Case Summary sells a wide variety of items on its website. Wish often advertises discounts or sale items, along with an “original” or “regular” price and a corresponding percent discount from that “original” price to the sale price. The Plaintiffs who filed this case allege that the “original” prices are often inflated higher than the real “original” price. As a result, the Plaintiffs allege that advertises discounts that are greater than in reality in order to induce people to buy these “sale” items. The Plaintiffs presently bring claims against for (i) violations of the Missouri Merchandising Practices Act; (ii) Unjust Enrichment, (iii) violations of the California Consumers Legal Remedies Act, (iv) violations of the California Unfair Competition Law; and (v) violations of the California False Advertising Act. denies the accuracy of the Plaintiffs’ allegations and denies that it violated any law or caused any harm as alleged in the Lawsuit.

    I have purchased multiple items that were advertised with a suggested retail price much higher then the actual quality worth of the product that I received. Very disappointing.

    I received several irritating text messages and emails stating that I had a credit and the money can be used on the website to shop with. Went to website to spend my credit but ended up being for items way overpriced. So much so that the credit wasn’t a credit but a discount on a item that was 2x’s more than anywhere else

      To the Admin: Because the claim states: ” (2) proof of the “original” prices from other retailers (online or bricks-and-mortar) advertising the identical items you purchased from within 90 days of the date you made your purchases.” and so you have to have the proof. What do you do if you don’t?

      If you are not able to provide proof of either (1) or (2), then you can provide a statement, under penalty of perjury, detailing why you could not find the required documents. The Settlement Administrator (not will determine whether your statement adequately explains the reason you could not provide the required proof. The Settlement Administrator may take into account whether your statement is notarized.

      The tier 1 & tier 2 levels ask us to attach the following: (2) proof of the “original” prices from other retailers (online or bricks-and-mortar) advertising the identical items you purchased from within 90 days of the date you made your purchases. Examples of “proof” may be receipts, screen shots, newspaper advertisements, etc.

    I received some jewelry as gifts. My mom bought these and she has passed away since. I received these items. I have found these items at kohls and they were much cheaper.

    This is not the idea behind this settlement. This settlement is about Wish saying they at one point or another sold items for a certain price and then discounted.

    I stopped buying items from wish because of this issue and because some items were misleading. I’m still waiting on about 4 items from wish to still arrive. I couldn’t stand being inundated with their emails and so I uninstalled their app and you have to have to have the app to check on statuses of your orders or history of your account, very frustrating!

    What wish is doing as false advertisement everything that I’ve ordered I have not received it has been something else totally different. So I emailed them through their app and they sent me a response back saying that the vendors send different out of the blue items.

      Wish changed the picture and discription of the item I ordered after I purchased it and after shipment. This is clear bate and switch as well as false advertising. I intend to file a separate class action lawsuit. Do they have a washington state corporate registry? If so please provide this information. I do not see them listed with the secretary of state.

    I have been a customer snce well before this suit. I’ve already claimed my measly few dollars though I have made a lot of purchases. My main issue is the same practices they got sued for are still happening. I just looked at a pair of running shorts that were 11$ marked down from 99$. That’s just one item. These are Chinese made items they sell, every last one of them. How is a pair of running shorts supposed to cost 99$? It doesn’t even have a name brand on it that would justify that. THIS IS STILL HAPPENING.

    It seems every time you go to buy a clothing item on there it goes up after you click buy. Why do people who are extra small get discounts and it goes up for people who are not tiny? A free item is never free if you are not extra small

    I didn’t know anything about the lawsuit against however I have a complaint of my own June 2017 was my first time buying something from wish and I still haven’t gotten it. It was a ring. I started buying things from them again in October or November 2017 I was buying the things that said free just pay shipping and handling which was 6 dollars or more I received a few even though they didn’t look like the picture. Then I brought more items and realized that they are false advertising it say one price however when you check out its another price and I didn’t receive half of the things that I brought and on some items they gave me a refund and on 2 or 3 of them they said that it had to go to the wish cash I said OK. Now I go to use my wish cash and the item says $2.70 however in the check out it was $6.00 and that’s not including the shipping cost. Smh

    I also purchased many items from Wish that never even came at all, and then when I told them about it, they said, “I’m sorry, it was over 30 days ago,” so they couldn’t give me a refund.
