I have made many calls to the administrator of this class action lawsuit specifically the ladies names are Judy and Nancy and they are the most vague unprofessional people I’ve ever spoken with this company should never handle another class action lawsuit because they’re not following the orders of the court number one that’s supposed to be keeping their website updated with information pertaining to the settlement and payments and such and they’re supposed to be doing things on a timeline after the approval for the settlement the judge is already approved at the checks be issued and that was done in the end of September I have spoken to them three times since then the latest time I spoke to them was in December at the end of it. The information I was told by Judy at the administrator office is might have the payment sent out by the middle of 2018 that is unacceptable and ridiculous the longer the money sits in the administrators account for distribution the more interest earning on it and who’s getting the benefit of that interest I don’t believe it’s class action members. So today I took it upon myself to call one of the lawyers and they are located in Edmonton Alberta I left a message that I expect to receive a call back from and when I do I will post a response here somebody has to hold these people accountable. The settlement administrator is not following the order of the Court on several points specifically updates to the website and distributing the checks in the time frame that the court has deemed it must be done amongst others

    ADMIN – Hi Ely,

I believe in September there was a letter that indicated an intent to reduce the claims proportionately based on the number of submittals. I would not be surprised if the amount was so small that the attorneys, the court and the administration are having to go back to the drawing table to figure out what is the next step.

  16. David says:

    Dear Admin,
In reading the several posts, I must say I never once received a letter indicating the status or amount of claim members were to receive. I do have my claims number if it would help you retrieve my info.

    ADMIN – Hi David,

You need to contact the admin directly. Think of us as a newspaper for class action settlements. We have no ability to look up records as we do not administer settlements.

  21. Love says:

When will check’s be mail out??thank you are a update

    ADMIN – Hi Love,

I don’t have updates at the moment.

    • Mike says:

According to the attorneys who brought the lawsuits website. They are indicating appeals should be done by June 30th and checks mailed out shortly after. Below is the website and reference (top left of page).

“IMPORTANT NOTICE: March 28, 2018 – The appeal process should be complete by June 30 with cheques to be issued by the claim administrator shortly thereafter.”

  22. Eve says:

I called the Claims Administrator today and was apprised of what actually is going on in regards to any payments being made. The August 2017 email and or letter that was sent out to claimants basically gave each individual whose claim has been approved an opportunity to appeal the fact that there wasn’t enough money to go around for all the claimants to pay out all the damages. This being the case claimants would either have to accept the amount of their claim being lowered or file an appeal. Although the appeal process for XL Foods has presumably been complete, the Claims Administrator told me today, via phone, that several claimants did in fact file appeals of Their Own. Now it is allegedly those Appeals that have slowed down the issuing of any settlement funds.

  23. Apriel Dorsey says:

IMPORTANT NOTICE: July 9, 2018 – The appeal decisions remain pending at this time. We do not have an estimated time which we can provide in terms of the expected date for receipt of the appeal decisions. A further update will be posted as soon as we have more information. Thanks for your patience.

  24. Elyse Dinkelmann says:

As I promised in an earlier post I have been in bi-weekly or monthly contact with one of the lawyers involved in representing the claimants in this case and he has been keeping me up to date on the status of this class action so here are a couple of recent emails that I received from him with status information. Sincerely Elyse dinkelmann

    email #1) I sent June 23rd 2018:
Hi Rick I know you’re probably so tired of hearing from me but we’re almost at the end of June and I’m hoping you’re going to tell me that the decision was rendered and I know you had said when that does happen to the checks will be released pretty quick hoping for some good news please

    His response June 27th 2018:
    Hi Elyse,
The appeal decisions have not yet been received.
I will let you know once I have any more information.
    Best regards,
    Rick Mallett

    email #2) I sent July 10th:
It’s been a couple weeks since I emailed you hoping that there’s some development been almost a year since this was supposed to be closed out when people were supposed to accept the offer the close date for that was September 9th getting close to that date!

    His response: July 10th 2018:
One the appeal decisions are rendered, the claims process should be concluded relatively quickly.
I am hesitant to give another time frame on when the decisions can be expected as there are multiple demands on the court at this time.
We have been assured that they are working as quickly as possible.
I would anticipate decisions in September.

    email #3) I sent August 21st 2018
Rick please tell me there’s been some action on the XL beef class action regards to the judge finally making a decision so that we can get our checks it’s been a year since people were supposed to accept the offer or not it’s been 8 months since the judge heard those who didn’t accept the offer

    His response August 22nd 2018:
I hope to see the appeal decisions soon. I believe the last appeals were heard in April. The waiting period is not unusual but I understand that all are anxious to get this concluded.

I will continue to update as I get more communication from Rick mallet

    ADMIN – Hi Rozalen,

    Thanks for the info.

  26. Mike says:
