra small

  37. Brittney Hollins says:

I didn’t know anything about the lawsuit against wish.com however I have a complaint of my own June 2017 was my first time buying something from wish and I still haven’t gotten it. It was a ring. I started buying things from them again in October or November 2017 I was buying the things that said free just pay shipping and handling which was 6 dollars or more I received a few even though they didn’t look like the picture. Then I brought more items and realized that they are false advertising it say one price however when you check out its another price and I didn’t receive half of the things that I brought and on some items they gave me a refund and on 2 or 3 of them they said that it had to go to the wish cash I said OK. Now I go to use my wish cash and the item says $2.70 however in the check out it was $6.00 and that’s not including the shipping cost. Smh

  38. Nick Brown says:

I actually had an item delivered to a different person at the other end of the country!wish are total twats
